Montana Code Annotated: Structure, Citations, and Effective Dates

The Montana Code Annotated, usually shortened to MCA, is the official, organized collection of every state statute currently in force in Montana. It covers criminal law, property, taxation, family matters, environmental regulation, and nearly every other area the legislature has acted on, arranged by subject so you can locate a specific rule without reading the whole code. The Montana Constitution is published alongside it. You can read the entire MCA for free on the Montana Legislature’s website at legmt.gov.1Montana State Legislature. Home – Montana Legislature

How the Code Is Organized

The MCA uses a four-level hierarchy that moves from broad subject areas down to individual rules.

At the top are numbered Titles, each covering a major area of state concern. Title 45, for example, holds Montana’s criminal laws.2Montana Legislature. Montana Code Annotated 2021 – Title 45 Crimes Each Title is divided into Chapters that group related statutes. Within Title 45, Chapter 5 addresses offenses against the person and Chapter 6 covers offenses against property. Chapters are further broken into Parts, which cluster statutes by their specific function, and each Part contains individual Sections, which hold the actual text of a single law.

This layered structure keeps thousands of statutes logically sorted. Once you know roughly what subject you’re looking at, you can drill from the Title down to the Section that applies to your situation.

How To Read an MCA Citation

Every statute has a hyphenated numeric address. Take 1-2-305 as an example. The first number is the Title, the middle number is the Chapter, and the final number encodes both the Part and the Section. In this case: Title 1, Chapter 2, Part 3, Section 5.3Montana State Legislature. Help – Montana Code Annotated

The third segment trips people up because it isn’t just a section number. The leading digit or digits represent the Part, and the remaining digits represent the specific Section within that Part. A citation to 45-5-207 therefore means Title 45, Chapter 5, Part 2, Section 7.

Section numbers inside a chapter are not always consecutive. The legislature leaves gaps on purpose so new statutes can be inserted later without renumbering everything around them.3Montana State Legislature. Help – Montana Code Annotated

What “Annotated” Means

The word “Annotated” is what separates the MCA from a bare statutory compilation. After the text of each law you’ll find editorial material: summaries of relevant court decisions, notes on how the legislature has amended the statute over time, and cross-references. These annotations help you see how courts have interpreted a provision and how it has evolved.

One point matters more than any other here: the annotations are not law. Montana statute explicitly provides that annotations, code commissioner notes, catchlines, and similar editorial material are included only for convenience and information, and they are not part of the legislative text unless the legislature specifically adopted them as such.4Montana State Legislature. Where the Montana Constitution Fits

The Montana Constitution is published within the MCA but sits above the numbered titles rather than being assigned one. It appears at the front of the code, organized by articles and sections. Article II, for example, contains the Declaration of Rights, with provisions on privacy, due process, and the right to know.

Because the Constitution is the state’s supreme law, any statute that conflicts with it is invalid. When you’re reading an MCA provision, remember that the Constitution sets the outer limit on what the legislature can do, and courts have struck down statutes that go past that limit.

How To Access the MCA

The most direct way to read the MCA is through the Montana Legislature’s official website, which hosts a searchable digital version. You can browse by title and chapter or search by keyword. The State Law Library of Montana, run by the Montana Judicial Branch, also provides access and research help for more complex questions.5Montana Judicial Branch. State Law Library of Montana

Printed copies are available at county law libraries and many public libraries. The physical volumes can be useful if you want to see a statute in full context next to its annotations. A complete printed set runs several hundred dollars, so most people use the free online version for day-to-day work.

When a New Law Takes Effect

The Montana Legislature meets in regular session during odd-numbered years. After a session ends, newly passed legislation is incorporated into the MCA during a biennial publication cycle. Between updates, the session laws document what the legislature changed before those changes are formally folded into the code.

Not every new law takes effect on the same date. Montana has a tiered system of default effective dates:

  • Most statutes take effect on October 1 following passage and approval.
  • Statutes that appropriate money for a public purpose take effect on July 1 following passage.
  • Motor vehicle taxes and fees take effect on January 1 following passage.
  • Legislation passed in a special session takes effect immediately upon passage and approval.

Any of these defaults can be overridden by language in the bill itself.6Montana State Legislature. Montana Code 1-2-201 – Statutes – Effective Date Always check the bill text if you’re relying on a recently passed provision, because its effective date may not match the default.

MCA vs. the Enrolled Bill

The MCA is the official version of Montana’s statutes and the only publication that may be used in public documents. It is, however, considered “prima facie” the official law, meaning it is presumed accurate but can be rebutted. If there is any inconsistency between the MCA and the enrolled bill filed with the Secretary of State, the enrolled bill controls.4Montana State Legislature. Inconsistencies are rare and usually come from codification errors rather than substantive disagreements. But on a high-stakes question where the statutory wording seems off, the enrolled bill is the ultimate backstop.

The Administrative Rules of Montana

Statutes are only part of the legal picture. State agencies fill in operational details under authority the legislature delegates to them, and those rules are compiled in the Administrative Rules of Montana (ARM). The ARM is available through the Secretary of State’s office at rules.mt.gov.7Montana Secretary of State. ARM and MAR Administrative Rules Services

Rulemaking is governed by the Montana Administrative Procedure Act. Agencies must give public notice before they adopt, amend, or repeal a rule, and those notices are published in the Montana Administrative Register (MAR). Once adopted, the rule is added to the ARM. A key distinction: legislative rules adopted under express statutory authority carry the force of law, while interpretive rules that merely state an agency’s reading of a statute do not.8Montana State Legislature.
