Where a Sump Pump Can Legally Discharge
The state recognizes several ways to handle discharge without burdening the sanitary system. The right choice depends on your lot, soil, and neighbors.
Surface Discharge on Your Own Property
The simplest option is discharging onto the surface of your yard, provided the water soaks in on-site and does not create a nuisance next door. Direct the outlet away from your foundation so the water does not loop back toward the basement. A low-lying garden bed or graded swale works in most Michigan soils. Heavy clay lots absorb poorly and may need a different strategy since the water pools instead of soaking in.
Municipal Storm Sewer
Where a dedicated storm sewer is available, connecting to it is the most reliable option for homes with high water volume. Dry Well
A dry well is an underground chamber, usually a gravel-filled pit or a perforated barrel, that holds discharge water and lets it seep into surrounding soil. Placement Limits That Apply to Every Method
Whichever method you use, you cannot discharge onto public sidewalks, into the street, or in a direction that damages a neighbor’s property. Michigan municipalities treat this as a nuisance violation, and local ordinances commonly prohibit increasing surface water flow onto adjacent properties or public roads. Setback distances from property lines and rights-of-way vary by municipality, so check your local code before deciding where the pipe will terminate.
Installation Requirements Under the Plumbing Code

Check Valve and Full-Open Valve
Section 712.2 requires a check valve and a full-open valve on the discharge side of the check valve, installed in the pump discharge piping between the pump and the drainage system.5ICC. Without one, water flows backward, the float switch triggers again, and the pump cycles until the motor burns out. Approved Pipe Materials
Section 712.3.3.1 limits sump pump discharge piping to copper or copper-alloy, CPVC, ductile iron, polyethylene (PE), or PVC.5ICC. PVC is the most widely used in residential installations because it is inexpensive, easy to work with, and handles the pressure range of typical sump pumps. Sump Pit Specifications
The sump pit must be at least 18 inches in diameter and 24 inches deep unless your local authority approves an alternative. It needs a solid bottom that permanently supports the pump, and a gastight removable cover installed no more than 2 inches below floor level. Skipping the permit does not just risk a fine; it can complicate a future home sale when the buyer’s inspector flags unpermitted work.

Winter restrictions are the most common example. Many Michigan communities prohibit discharge onto driveways, sidewalks, or street gutters during cold months to prevent ice buildup. An icy sidewalk caused by your discharge can bring a citation and, worse, personal liability if someone slips. Some communities require winter discharge to be redirected to a storm sewer connection or contained on-site during freezing conditions.
Local codes also regulate the proximity of discharge outlets to public rights-of-way and often require a separate permit for any connection to a municipal storm grate or curb inlet. Those permits involve an administrative fee and an inspection to confirm the connection does not interfere with city infrastructure. Freezing Is a Code Problem in Michigan
Because you cannot discharge into the sanitary sewer, the pipe has to run outside, and outside means winter. Frozen discharge lines are among the most common sump pump failures in Michigan. When the line freezes, the pump has nowhere to send water. It either cycles until the motor burns out or the pit overflows into the basement.
