Missouri TANF: Eligibility, How to Apply, and the 45-Month Limit

Missouri’s TANF program, officially called Temporary Assistance, provides monthly cash payments to low-income families with at least one dependent child. The Family Support Division within the Missouri Department of Social Services runs the program. Benefits are capped at 45 months over your lifetime, most adults must participate in work activities, and every applicant goes through a drug screening questionnaire. The cash grant itself is calculated as the difference between a percentage of the state’s standard of need for your household size and your countable income.

Who Qualifies

Your household must include at least one child who is under 18, or under 19 if the child is still in high school or an equivalent vocational program and expected to finish before turning 19.1Missouri Revisor of Statutes. RSMo Section 208.040 The child has to live with a parent or a qualifying relative. Missouri’s definition of qualifying relative is broad: grandparents, siblings, step-siblings, stepparents, aunts, uncles, first cousins, and nephews or nieces all count.2WIOA State Plan Portal. The child must also have been deprived of parental support because a parent died, is continuously absent from the home, or is physically or mentally incapacitated.1Missouri Revisor of Statutes. RSMo Section 208.040 Both the payee and the children have to be Missouri residents, and everyone must be either a U.S. citizen or a qualified alien who has lived in the United States for at least five years.2WIOA State Plan Portal. You will need to provide Social Security numbers for each parent, caretaker, and child.1Missouri Revisor of Statutes. RSMo Section 208.040 You also have to cooperate with the Division’s Child Support program by sharing whatever information you have about any non-custodial parent: names, addresses, employers, physical descriptions, vehicle details.3Legal Information Institute. Income and Asset Limits

Missouri runs two financial tests. First, your household’s gross income (minus only self-employment overhead) cannot exceed 185 percent of the Consolidated Standard Expense for your household size.5DSS Manuals. 0210.010.05 185 Percent Income Eligibility Limit If you pass that, a second calculation applies: your net income after earned-income disregards must fall below 34.526 percent of the standard of need for your household size, and your cash grant equals the difference between that threshold and your countable income.6Missouri Department of Social Services. Temporary Assistance for Needy Families Program TANF State Plan

On the asset side, your total countable resources cannot exceed $1,000. That limit rises to $5,000 if you are participating in an Individual Employment Plan. Your home and up to 40 adjoining acres do not count. Your first vehicle is excluded entirely, and up to $1,500 in equity in a second vehicle is also excluded.7Legal Information Institute. Documents to Gather Before You Apply

Missing paperwork is the most common reason applications stall. Pull together four categories of documents in advance.8Missouri Department of Social Services. Verify

  • Identity for each adult: driver’s license, state ID, pay stub, or voter registration card.
  • Citizenship or immigration status: U.S. birth certificate, passport, certificate of naturalization, or proof of qualified alien status.
  • Missouri residency and shelter costs: rent receipts, lease, utility bills, mortgage statement, or mail showing your address.
  • Income: pay stubs, a letter from your employer, or business records with a Schedule C if you are self-employed. Bring award letters for any Social Security, unemployment, or other benefits you receive.

How to Apply

The application is Form IM-1TA, Application for Temporary Assistance Cash Benefits. You can submit it five ways, but applying online at mydss.mo.gov is the fastest.9DSS Manuals. IM-1TA Application for Temporary Assistance Cash Benefits Supporting documents can go through the FSD Document Upload Portal, by fax, or by mail to the Family Support Division.10Missouri Department of Social Services. If you apply online or use the IM-1TA long form, a face-to-face interview is generally not required.11Missouri Department of Social Services. DSS Manuals – 0203.050.00 Interview Process That means you may never need to visit an office. If you submit through a shorter form or another channel, the state may schedule an interview to verify your household details.

Expect a drug screening questionnaire as part of intake. Depending on your answers, you may be referred for an actual drug test, and you must cooperate with the screening to receive benefits.12DSS Manuals. 0240.005.10 Drug Screening – Applicants

The Division works from a 30-day processing window. If you are approved but do not receive your first payment within the month in which the 30th day after application falls, the Division must issue a delayed payment covering that month and any months before approval came through.2WIOA State Plan Portal. Work Requirements After You Are Approved

Most adults who receive Temporary Assistance have to participate in Missouri Work Assistance (MWA), the state’s employment and training program.13Missouri Department of Social Services. MWA Handbook The weekly hours depend on your household:

  • Single parent with a child under 6: 20 hours per week.
  • Single parent with all children 6 or older: 30 hours per week.
  • Two-parent household with a child under 6 and no childcare subsidy: 35 hours per week.
  • All other two-parent households: 55 hours per week.

Qualifying activities include job search, vocational training, subsidized employment, and community service. You are not required to participate if you are over 60, permanently disabled, caring for a disabled family member in the home, caring for a child under 12 weeks old, or experiencing domestic violence that would make participation harmful.14Missouri Department of Social Services. If you fail to meet your hours without good cause, the Division first attempts a conciliation process. If that fails, your cash grant is cut by 25 percent until you comply. A second or later sanction lasts at least three months or until you comply, whichever is longer, though the Division can lift it earlier if you show a genuine willingness to cooperate.15DSS Manuals. 0295.025.00 Sanctions

The 45-Month Lifetime Limit

Missouri caps Temporary Assistance at 45 cumulative months for any adult in the household. The months do not need to be consecutive, and months of TANF cash assistance received in other states count toward the total.16Legal Information Institute. Missouri Code 13 CSR 40-2.350 – Time Limit for Receipt of Temporary Assistance Once you reach 45 months, a family that includes you is no longer eligible for cash assistance.

Some months do not count against the limit:

  • Months when your household includes someone who has been battered or subjected to extreme cruelty.
  • Months when you are permanently and totally disabled, as determined by SSDI, SSI, employer-sponsored disability, or the state’s Medical Review Team.
  • Months of receipt while you are 60 or older.
  • Months when you were a minor and not the head of household or married to the head of household.
  • Months when you are required to remain home to care for a disabled family member.

Missouri also offers hardship extensions beyond 45 months, including extensions for domestic violence situations.17DSS Manuals. 0205.075.45 Application Process After the Forty-Five Month Lifetime Limit If you are nearing the limit and think an exemption or extension may apply, raise it with your caseworker early. The Division tracks your months and should notify you as you approach the cap, but do not rely on that notice alone.18DSS Manuals. 0205.075.00 Forty-Five Month Lifetime Limit

Where You Cannot Use Your Benefits

Federal law bars using your TANF card for electronic transactions at three categories of businesses: liquor stores (retailers that sell primarily or exclusively alcohol), casinos and gambling establishments, and retail businesses featuring adult entertainment where performers disrobe.19Office of the Law Revision Counsel. 42 USC 608 The ban applies to ATM withdrawals and point-of-sale purchases at those locations regardless of what you are buying.20Administration for Children and Families. Missouri adds its own prohibitions. Using TANF funds to buy alcohol, tobacco, lottery tickets, illegal drugs, or controlled substances without a valid prescription is treated as misuse of benefits and can bring sanctions or disqualification.21Missouri State Auditor. If You Are Denied or Your Benefits Are Cut

You can request a fair hearing on any Family Support Division action you disagree with, including a denial or benefit reduction. The request can be verbal or written, and you have 90 calendar days from the date on the action notice to file it.22Missouri Department of Social Services. Hearings Manual Hearings are held by telephone with a hearing officer. You can represent yourself or bring an attorney or anyone else to help, review the Division’s documents, present evidence and witnesses, and cross-examine the Division’s witness. If you fail to appear without good cause, the hearing is dismissed, so put the date on the calendar as soon as it is scheduled.
