Nassau County Semi-Auto Rifle Permit Requirements

To buy or take possession of a semi-automatic rifle in Nassau County, you need a license issued through the Nassau County Police Department’s Pistol License Section. The Nassau County semi-automatic rifle permit requirements took effect September 4, 2022 under New York’s Concealed Carry Improvement Act, and they fold the new authorization into the existing pistol licensing system. You must be at least 21, pass a background investigation that includes fingerprinting and four character references, and clear both state and federal eligibility rules. Expect the process to take several months.

Which Rifles Actually Require the License

New York defines a semiautomatic firearm as one that uses the energy of a fired cartridge to eject the spent casing and load the next round, with a separate trigger pull for each shot.1New York State Senate. New York Penal Code 265.00 – Definitions If your rifle fits that description, the license applies. Bolt-action, lever-action, pump-action, and slide-action rifles do not, because they are manually operated.

One boundary matters before you apply. A semi-automatic rifle that also meets New York’s “assault weapon” definition is banned outright, not available through this license. That definition catches a semi-automatic rifle that accepts a detachable magazine and has at least one additional feature such as a folding or telescoping stock, a pistol grip, a thumbhole stock, or a flash suppressor.1New York State Senate. New York Penal Code 265.00 – Definitions The permit only covers rifles that are legal to own in New York.

How the Permit Fits the Pistol License System

The semi-automatic rifle authorization is an endorsement within New York’s pistol licensing framework. If you already hold a Nassau County pistol license, you file an amendment to add the endorsement to it. If you don’t, you apply for a pistol license with the semi-automatic rifle endorsement included. Either path runs through the Pistol License Section.2Nassau County Police, NY. Pistol Licenses

Who Qualifies

Eligibility runs on two tracks: New York Penal Law § 400.00 and federal law under 18 U.S.C. § 922(g). You have to clear both.

Age and Residency

You must be at least 21 years old. If you legally acquired a semi-automatic rifle before September 4, 2022 while under 21, you can keep that rifle, but you cannot buy a new one until you turn 21.3Gun Safety in New York State. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms You also need a permanent residence in Nassau County, since the county police department is the licensing authority.

Good Moral Character

The licensing officer must find that you are of “good moral character” before issuing the license.4New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms That is a judgment, not a checkbox, and the department reaches it through your references, your history, and the background investigation.

State Disqualifiers

You are ineligible under state law if you have been convicted of a felony or a “serious offense” as defined in the Penal Law, or if you are the subject of an outstanding warrant for one.4New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms The NY SAFE Act added mental health reporting: clinicians who believe a patient is likely to cause serious harm must report that patient, and those reports can lead to suspension or revocation.5New York State Office of Mental Health. Federal Disqualifiers

Federal law bars firearm possession by anyone who:

  • Has a felony conviction, meaning any crime punishable by more than one year in prison
  • Is a fugitive from justice
  • Uses or is addicted to controlled substances
  • Has been involuntarily committed to a mental institution or adjudicated as mentally defective
  • Is subject to a domestic restraining order involving an intimate partner or that partner’s child
  • Has a domestic violence misdemeanor conviction
  • Was dishonorably discharged from the military
  • Has renounced U.S. citizenship

If you are under indictment for a crime punishable by more than a year, you cannot receive a firearm while that charge is pending.6Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons

What to Bring When You File

Pull everything together before you go in. A missing document means another trip.

Personal History

The application requires at least ten years of personal history: every residential address and every employer during that period, with addresses for each. Investigators use it to trace you across jurisdictions.

Four Character References

You need four character references. Each must be a U.S. citizen, a Nassau County resident, and someone who has known you for at least a year. Relatives by blood or marriage don’t qualify, and neither do active law enforcement officers, husband-and-wife pairs, or two people from the same household.7New York State Court Clerks. Nassau County Pistol License Application Instructions Each must sign, and the investigator may contact them directly. Line these people up early. This is where applications stall most often.

Identification and Citizenship

Bring a valid New York State driver’s license or non-driver ID for identity and residency, plus proof of U.S. citizenship such as a birth certificate or unexpired passport. If you were born outside the United States, bring your original naturalization certificate or permanent resident card.

Social Media Accounts

The Concealed Carry Improvement Act required license applicants to disclose social media accounts used in the past three years so investigators could review public posts as part of the moral character review. A federal court has challenged aspects of the social media disclosure requirement for carry permits, so enforcement may have shifted. Confirm with the Pistol License Section whether this disclosure is currently required when you pick up your forms.

If You Already Hold a Pistol License

Existing Nassau County pistol licensees follow a shorter path: an amendment form adding the semi-automatic rifle endorsement to your current license. Have your permit number and expiration date on hand so the department can link the endorsement to your file.2Nassau County Police, NY. Pistol Licenses

Where to File, Fees, and Fingerprints

Filing happens in person at the Nassau County Police Department Pistol License Section at 1490 Franklin Avenue in Mineola. Staff review your packet at the window before accepting it, checking that everything is complete and properly signed.

You pay an application fee when you file. The department generally does not take cash, so bring a money order or credit card. A separate fingerprint processing fee runs about $89.25, covering a $75 DCJS fee and a $14.25 vendor fee. Call the Pistol License Section ahead of your appointment to confirm the current application fee.

Fingerprints are captured digitally during your visit and sent to DCJS, which runs them against state and federal criminal history databases. That biometric check is separate from the broader background investigation the department conducts on its own.

The Background Investigation

Once your packet is accepted and your prints are submitted, an investigator reviews everything, verifies your personal history, contacts each of your four references, and searches for anything you didn’t disclose. The investigation can take several months depending on caseload. You receive the outcome by mail after the Commanding Officer of the Pistol License Section reviews the findings.

Do not shade the truth on the application. A false written statement on the application is a Class A misdemeanor under New York Penal Law § 210.45.8New York State Senate. New York Penal Code 210.45 – Making a Punishable False Written Statement The investigator is comparing your answers against actual records.

After Approval

If you applied as an existing pistol licensee, you return to the Mineola office to swap your old card for a new one showing the endorsement. The department destroys the old card and issues the replacement on the spot.

With the license in hand you can buy a semi-automatic rifle from a licensed dealer. At the point of sale the dealer still runs a federal background check through the National Instant Criminal Background Check System using ATF Form 4473.9Federal Bureau of Investigation. Firearms Checks (NICS) The state license and the federal point-of-sale check are independent requirements, and you have to clear both.

The permit must be recertified every three years.10Gun Safety in New York State. Pistol Permit Recertification Missing the deadline does not automatically revoke your license, but it can create problems when you try to buy another firearm or if your status is checked during a law enforcement encounter. Mark the date and treat it like a renewal.

If Your Application Is Denied

A denial arrives in writing, explaining which criteria you failed. If you believe the decision rests on incorrect information, you can appeal through an administrative hearing or file a court proceeding challenging it. Deadlines are short, so read the denial letter carefully. An attorney experienced in New York firearms law is worth consulting at this stage, because the administrative process has procedural requirements that are easy to miss.
