Nebraska Rental Tax: Sales, Income, and Property Rules

Nebraska rental property taxes come in up to four flavors, and which ones you owe depends on how you rent and what’s inside the unit. Short stays under 30 days pull in 5.5% state sales tax plus a 1% state lodging tax and any county lodging tax. Net rental profit is taxed as income, with a top rate of 4.55% for 2026. The land and building carry annual real property tax set by local levies. And if you furnish the unit, the appliances and furniture inside owe their own personal property tax on a May 1 return.

Sales and Lodging Tax on Stays Under 30 Days

Rent a room, apartment, or house for fewer than 30 continuous days and Nebraska treats the transaction the way it treats a hotel stay. You collect 5.5% state sales tax on the total occupancy charge.1Nebraska Department of Revenue. Nebraska Sales and Use Tax Once the same tenant stays 30 continuous days or longer, the arrangement becomes a residential lease and sales tax drops off.2Nebraska Department of Revenue. Chapter 1 – Sales and Use Tax – Section: REG-1-046

Every short-term rental in the state also owes a separate 1% Nebraska lodging tax.3Nebraska Department of Revenue. Nebraska and County Lodging Tax Many counties layer their own lodging tax on top. In a county with a 2% local rate, your guest sees an 8.5% combined tax on the bill. Check the Department of Revenue’s current schedule before you set a nightly price, because county rates change.

The sales tax you collect isn’t your money. Nebraska treats it as a trust fund held on behalf of the state.4Nebraska Department of Revenue. Chapter 1 – Sales and Use Tax – Section: REG-1-001 Anyone who willfully fails to remit those funds can be held personally liable for the tax, penalties, and interest. “Willfully” doesn’t require fraud. Knowing the tax is owed and paying other bills first is enough.

Income Tax on Rental Earnings

Every dollar of net rental profit is subject to Nebraska income tax, whether it comes from a weekend vacation booking or a twelve-month lease. Nebraska uses your federal adjusted gross income as its starting point, so the rental income you report federally flows straight into your state calculation.5Nebraska Department of Revenue. Nebraska Individual Income Tax Return Form 1040N Federal deductions for depreciation, repairs, insurance, and other rental expenses carry over automatically.

The state uses a progressive rate structure that tops out at 4.55% for tax year 2026, well below the 6.84% top rate of a few years back.6Nebraska Legislature. Nebraska Code 77-2715.03 – Individual Income Tax Brackets and Rates Report your rental income and calculate your liability on Form 1040N.

Underreport rental income through negligence or intentional disregard of the rules and the Tax Commissioner can add 5% of the deficiency on top of the tax owed.7Nebraska Legislature. Nebraska Code 77-2790 – Deficiency; Negligence; Penalty Fraud draws steeper consequences. Clean records of every payment, expense, and deduction are the simplest defense.

Nonresident owners aren’t off the hook. If you live in another state and collect rent from a Nebraska property, you must file a Nebraska return covering income from Nebraska sources.8Nebraska Legislature. Nebraska Code 77-2734.01 – Nonresident Income There is no minimum threshold that lets you skip filing. Your home state will usually give you a credit for the taxes paid to Nebraska.

Real Property Tax on the Land and Building

Landlords owe annual property tax on the assessed value of the land and buildings, set by the county assessor. There is no statewide rate. Your bill is driven by the levies imposed by local school districts, cities, and other taxing authorities, which is why two identical buildings in different counties can produce very different bills.

Protesting an Assessment

If you think the assessor got the value wrong, file a protest with your county board of equalization. The board’s job is to correct undervaluations and overvaluations so taxes within the county are levied uniformly.9Nebraska Legislature. Nebraska Code 77-1504 – Equalization of Property; Board; Powers and Duties The filing window typically runs June 1 through June 30, though counties can extend hearings into August by resolution. Adverse decisions can be appealed to the Tax Equalization and Review Commission.10Justia. Nebraska Constitution Section IV-28 – Tax Equalization and Review Commission

Truth in Taxation Notices

Under the Property Tax Request Act, a local taxing authority that proposes to raise property tax revenue by 2% or more over the prior year must mail affected taxpayers a notice and hold a public hearing before finalizing the increase.11Nebraska Legislature. LB644 – Adopt the Property Tax Request Act The hearing is where you get to ask questions. Skip it and you’ll first notice the increase when the bill arrives.

What Happens if You Fall Behind

Real property with taxes still unpaid by the first Monday in March becomes subject to a public tax sale.12Nebraska Legislature. Nebraska Code 77-1801 – Delinquent Tax Sale Bidders pay the delinquent taxes, interest, and costs, and receive a tax certificate representing a lien against the property.13Nebraska Legislature. Nebraska Code 77-1807 – Delinquent Tax Sale; How Conducted If you don’t redeem within the statutory period, the certificate holder can pursue a tax deed. Losing a rental property this way starts with one missed payment.

Property Tax Credits Worth Claiming

Nebraska offers a property tax credit landlords can claim on the state income tax return by filing Form PTC. Starting with property taxes paid in 2024, that credit applies only to community college property taxes, not the full bill.14Nebraska Department of Revenue. Nebraska Property Tax Credit General Information Separately, the School District Property Tax Relief Act directs at least $808 million in statewide relief toward school district property taxes for tax year 2026, showing up as a credit on your property tax statement rather than a separate claim.15Nebraska Legislature. Nebraska Code 77-7305 – School District Property Tax Relief Act Neither is huge on an individual property, but not filing Form PTC leaves money on the table.

Personal Property Tax on Furnishings

This one catches landlords more than any other tax on the list. Furnish a rental with appliances, furniture, or other depreciable equipment and those items are taxable tangible personal property. You must file a Personal Property Return with the county assessor where the property sits, and the deadline is May 1 each year.16Nebraska Department of Revenue. Nebraska Personal Property Return Furniture and appliances in rental units use a seven-year recovery period for depreciation on the return.

Late filing penalties are steep. File after May 1 but before June 30 and you owe a 10% penalty on the tax due. File after July 1 and it jumps to 25%. Missing the deadline entirely doesn’t erase the obligation. The county can still assess the property and apply the highest penalty tier.

One related quirk: when you buy furniture or appliances to put in a rental, you owe sales tax on that purchase. You can’t use a resale certificate for items incidental to a real estate lease.17Nebraska Department of Revenue. REG-1-018 Lease and Rental of Tangible Personal Property Charging the tenant rent for a furnished unit doesn’t create a separate taxable lease of the furniture, as long as the furnishings are incidental to the real estate agreement.

Registering and Filing With the Department of Revenue

Before you collect any sales or lodging tax from a short-term rental guest, you need a Nebraska Tax ID Number. New businesses register online through the Department of Revenue’s portal, which covers sales and use tax, lodging tax, income tax withholding, and several other tax types in one application.18Nebraska Department of Revenue. Register Your New Business Online You’ll need your federal EIN (or Social Security Number if you’re a sole proprietor), the names and addresses of all owners, and the physical address of the rental. Select both Sales and Use Tax and Lodging Tax during registration. If you already have a Nebraska Tax ID from another business activity, submit a paper Form 20 by mail or fax to add tax types.

Sales and lodging tax returns are due on the 20th of the month following the reporting period.19Nebraska Legislature. Nebraska Code 77-2708 – Sales and Use Tax; Returns; Date Due; Failure to File; Penalty Most short-term rental operators file monthly, though the Tax Commissioner may assign quarterly filing at lower volumes. Returns and payments go through the Business Electronic Filing System.

Miss the deadline and the penalty is 10% of the unpaid tax or $25, whichever is greater. That $25 floor means even a return filed one day late with a small underpayment costs at least that much. Interest accrues on top at a rate the Tax Commissioner resets every two years based on the federal short-term borrowing rate plus three points.20Nebraska Legislature. Nebraska Code 45-104.02 – Interest; Delinquent Taxes Set a calendar reminder for the 15th of each month and file a few days early.
