A Nebraska notary acknowledgment is a certificate a notary public attaches to your document confirming that you appeared in person, were identified, and declared the signature to be your own voluntary act. The fee is capped at $5, and the certificate is what allows the county register of deeds to accept a deed, mortgage, or similar instrument for recording.1Nebraska Legislature. Nebraska Code 33-133 – Notaries Public; Fees; Governmental Employee; Limitation If the acknowledgment is missing or defective, the filing is not considered lawfully recorded, and the protection recording provides can disappear with it.2Nebraska Legislature. Nebraska Code 76-241 – Deeds and Other Instruments; When Not Lawfully Recorded
When You Need an Acknowledgment
Nebraska requires acknowledgment on deeds transferring real estate or any interest in it. The one narrow exception is a lease of one year or less.3Nebraska Legislature. Nebraska Code 76-216 – Deeds; Acknowledgment Required Beyond deeds, acknowledgments are standard on mortgages, powers of attorney, living trusts, and other instruments meant to be recorded or relied on by third parties. The purpose is to verify who signed and to confirm the signature was voluntary.4Nebraska Legislature. Nebraska Code 64-201 – Notarial Acts, Defined; Performed; Effect
An acknowledgment is not a jurat. A jurat requires you to swear under oath that the document’s contents are true; an acknowledgment is about the signature itself. If the document tells you which certificate it needs, follow that instruction. If it doesn’t, ask the person or firm who drafted it. A notary who isn’t an attorney is not allowed to pick the certificate type for you.5Nebraska Legislature. Nebraska Code 64-105.03 – Notary Public; Unauthorized Practice of Law
What to Bring and How You’ll Be Identified
A notary cannot perform the act unless you appear in person and are either personally known to them or identified through satisfactory evidence.6Nebraska Legislature. Nebraska Code 64-105 – Notarial Acts Prohibited; When The usual proof is a current government-issued document bearing your photograph, signature, and physical description. A properly stamped passport works even without a physical description.
If you don’t have qualifying ID, two backup paths exist:
- One credible witness who is personally known to the notary and who personally knows you, with no stake in the document, can swear to your identity.
- Two credible witnesses who each know you personally and each present qualifying government photo ID to the notary. Neither can be affected by the transaction.
“Personal knowledge” means familiarity built up through enough interaction over time to remove reasonable doubt about who you are.6Nebraska Legislature. Nebraska Code 64-105 – Notarial Acts Prohibited; When Before the appointment, check that the name on your ID matches the name on the document exactly. A mismatch is one of the most common reasons appointments fall apart.
Bring the document fully completed except for the notarial certificate section. Leaving blanks in the body of the instrument invites later claims that something was changed after notarization, which is exactly what the acknowledgment is meant to prevent.
What Happens at the Appointment
You appear before the notary with your document and your ID. You tell the notary that the signature on the document is yours and that you signed it voluntarily. The notary verifies your identity, fills in the certificate wording, signs it, and applies the official seal. The seal may be an engraved embosser or an ink stamp, but an ink stamp must show the State of Nebraska, the words “General Notary,” the notary’s name, and the commission expiration date.7Nebraska Secretary of State. Notary Statutes – Section 64-210 A seal missing any of those elements can be challenged or rejected at recording.
What the Certificate Looks Like
Nebraska publishes short form acknowledgment certificates in Neb. Rev. Stat. § 64-206 that are legally sufficient for their stated purposes, though other compliant formats are also accepted.8Nebraska Legislature. Nebraska Code 64-206 – Statutory Short Forms of Acknowledgment; Use of Other Forms The individual version reads:
State of ___________
County of ___________
The foregoing instrument was acknowledged before me this (date) by (name of person acknowledged).
(Signature of Person Taking Acknowledgment)
(Title or Rank)
(Serial Number, if any)
Separate short forms exist for someone signing as a corporate officer, as a partner for a partnership, or as an attorney-in-fact under a power of attorney. The Secretary of State posts sample certificates online that follow the statutory forms and add templates for signature-by-mark situations.9Nebraska Secretary of State. Sample Notary Acknowledgements
What It Costs
Nebraska caps the fees a notary can charge. The ones that come up most often:
- Acknowledgment of a deed or other instrument: $5.00
- Certificate and seal: $5.00
- Administering an oath or affirmation: $2.00
- Affidavit and seal: $2.00
- Mileage for a mobile notary: reimbursement at the state rate per mile
The caps come from Neb. Rev. Stat. § 33-133.1Nebraska Legislature. Nebraska Code 33-133 – Notaries Public; Fees; Governmental Employee; Limitation The state mileage reimbursement rate for 2026 is $0.725 per mile.10Nebraska Department of Administrative Services. 2026 Mileage Reimbursement Rates Neither the notary nor a signing service can exceed these limits.11Nebraska Secretary of State. Mobile Notary Signing Agent Warning A significantly higher quote is a warning sign.
If You Cannot Sign Normally
Nebraska has procedures for signers who cannot write their names in the usual way. If you can make a mark but not sign, the mark must be made in front of the notary and two witnesses with no stake in the document. The witnesses sign beside the mark, and the notary adds a statement below identifying everyone by name and address.12Nebraska Legislature. Nebraska Code 64-105.02 – Notary Public; Signature by Mark; Physical Incapacity; Procedure
If you cannot sign or make a mark at all, the notary may sign your name for you at your direction, in the presence of two disinterested witnesses. The witnesses sign beside the signature, and the notary adds the same identifying statement. The Secretary of State’s sample page includes certificate templates for both situations.9Nebraska Secretary of State. Sample Notary Acknowledgements
Can It Be Done Online?
Yes. Nebraska’s Online Notary Public Act allows the acknowledgment to be done through audio-video technology instead of in the same room, and the usual in-person appearance rule does not apply to online acts.6Nebraska Legislature. Nebraska Code 64-105 – Notarial Acts Prohibited; When Not every Nebraska notary is set up for this. Online notaries have to complete a separate course, pass an exam, and register specifically for online notarization with the Secretary of State.13Nebraska Secretary of State. Online Notary Statutes They use an electronic seal and signature, verify your identity through approved technology, and the certificate itself must note that the act was performed remotely. If you need to go this route, look specifically for a Nebraska notary registered for online acts.
Notaries Who Cannot Act for You
Some notaries are disqualified from your particular transaction even if they’re commissioned and nearby.14Nebraska Secretary of State. Notary Frequently Asked Questions A notary cannot notarize a document signed by their parent, grandparent, child, grandchild, spouse, brother, or sister, and that extends to in-laws, step-relatives, and half-relatives. A notary who has a financial stake in the transaction beyond the standard fee, or who is a party to it, is also disqualified. And a notary can never notarize their own signature. If a notarization is later challenged and it comes out that the notary was disqualified, the validity of the whole document can be called into question. It’s worth asking before the appointment.
What a Non-Attorney Notary Cannot Help With
If the notary isn’t also a licensed attorney, Nebraska law limits what they can do beyond the notarial act. They cannot choose between an acknowledgment and a jurat for you. They cannot help you draft, complete, select, or understand the document being notarized. They cannot give legal advice, including on immigration. They cannot use the title “notario publico” or any equivalent in a non-English language on cards, ads, or signs. A non-attorney notary who advertises in another language has to include a prominent disclaimer in that language stating they are not an attorney and have no authority to give advice on immigration or legal matters.5Nebraska Legislature. Nebraska Code 64-105.03 – Notary Public; Unauthorized Practice of Law Crossing any of these lines is the unauthorized practice of law and is a Class III misdemeanor in Nebraska. There is one narrow exception: a notary with training or experience in a particular industry may assist with documents in that field even without a law license.
If you need legal guidance on what the document says or which certificate it should carry, that question belongs with the attorney or entity that prepared the document, not with the notary at the counter.
