A North Carolina separation agreement is a private written contract between spouses, not a state-issued form, so any “NC separation agreement PDF” you download is simply a template you adapt to your situation. To be legally enforceable, the document must be in writing and acknowledged by both spouses before a certifying officer who is not a party to the contract.1North Carolina General Assembly. North Carolina Code 52-10.1 – Separation Agreements What the template looks like matters far less than what you put in it and how you execute it.
North Carolina does not have a formal “legal separation” filing. Separation begins the day you move into separate residences intending to stay apart, and the written agreement governs your finances, parenting, and obligations through the one-year waiting period before either spouse can file for absolute divorce.2North Carolina General Assembly. North Carolina Code 50-6 – Divorce After Separation of One Year on Application of Either Party You can sign the agreement at any point during separation, but earlier is better: it locks down who pays what before disputes escalate.
What the Agreement Needs to Cover
Property and Debts
North Carolina follows equitable distribution, starting from a presumption of equal division of marital property.3North Carolina General Assembly. North Carolina Code 50-20 – Distribution by Court of Marital and Divisible Property Your agreement lets you skip court involvement by settling the split yourselves. List every marital asset: real estate, bank accounts, investments, vehicles, and household items of significant value. List every debt too, and assign responsibility for each one.
Here’s the catch most people miss: your agreement does not bind creditors. If your spouse agrees to pay a joint credit card and stops, the creditor can still come after you. The only ways to truly sever joint liability are to pay off and close the account or get the creditor to release one spouse. The agreement gives you a breach-of-contract claim against your spouse if they default, but it does not protect your credit report. Refinancing joint debts into individual accounts before signing is often worth the trouble.
Spousal Support
Spell out the dollar amount, payment frequency, and duration of any alimony or post-separation support. North Carolina courts evaluate factors including each spouse’s earnings, accustomed standard of living, and debts when awarding support.4North Carolina General Assembly. North Carolina Code 50-16.2A – Postseparation Support You are negotiating privately, but setting a figure a court would find reasonable protects the agreement against a later challenge.
Consider requiring the paying spouse to maintain a life insurance policy with a death benefit large enough to cover future support. Employer group coverage is a weak choice because it ends if the paying spouse changes jobs; an individually owned policy with the receiving spouse (or a trust for the children) as beneficiary is more reliable. A reduction schedule can lower the required death benefit as the remaining support obligation shrinks.
Custody and Child Support
If you have children, include a detailed parenting schedule for the regular weekly rotation, holidays, school breaks, and summer vacations. Vague language like “reasonable visitation” invites conflict later.
Child support is calculated using North Carolina’s official guidelines.5North Carolina Child Support Services. North Carolina Child Support Guidelines Worksheet A applies when one parent has the children most of the time and focuses on each parent’s gross monthly income. Worksheet B applies to shared custody and factors in the number of overnights with each child.6North Carolina Department of Health and Human Services. North Carolina Child Support Worksheet B – Joint or Shared Custody Attach the completed worksheet and supporting income documentation.
Address health insurance for the children and how you will split uncovered medical costs: copays, orthodontia, prescriptions. Vague percentages without a reimbursement mechanism tend to cause problems.
Taxes
Three tax issues belong in any current agreement.
First, for agreements executed after December 31, 2018, alimony is not deductible by the payer and is not income to the recipient.7Internal Revenue Service. Topic No. 452, Alimony and Separate Maintenance The after-tax cost of a $2,000 monthly payment is very different than it was under pre-2019 agreements. Factor that into the number you negotiate.
Second, property transfers between spouses incident to divorce are generally tax-free under federal law if they occur within one year after the marriage ends or are related to the divorce.8Office of the Law Revision Counsel. 26 USC 1041 – Transfers of Property Between Spouses or Incident to Divorce The receiving spouse inherits the transferor’s original tax basis. Stock your spouse bought for $20,000 that is now worth $80,000 comes with a $20,000 basis, and you owe capital gains on the full $60,000 when you sell. Current value and tax basis are different numbers; account for both.
Third, say which parent claims each child as a dependent. If the noncustodial parent will claim a child, the custodial parent signs IRS Form 8332 releasing the claim, and the noncustodial parent files it with their return.9Internal Revenue Service. About Form 8332, Release/Revocation of Release of Claim to Exemption for Child by Custodial Parent The release can cover one year or several. A revocation by the custodial parent does not take effect until the following tax year. With multiple children, alternating who claims which can balance the benefit. Write it into the agreement rather than renegotiating every spring.
Retirement Accounts
Retirement accounts are often the second-largest marital asset after the home, and dividing them wrong triggers unnecessary taxes and penalties. To split a 401(k), 403(b), or pension, you need a Qualified Domestic Relations Order, a separate legal document instructing the plan administrator to pay a share to the non-participant spouse.10Office of the Law Revision Counsel. 29 USC 1056 – Form of Distribution Each plan requires its own QDRO, so a spouse with both a pension and a 401(k) needs two.
Contact the plan administrator early for any model QDRO the plan uses, its QDRO procedures, and current benefit statements. Plans reject orders that do not match their requirements, and corrections can delay transfer by months. IRAs are simpler: a direct trustee-to-trustee transfer incident to divorce works without a QDRO, though the agreement should still document the split.
For active-duty military, the Uniformed Services Former Spouses’ Protection Act governs division of military retirement pay. The Defense Finance and Accounting Service will make direct payments to a former spouse only if the marriage lasted at least ten years and overlapped with at least ten years of creditable military service. The non-military spouse may still be entitled to a share without meeting that threshold; the ten-year rule affects only direct payment from DFAS.
Health Insurance
If one spouse is covered under the other’s employer plan, separation and divorce are COBRA qualifying events, and continuation coverage can last up to 36 months for the divorced or separated spouse.11U.S. Department of Labor. FAQs on COBRA Continuation Health Coverage for Workers Premiums are expensive because the covered spouse pays the full cost plus a 2% administrative fee. The agreement should say who pays for COBRA during separation and whether the supporting spouse contributes.
Making the Agreement Legally Valid
North Carolina imposes specific formalities. The agreement must be in writing and acknowledged by both spouses before a certifying officer who is not a party to it.1North Carolina General Assembly. North Carolina Code 52-10.1 – Separation Agreements A certifying officer can be a notary public, a judge, a magistrate, or a clerk of the General Court of Justice.12North Carolina General Assembly. North Carolina Code 52-10 – Contracts Between Husband and Wife Generally; Releases
The agreement must also be entered into voluntarily. A court can set aside an agreement it finds unconscionable, but that requires both procedural problems (fraud, coercion, hidden assets, misrepresentation) and substantive unfairness (terms no reasonable person would accept). One prong alone is not enough. Full financial transparency during negotiation is your best protection: a hidden account or an undervalued business, if proven later, puts the whole agreement at risk.
The statute does not explicitly require spouses to be living apart when they sign, but North Carolina practice treats physical separation as a practical prerequisite. Signing while still sharing a residence invites a court to question whether a true separation existed. Establish separate households first.
Signing and Storing the Document
Each spouse signs the printed PDF in front of the certifying officer. Notary fees in North Carolina are capped at $10 per signature for an in-person acknowledgment, $15 for an electronic acknowledgment, and $25 for a remote online notarization.13North Carolina General Assembly. North Carolina Code 10B-31 – Fees for Notarial Acts Sign and notarize multiple originals so each spouse keeps a copy with original signatures, and store yours in a safe deposit box or fireproof safe. You may need it years later.
You can record the agreement with your county’s Register of Deeds, which makes it a public record and puts third parties on notice about marital property status. Recording is not required for enforceability but can be useful when the agreement transfers real estate interests. Recording fees vary by county.
Enforcement: Incorporated vs. Unincorporated
How the agreement gets enforced depends on whether it has been incorporated into a court order, and this is where people get confused.
An unincorporated agreement is a private contract. If your spouse violates a term, your remedy is a breach-of-contract lawsuit. You can seek money damages, an injunction, or an order requiring performance. You cannot ask the court to hold your spouse in contempt, because no court order has been violated.
An incorporated agreement is different. With both parties’ consent, the court can fold the separation agreement into the final divorce decree, turning it into a court order.14North Carolina Judicial Branch. Separation and Divorce Violations then become enforceable through contempt, which can mean fines or jail. The trade-off is that incorporation also opens certain provisions to court modification.
One protection applies either way: domestic support obligations like alimony and child support are not dischargeable in bankruptcy.15Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge A spouse who files bankruptcy to escape support will find those debts survive.
What Can Be Changed Later
Modification rules depend on whether the agreement is incorporated and which provision you want to change.
- Unincorporated agreements cannot be modified by a court. Changes require both parties to agree and execute an amended written agreement with the same formalities as the original.
- Incorporated child support can be modified based on a substantial change in circumstances occurring after incorporation: a significant income change, a change in custody, or new medical needs.3North Carolina General Assembly. North Carolina Code 50-20 – Distribution by Court of Marital and Divisible Property
- Incorporated alimony can be modified or terminated on a showing of changed circumstances. But only payments that truly function as alimony qualify; periodic payments that are really a structured property settlement labeled as alimony will not be modified.16North Carolina General Assembly. North Carolina Code 50-16.9 – Modification of Order
- Property division cannot be modified by a court, even after incorporation. Once you agree on who gets the house or how to split the retirement accounts, that division is final.
Knowing this before signing lets you decide whether incorporation helps you. A favorable property split, locked in through contempt enforcement with no modification risk, argues for incorporation. Favorable alimony terms you want fixed argue against it, since keeping the agreement unincorporated prevents a court from changing them, at the cost of losing contempt as a remedy if your spouse stops paying.
