Mitchell-Lama housing eligibility and how to apply come down to three things on the eligibility side — your household income, the number of people in your household, and whether the apartment will be your primary home — and on the application side, entering the waiting-list lottery for a specific development through either the NYC HPD Mitchell-Lama Connect portal or the state HCR Automated Waiting List system. Each building sets its own income ceilings and runs its own list, so you apply to individual developments rather than to the program as a whole.
Who Qualifies
Mitchell-Lama is a New York affordable housing program for moderate- and middle-income households, created in 1955 under the Private Housing Finance Law.1Mitchell-Lama Residents Coalition. Legislative History of the Mitchell-Lama Buy-Out Provision Two agencies supervise the developments: the NYC Department of Housing Preservation and Development (HPD) inside the city, and NYS Homes and Community Renewal (HCR) statewide.2Homes and Community Renewal. Income Limits
Income ceilings vary by whether the development is a rental or a cooperative, whether it receives federal assistance, and how many people are in the household. For HPD-supervised buildings in New York City, the 2025 published limits for federally assisted rentals top out at $90,720 for a single person and $171,120 for a household of eight. Cooperative and non-federally assisted developments allow higher incomes, running from $141,750 for one person up to $267,375 for eight.3NYC Housing Preservation & Development. Being slightly over the ceiling isn’t an automatic no. If your income falls between 100% and 125% of the admission limit, you can still be admitted, but you’ll pay a surcharge on top of your regular rent or carrying charges from your first month.4NY.Gov. 2024 HUD Program Income Limits and Revised Mitchell-Lama Alternate Income Criteria and Income Review Surcharges Asset limits also apply. The dollar threshold varies by development and can change over time.
Household Size and Occupancy
Your household has to fit the apartment. HCR sets these minimum and maximum occupancy standards:
- Studio: 1 to 2 people
- 1 bedroom: 1 to 2 people (up to 3 at management’s discretion)
- 2 bedrooms: 2 to 4 people (up to 5 at management’s discretion)
- 3 bedrooms: 4 to 6 people (up to 7 at management’s discretion)
- 4 bedrooms: 5 to 8 people (up to 9 at management’s discretion)
- 5 bedrooms: 7 to 10 people (up to 11 at management’s discretion)
The optional maximums apply only if management chooses to allow them and there’s no conflict with local fire or housing codes.5Homes and Community Renewal. Primary Residence
The apartment must be your primary home, every day you live there. The named leaseholder has to be at least 18, and you can’t collect any payment from guests or other occupants in exchange for letting them stay.7NYC.gov. How to Apply
You don’t apply to Mitchell-Lama the program. You apply to a specific development, whose management company runs its own waiting list.
Finding an Open Lottery
For HPD-supervised buildings in New York City, search open waiting-list lotteries through the Mitchell-Lama Connect portal. Creating an account there also signs you up for email alerts when new lotteries open. For HCR-supervised developments, the Automated Waiting List lets you check your position once you have an application number.8ACCESS NYC. The Lottery, the Fee, and the Wait
When a waiting list opens, applications go into a lottery. A non-refundable $75 application fee applies for each development you apply to.3NYC Housing Preservation & Development. Mitchell-Lama Program – HPD Winning the lottery puts you on the waiting list. It does not give you an apartment. Actual availability can take years, sometimes a decade or more, so applying to several developments is normal.
Veteran Preference
Under the Private Housing Finance Law, limited-profit Mitchell-Lama developments must give admission preference to veterans, or their surviving spouses, who served on active duty and live in New York State. A small number of older limited-dividend developments are exempt.9Homes and Community Renewal. Rental or Cooperative: What You’re Applying For
Mitchell-Lama buildings come in two forms, and the form changes what admission actually means. In a rental development, you sign a lease and pay monthly regulated rent that’s typically well below the local market. In a cooperative, you buy shares in the corporation that owns the building, and those shares give you the right to occupy a specific unit under an occupancy agreement. Both rents and co-op carrying charges have to be approved by the supervising agency.
One boundary worth understanding before applying to a co-op: Mitchell-Lama cooperatives are limited-equity. The resale price is capped by a formula in the Private Housing Finance Law, equal to what you originally paid for the shares, plus any capital assessments or voluntary contributions you made, plus your proportionate share of the mortgage principal the co-op paid down while you owned.11New York State Senate. New York Private Housing Finance Law 31-A Buying into a Mitchell-Lama co-op is a way to secure affordable housing, not to build market-rate equity.
What You’ll Pay After You Move In
Rental tenants pay regulated monthly rent. Cooperative shareholders pay carrying charges, which work like monthly maintenance fees and cover operating costs, mortgage payments, and property taxes.
If your household income later climbs above the limit for your development, you don’t have to move, but you’ll owe an income surcharge scaled to how far over you are. At the top end, households at 150% or more of the limit pay a surcharge equal to 50% of their base rent or carrying charges.7NYC.gov. Rules of the City of New York Chapter 3 – City-Aided Limited Profit Housing Companies The surcharge is recalculated every year through the affidavit process, so it moves with your income.12Homes and Community Renewal. Keeping the Apartment: Annual Affidavits and Succession
Every household in a Mitchell-Lama development has to file an annual income affidavit disclosing the total income of everyone living in the apartment. The supervising agency uses it to determine your surcharge and confirm continued eligibility.13NYS Division of Housing and Community Renewal. HM-73 Occupants Annual Affidavit of Household Income Calendar Year 2024 – 2025 Fillable Income What you report can be verified against the NYS Department of Taxation and Finance.
The penalties for missing the affidavit are steep and worth memorizing. Missing the April 30 filing deadline triggers a $50 non-refundable administrative fee. If you still haven’t filed by May 31, management must notify you that the maximum 50% surcharge will be added to your rent. Affidavits received after June 30 automatically trigger the 50% surcharge, and that amount is non-refundable even if you later prove your income was within limits.14NYS Division of Housing and Community Renewal. 2024 B 3 Occupants Annual Affidavit of Household Income – Income Review Procedure Refusing to cooperate with an income audit triggers the same surcharge.
Succession is how a family member keeps the apartment when the primary tenant or shareholder dies or moves out. To qualify, the family member must be an authorized relative (spouse, child, parent, sibling, grandchild, or grandparent), must have been listed on the household’s annual income affidavits, and must have lived in the apartment as their primary residence for at least two consecutive years before the primary tenant left. If the person seeking succession is 62 or older or has a qualifying disability, the co-residency requirement drops to one year, and temporary absences like hospitalization generally don’t break the clock. People who aren’t related by blood, marriage, or adoption can also qualify if they can show emotional and financial interdependence with the primary tenant, weighed through factors like length of the relationship, shared finances, holding themselves out publicly as family, and formal steps like wills or powers of attorney.15NYC.gov. Application for Succession Instructions
Two habits protect a Mitchell-Lama apartment across generations: filing the affidavit on time every year, and making sure every household member who might one day need succession rights is listed on it.
