Nevada 7-Day Notice to Pay Rent or Quit: Form, Service, and Deadlines

The Nevada 7-day notice to pay rent or quit PDF is available on the Civil Law Self-Help Center website at civillawselfhelpcenter.org, and Clark County’s Las Vegas Justice Court requires landlords to use that court-approved form.1Clark County Justice Court, NV. Eviction Forms It is the mandatory first step before filing for summary eviction over unpaid rent, and the content, service method, and day count all have to be right or the notice fails and you start over.

Where to Download the Form

The court-approved fillable PDF lives on the Civil Law Self-Help Center site. Clark County’s Las Vegas Justice Court mandates that landlords and tenants use the forms approved by the court and posted there.1Clark County Justice Court, NV. Eviction Forms Other justice courts around the state follow similar requirements, so the Self-Help Center download is the safest source regardless of which county your property sits in.

Skip the generic templates on legal document sites. Nevada courts are particular about the statutory language the notice has to contain, and a non-approved version hands the tenant a ready-made defense.

Information the Notice Must Contain

Fill in the full legal names of every adult tenant listed on the lease and the complete property address. Give a clear breakdown of the total amount owed, separating base rent from any additional lawful charges, and identify which months or rental periods remain unpaid. Ambiguity about what is owed for which period is something a tenant can use to contest the notice later.

Two statutory requirements are easy to miss. The notice must identify the justice court that has jurisdiction over the property, and it must inform the tenant of the right to contest the eviction by filing an affidavit with that court within the same seven-judicial-day window.2Nevada Legislature. Nevada Code 40.253 – Unlawful Detainer: Supplemental Remedy of Summary Eviction and Exclusion of Tenant for Default in Payment of Rent A notice missing either element is defective. The court-approved PDF already contains this language, which is another reason to use it rather than draft your own.

The form needs the landlord’s or authorized agent’s signature, the date of signature, and contact information so the tenant has a way to communicate about payment.

Getting the Dollar Amount Right

Inflating the amount owed is one of the fastest ways to get an entire notice thrown out. Nevada caps late fees at 5 percent of the periodic rent, and for any tenancy longer than week-to-week, no late fee can be charged until at least three calendar days after rent is due.3Nevada Legislature. Nevada Code 118A.210 – Rental Agreements: Payment of Rent; Term of Tenancy; Late Fee The late fee also has to be spelled out in the rental agreement; you cannot impose one the lease does not authorize. A previously unpaid late fee does not raise the cap on the next one, which stays at 5 percent of the periodic rent.

Do not tack on attorney’s fees, collection fees, returned check fees, or unpaid security deposit amounts to the number you demand in the notice. List any lawful late fee as a separate line so the math is transparent. A judge reviewing the complaint will check it.

How to Count the Seven Days

The seven-day clock runs in judicial days. Weekends and legal holidays do not count toward the period.2Nevada Legislature. Nevada Code 40.253 – Unlawful Detainer: Supplemental Remedy of Summary Eviction and Exclusion of Tenant for Default in Payment of Rent A notice served on a Monday with no intervening holidays does not expire until the following Wednesday, which is seven business days later. Serve it on a Friday and the count does not begin ticking until Monday.

The statute defines “day of service” as the day the landlord or their agent personally delivers the notice to the tenant. When personal delivery does not happen and the notice is instead posted and mailed, the day of service is the day the notice is delivered to the sheriff or constable for service, but only if that delivery occurs before noon. A request made after noon pushes the day of service to the next day.2Nevada Legislature. Nevada Code 40.253 – Unlawful Detainer: Supplemental Remedy of Summary Eviction and Exclusion of Tenant for Default in Payment of Rent Landlords who serve late in the day and miscalculate the deadline file too early.

The tenant has until the close of business on the seventh judicial day to pay the full rent, vacate, or file a contesting affidavit with the court. Filing for eviction one day early gives the tenant grounds to have the case dismissed.

Who Can Serve the Notice

You cannot hand the notice to the tenant yourself. Under NRS 40.280, service must be performed by a sheriff, a constable, a licensed process server, or the agent of an attorney licensed to practice in Nevada.4Nevada Legislature. Nevada Code 40.280 – Service of Notices to Surrender; Proof Required Before Issuance of Order to Remove or Writ of Restitution An attorney’s agent qualifies only when the landlord has retained that attorney in the eviction and the agent acts under the attorney’s direct supervision. A notice handed over by a friend, family member, or the landlord personally is not valid service, however many witnesses were there.

The statute sets three service methods in a required order of preference:

Each fallback is only available after the one before it fails. You cannot skip to posting the notice on the door because it is faster. When leave-and-mail or post-and-mail is used, the server must sign an affidavit or declaration under penalty of perjury stating the date and manner of service, together with a confirmation of delivery or USPS certificate of mailing.4Nevada Legislature. Nevada Code 40.280 – Service of Notices to Surrender; Proof Required Before Issuance of Order to Remove or Writ of Restitution Keep that certificate. Without it, you may not be able to prove service in court.

What the Tenant Can Do During the Seven Days

Within the same seven judicial days, the tenant can file an affidavit with the justice court stating they have already tendered payment or are not actually in default.2Nevada Legislature. Nevada Code 40.253 – Unlawful Detainer: Supplemental Remedy of Summary Eviction and Exclusion of Tenant for Default in Payment of Rent Once you receive a file-stamped copy of that affidavit, locking the tenant out or blocking entry becomes illegal.

With both affidavits on file, the court schedules a hearing. If the judge finds unlawful detainer and no valid defense, a summary eviction order issues. If the judge finds the tenant does have a legal defense, neither side gets relief through the summary process, and the landlord has to pursue a formal eviction lawsuit under NRS 40.290 through 40.420.2Nevada Legislature. Nevada Code 40.253 – Unlawful Detainer: Supplemental Remedy of Summary Eviction and Exclusion of Tenant for Default in Payment of Rent The formal process takes significantly longer, so a tenant affidavit can add weeks or months.

Partial Payments and Conditional Refusals

Accepting partial rent after serving the notice is risky. Nevada courts have held that if a landlord accepts partial payment and leads the tenant to believe it will prevent eviction, the landlord may be estopped from going forward.5Civil Law Self-Help Center. Rent Notices Whether that argument wins depends on the facts and the judge, but it is a gamble most landlords should avoid.

The reverse rule matters just as much. After serving a 7-day notice, you cannot refuse the tenant’s full rent payment because you also want collection fees, attorney’s fees, late fees, returned check fees, or unpaid security deposit amounts.5Civil Law Self-Help Center. Rent Notices The notice demands rent. If the tenant pays the rent, the notice is satisfied. Attaching extra conditions violates NRS 40.253(9).

One Boundary to Note

If your tenant is an active-duty servicemember, federal law overrides the standard Nevada timeline. The Servicemembers Civil Relief Act requires a court order to evict a servicemember or their dependents from a primary residence when the monthly rent is below a federally set threshold (currently $10,239.63 after annual inflation adjustments), which covers essentially every residential rental in the state.6Office of the Law Revision Counsel. 50 USC 3951 – Evictions and Distress Verify active-duty status at scra.dmdc.osd.mil before proceeding, and consult an attorney if the tenant qualifies.

Mistakes That Invalidate the Notice

Most failed evictions in Nevada trace back to the notice, not the courtroom. The recurring defects:

  • Overstating the amount owed by including unauthorized charges or an inflated late fee.
  • Using a generic template instead of the court-approved PDF, which may omit required statutory language.
  • Leaving out the name of the justice court or the tenant’s right to contest.
  • Having the wrong person serve the notice.
  • Jumping to post-and-mail when leave-and-mail was still available.
  • Counting calendar days instead of judicial days and filing the complaint too early.
  • Serving after noon by sheriff or constable and missing the shifted day of service.

Each of these costs you the filing fee, additional service costs, and at minimum another full seven-judicial-day cycle. Getting the notice right the first time is almost always faster than fixing it afterward.
