M&P 2.0 California Legal: Roster, Off-Roster Paths, Microstamping

The Smith & Wesson M&P 2.0 is legal to buy new in California, but only the specific compact 9mm variants that Smith & Wesson has certified for the state’s handgun roster. As of mid-2025, three SKUs qualify: the M&P 9 M2.0 Compact (SKU 14032), the M&P 9 M2.0 Compact Optics Ready (SKU 14277), and the M&P 9 M2.0 Metal Compact (SKU 14279).1Smith & Wesson. Why the Roster Decides What You Can Buy

California’s Roster of Certified Handguns lists every handgun that has passed the state’s safety testing. Under Penal Code Section 32000, selling, importing for sale, or keeping for sale a handgun that isn’t on the roster is a misdemeanor punishable by up to a year in county jail.2California Legislative Information. California Code PEN – 32000 A dealer cannot legally hand you a new M&P 2.0 unless the exact SKU appears on that list. Finish, barrel length, and internal components all matter; a tiny spec change can leave an otherwise identical pistol ineligible.

The M&P 2.0 was off the roster for years because California required microstamping, which no manufacturer had implemented. A 2020 change relaxed the dual-location microstamping rule for new additions, and Senate Bill 452 later moved the broader microstamping requirement to January 1, 2028, contingent on a Department of Justice finding that the technology is commercially available.3State of California – Department of Justice – Office of the Attorney General. Before you walk into a store, confirm the SKU against the DOJ’s online roster search tool. The roster is updated periodically, and models can be removed.4State of California – Department of Justice – Office of the Attorney General. Handguns Certified for Sale

What’s Different About the California-Compliant M&P 2.0

Penal Code Section 31910 defines an “unsafe handgun” that cannot be sold new. To clear that definition, Smith & Wesson’s California SKUs include features you won’t find on the standard version:

  • A loaded chamber indicator you can confirm by sight or touch. Required for all new centerfire semiautomatic pistols added to the roster since July 2022.5California Legislative Information. California Penal Code 31910
  • A magazine disconnect that prevents firing when the magazine is removed, even with a round still in the chamber.5California Legislative Information. California Penal Code 31910
  • A manual thumb safety, which Smith & Wesson uses to satisfy the statute’s “positive manually operated safety device” requirement.6Smith & Wesson. M&P 9 M2.0 Optics Ready CA Compliant
  • Two 10-round magazines to meet the state’s capacity limit.

These features are factory-installed and tied to the gun’s roster eligibility. Swapping parts to mirror the standard model has consequences covered further down.

What You’ll Actually Pay and Wait

The sticker price is the start, not the end. California adds several mandatory fees and a state excise tax to every retail firearm sale.

  • Firearm Safety Certificate. You need a valid FSC before you can buy any firearm, which requires passing a written test at a licensed dealer. The fee is $25 and the certificate lasts five years.7State of California – Department of Justice – Office of the Attorney General. Firearms Safety Certificate Study Guide
  • DROS fee. The Dealer Record of Sale fee covers the background check and registration. The current base DROS fee is $31.19.8New York Codes, Rules and Regulations. 4001 DROS Fees
  • State excise tax. Since July 1, 2024, California has imposed an 11% excise tax on retail sales of firearms, ammunition, and firearm precursor parts. On a $550 handgun, that’s roughly $60 more. Active and retired peace officers and their employing agencies are exempt.9California Department of Tax and Fee Administration. For a first-time handgun buyer, plan on roughly $120 to $150 above the retail price depending on county sales tax, before any accessories.

Then there’s the wait. Every firearm purchase or transfer in California requires a mandatory 10-day waiting period before the dealer can release the gun to you.11State of California – Department of Justice – Office of the Attorney General. If You Want an Off-Roster M&P 2.0

The roster only limits what dealers can sell as new inventory. Several legal paths exist to acquire a non-roster M&P 2.0, such as a full-size model or a standard version without the California safety features. Whatever you bring in still has to comply with the 10-round magazine cap and cannot be configured as an assault weapon.

Private Party Transfers

Two California residents can transfer any handgun, rostered or not, through a licensed dealer. The seller brings the gun to the dealer, the buyer fills out the paperwork, the background check runs, and the 10-day wait applies as it would for a retail purchase. Fees are capped at $47.19, which breaks down as $37.19 in DROS and processing fees plus a $10 dealer transfer fee.11State of California – Department of Justice – Office of the Attorney General. Frequently Asked Questions An off-roster handgun acquired this way is legal to own, but you cannot later resell it through a dealer to a buyer who isn’t exempt from the roster.

Intrafamilial Transfers

An immediate family member living outside California can gift you an off-roster handgun. Eligible relationships are parent, grandparent, child, grandchild, spouse, and registered domestic partner, and the recipient must be 18 or older. The transfer doesn’t go through a dealer. Instead, you submit a report to the Department of Justice within 30 days of taking possession, along with a $19 processing fee and a copy of your California ID.13Department of Justice Bureau of Firearms. Report of Operation of Law or Intra-Familial Firearm Transaction You still need a valid FSC before the transfer. The DOJ runs an eligibility check and confirms once approved.

Peace Officer Purchases

Sworn peace officers in California can buy off-roster handguns for duty and personal use, with requirements that vary by agency category.12State of California – Department of Justice – Office of the Attorney General. State Exemptions for Authorized Peace Officers An officer who later sells an off-roster handgun obtained through this exemption to a non-exempt civilian faces restrictions, and an unlawful sale can trigger a civil penalty of up to $10,000 on top of criminal charges.

Magazines: 10 Rounds, No Exceptions

Penal Code Section 32310 bans the manufacture, import, sale, and possession of magazines holding more than 10 rounds, with no grandfather clause for magazines acquired before the ban.14California Legislative Information. California Penal Code 32310 Simple possession is a wobblette: the district attorney can charge it as an infraction with a fine of up to $100 per magazine or as a misdemeanor with up to a year in jail and the same per-magazine fine. The standard M&P 2.0 ships with 15- or 17-round magazines in other states. If you’re moving to California or ordering accessories online, those magazines become a crime to possess the moment they cross the state line.

Modifications That Can Turn Your Legal Gun Illegal

Once you own a California-compliant M&P 2.0, resist swapping parts to match the standard version sold elsewhere. Removing the loaded chamber indicator, magazine disconnect, or manual safety can convert a legal handgun into one that meets the statutory definition of “unsafe,” and manufacturing an unsafe handgun is a misdemeanor under Penal Code Section 32000.4State of California – Department of Justice – Office of the Attorney General. Handguns Certified for Sale The DOJ has warned that aftermarket alterations to certain pistols may be treated as manufacturing an unsafe handgun or even an assault weapon, depending on the resulting configuration.

Threaded barrels invite similar risk. A threaded barrel alone doesn’t automatically trigger California’s assault weapon definition for handguns, but combining features can cross legal lines depending on the overall configuration. Grips, sights, and trigger upgrades that leave the required safety mechanisms intact are the safe lane for customization.

The 2028 Microstamping Deadline

In July 2025, the Attorney General released a report concluding that microstamping technology is viable.3State of California – Department of Justice – Office of the Attorney General. Attorney General Bonta Releases Report, Finds Firearm Microstamping Technology Viable Starting January 1, 2028, semiautomatic handguns sold by licensed dealers must be verified as microstamping-enabled, provided the DOJ also finds that the components are available at commercially reasonable prices. If both conditions are met, pistols that lack microstamping could be removed from the roster even if they satisfy every other safety requirement. Whether the M&P 2.0 will carry microstamping by then is Smith & Wesson’s call. If buying one matters to you, the current roster window is the relevant one.
