Who Has to Register and File
Any business making retail sales of taxable goods or services in Nebraska needs a sales tax permit and must file returns. You don’t need a physical location in Nebraska to trigger the filing obligation. Under LB 284, effective April 1, 2019, a remote seller must register and collect Nebraska sales tax after exceeding either threshold in the current or prior calendar year: more than $100,000 in Nebraska retail sales, or 200 or more separate Nebraska sales transactions. Filing Frequency and Due Dates

- Monthly if your yearly tax liability is $3,000 or more
- Quarterly if it’s $900 or more but less than $3,000
- Annual if it’s under $900
Every return is due by the 20th of the month after the reporting period ends. A monthly filer covering January files by February 20. What Goes on Form 10

Exempt Sales
Subtract transactions that qualify for exemption. Common categories include sales to governmental units, purchases by organizations holding a Nebraska Exempt Organization Certificate, resale purchases documented with a Form 13, and sales of qualifying manufacturing machinery or agricultural equipment.7Nebraska Department of Revenue. Local Tax
Nebraska cities and counties add their own sales taxes on top of the state rate, from 0.5% to 2.0% depending on jurisdiction.9Nebraska Department of Revenue. Use Tax
Form 10 also covers use tax, owed when you buy taxable items or services for your business without paying Nebraska sales tax at purchase. It comes up with out-of-state purchases, items pulled from inventory for business use or donation, and taxable services like equipment repair or building cleaning. How to File and Pay
Most businesses file and pay through the Department’s online e-file system, which walks you through the state and local figures before submission.11Nebraska Department of Revenue. Payment usually runs through electronic funds transfer linked to your bank account. Credit card payments are accepted but generally carry third-party processing fees.
If you aren’t caught by the electronic mandate, you can mail Form 10 to PO Box 98903, Lincoln, NE 68509-8903. The Collection Allowance
Nebraska rewards retailers for collecting and remitting on time. You can deduct 2.5% of the first $3,000 remitted each month, up to $75 per month per licensed location, taken directly on Form 10. One exception: if a certified service provider handles your sales tax functions under the Streamlined Sales and Use Tax Agreement and receives compensation through that arrangement, you don’t also get the collection allowance.1Nebraska Legislature. Penalties, Interest, and Abatement
A late return costs you $25 or 10% of the unpaid tax, whichever is greater. That minimum applies even when the return is a zero return.2Nebraska Department of Revenue. Nebraska Sales and Use Tax FAQs
Interest accrues on any unpaid balance from the due date until you pay. Under Neb. Rev. Stat. § 45-104.02, the delinquent tax interest rate tracks the federal short-term rate plus three percentage points. The Tax Commissioner redetermines the rate every two years, and it changes only if the new calculation moves at least two percentage points from the current rate.14Nebraska Legislature. Consistent late filing can lead to revocation of your sales tax permit, which shuts down your ability to operate as a retailer in Nebraska.
If a late filing was caused by circumstances genuinely beyond your control, you can request a penalty waiver using Form 21, Request for Abatement of Penalty. Pay the underlying tax and interest first — the Department won’t consider the request otherwise — and file a separate Form 21 for each penalty. Your explanation must show the failure wasn’t due to negligence or intentional disregard of Nebraska tax law. Serious illness, natural disasters that destroyed records, and extended hospitalization typically qualify. Forgetting or being busy does not. Marketplace Sales
If you sell through platforms like Amazon, eBay, or Etsy, the marketplace facilitator collects and remits Nebraska sales tax on those transactions. Buying a Business
One boundary worth flagging for anyone taking over an existing Nebraska retailer: unpaid sales tax follows the business. Nebraska law requires the buyer to withhold enough of the purchase price to cover any outstanding sales tax until the seller produces either a receipt showing the tax has been paid or a certificate from the Tax Commissioner confirming nothing is owed.
