Michigan Child Care Licensing: Types, Ratios, and Inspection

Michigan child care licensing requirements are set by the Child Care Organizations Act (Act 116 of 1973) and administered by the Child Care Licensing Bureau within the Michigan Department of Lifelong Education, Advancement, and Potential (MiLEAP).¹² Anyone who regularly cares for unrelated children outside their own home needs a state license, and the specific requirements depend on how many children you plan to serve and whether you operate from a residence or a commercial building.

The Three License Types

The first thing to settle is which license fits your plan, because it drives every requirement that follows.

Family child care home: Runs out of your personal residence and serves no more than 6 unrelated children at any one time.
Group child care home: Also based in a private residence, with a cap of 12 unrelated children. Requires at least one assistant caregiver beyond the licensee.
Child care center: Operates in a non-residential building. No statutory enrollment cap; capacity is set during inspection based on usable space and staffing.

The capacity numbers on home licenses are firm, and they count every unrelated child present for any reason, not just those enrolled in your program.³

Personal Qualifications

To hold a family or group child care home license you must be at least 18, demonstrate responsible character, and show you are able to meet the needs of children in your care.⁴

Center program directors face a higher bar. They must be at least 21, hold a high school diploma or GED, and meet one of several education-and-experience tracks. The clearest path is a bachelor’s degree in early childhood education. Alternatives include an associate’s degree in early childhood education paired with 480 hours of child care experience, or a child development associate credential paired with 960 hours. Every track requires at least 18 semester hours of early childhood education or child development coursework.⁵

Background Checks

A child care background check is required for the applicant, every adult household member in a home-based facility, the center director, all staff, and any volunteer with unsupervised access to children. The check includes fingerprint-based criminal history through the Michigan State Police and the FBI, plus a name-based search of Michigan’s Child Abuse and Neglect Central Registry. Anyone listed on that registry as a perpetrator is automatically ineligible.⁶

Health and Training You Must Complete Before Applying

A Medical Clearance Request (form BCAL-3704-CC) signed by a licensed physician is required before your application can move. Tuberculosis test results are required for every person living in the home who is 14 or older, and for any assistant caregivers.

You also need current certifications in pediatric CPR, first aid, and bloodborne pathogen training. Home-based providers must complete an online infant safe sleep training course as well.³

Facility and Safety Standards

Indoor Space

Family and group child care homes must provide at least 35 square feet of safe, usable indoor floor space per child, excluding bathrooms and storage areas.⁷ Centers must provide 42 square feet per child for infants and toddlers and 35 square feet for preschoolers and school-age children.⁸ The licensing consultant will measure the actual rooms during inspection, and closets, bathrooms, and furniture footprints all come out of the total.

Outdoor Play Areas

Outdoor play space must be enclosed by a fence or natural barrier at least 48 inches high with no gaps a child could squeeze through.⁹ Inspectors check gate latches, fence integrity, and whether the play surface is free of tripping hazards and toxic plants.

Fire and Carbon Monoxide Equipment

Every licensed facility needs working smoke detectors and at least one multipurpose fire extinguisher rated 2A-10BC or higher on each floor used by children. Home-based facilities need a carbon monoxide detector on every floor used for child care.³ Centers require carbon monoxide detectors in any building with a fuel-fired heating system, placed on all levels approved for child care and in each area covered by a different furnace zone.¹⁰ A posted evacuation plan covering fires, tornados, and serious injuries is also required.

Environmental Health Checks

Home-based facilities must test for radon gas before the initial license is issued and again every four years at renewal. The radon concentration in the lowest level of the home used for child care cannot exceed 4 picocuries per liter of air. If a test comes back higher, you install a mitigation system and retest before the license issues.¹¹ This applies statewide, not just in certain areas.

Facilities with a private water source must follow Michigan’s Lead and Copper Rule for sampling. Those on community water are strongly encouraged to test voluntarily.¹² If the home draws from a private well, the licensing bureau arranges and pays for an environmental health inspection.

You also need proof that your furnace and any fuel-fired water heater have been inspected and approved by a licensed heating contractor within the past 12 months. Centers arrange a separate fire safety inspection, unless the facility is inside a school building with its own fire inspection certification.¹³

Staff-to-Child Ratios for Centers

Centers must maintain minimum staff-to-child ratios at all times, and the count includes children of staff members who are present.

Infants and toddlers (birth to 30 months): 1 staff to 4 children, maximum group size 12.
Preschoolers (30 months to 3 years): 1 to 8, maximum group size 24.
Preschoolers (3 to 4 years): 1 to 10, maximum group size 30.
Preschoolers (4 years to school-age): 1 to 12, maximum group size 40.
School-age children: 1 to 18, maximum group size 54.

Small capacity centers follow a simplified ratio of 1 staff to 6 children, with no more than 4 of those children under 30 months.¹⁴ Build the staffing plan with cushion. Getting caught understaffed during an inspection is one of the fastest ways to receive a violation.

The Application

Fees and Forms

Applications go through the MiLEAP portal, with a non-refundable fee due at submission:

Family child care home: $50
Group child care home: $100
Child care center (1–20 children): $150
Child care center (21–50 children): $200
Child care center (51–100 children): $250
Child care center (101+ children): $300

Home fees are confirmed on MiLEAP’s licensing page,³ and center fees scale with intended capacity.¹⁵

After the online submission, supporting documents go by mail to the Bureau of Community and Health Systems in Lansing. For a home-based application, that packet includes:

Zoning approval form BCAL-3748 (required for group homes; family applicants should still verify local zoning).¹⁶
Medical clearance form BCAL-3704-CC for the applicant and each assistant caregiver.
TB test results for everyone in the home age 14 or older and all assistant caregivers.
Current CPR, first aid, bloodborne pathogen, and infant safe sleep training certificates.
Background check fingerprint enrollment for everyone required.
Heating and water heater inspection dated within 12 months.
Radon results at or below 4 picocuries per liter.

Center applicants add a staffing plan, documentation of the program director’s qualifications, and a fire safety inspection report.¹⁵ Every field on every form has to be completed. Blanks are the most common reason packets bounce back.

Orientation and Inspection

Home-based applicants must attend a six-hour orientation session arranged by the local licensing office after the application is submitted.¹⁷ The inspection cannot be scheduled until orientation is complete.

A licensing consultant then visits the facility. They measure rooms, check extinguisher ratings and placement, test smoke and carbon monoxide detectors, inspect the outdoor play area, and review the posted evacuation plan. Any deficiency generates a corrective action plan, and you cannot open until every item is resolved.

After You’re Approved

The Six-Month Provisional Period

Once the facility passes inspection, the state issues an original provisional license valid for six months.¹⁵ At the end of that period, the department issues a regular license, refuses to renew, or extends provisional status if issues remain unresolved.¹⁸ The consultant may return during those six months to confirm compliance under real operating conditions.

Renewal

You must submit the renewal application and fee at least 45 days before your license expires. Missing that window closes the license and forces you to stop operating. Renewal requires updated background checks for any new staff or household members, a current fire safety inspection (or a no-change declaration if no construction has occurred), a current heating system inspection, and proof that all training certifications remain valid.¹³ Radon retesting comes due every four years.¹¹

Insurance Sits Outside the License

The licensing rules cover safety standards and staffing. They do not cover your liability if a child is injured. Most providers carry general liability insurance for bodily injury and property damage claims, and many add professional liability coverage for allegations of staff negligence. If employees will drive children in personal vehicles, standard auto policies often exclude business use, so ask your agent about a commercial or non-owned auto policy.

Typical annual premiums for a small child care business run roughly $1,100 to $1,500, though the number depends on capacity, claims history, and higher-risk services like transportation or overnight care. Home-based providers should also confirm their homeowner’s policy does not exclude business activities, because many do.
