Nevada Lodging Tax: Rates, Exemptions, and Filing

The Nevada lodging tax is a transient lodging tax charged on stays of 30 days or fewer, with a combined rate that runs from roughly 5% in some rural counties up to 13.38% inside the Primary Gaming Corridor in Las Vegas. There is no single statewide rate. What a guest pays is a stack of a state-mandated base, a county tax, and local surcharges for convention authorities, transportation, stadiums, and schools. The operator collects the tax from the guest and remits it to the local authority each month.

What the Tax Applies To

If a guest pays to sleep somewhere for 30 or fewer consecutive days, the lodging tax applies. That covers hotels, motels, apartment hotels, vacation rentals listed on Airbnb or VRBO, and short-term RV park spots.1City of North Las Vegas. Transient Lodging Tax The operator is responsible for collecting the tax regardless of whether it was actually charged to the guest; if you forget to add it to the bill, you still owe it.2Nevada Legislature. Nevada Revised Statutes 244.3352 – Mandatory Tax on Revenues From Rental of Transient Lodging

The taxable base is more than the room rate. Any mandatory fee a guest must pay in order to stay counts as part of gross receipts. In Las Vegas, that explicitly includes resort fees, service fees, booking fees, cleaning fees, and pet fees.3City of Las Vegas. The rule of thumb is simple: mandatory to stay means taxable.

How the Rate Is Built

State law sets a floor. Counties with populations of 700,000 or more (currently Clark County) must impose a 2% base; every other county must impose a 1% base.2Nevada Legislature. Nevada Revised Statutes 244.3352 – Mandatory Tax on Revenues From Rental of Transient Lodging From there, county commissions and city councils are authorized to add surcharges for convention and visitors authority funding, transportation districts, stadium financing, education capital projects, and general municipal operations.4Nevada Legislature. Rates by Region

Clark County and Las Vegas

Clark County carries the highest rates. Inside the City of Las Vegas, properties in the Primary Gaming Corridor pay 13.38%, and properties outside that corridor pay 13%.3City of Las Vegas. Rural Counties

Rural counties with lower visitor volumes charge much less. They start from the mandatory 1% state base and add their own local rate. Nye County, for example, sets a fixed rate on top of the state’s 1%.7Nye County. Who’s Exempt

Stays of 30 Days or More

Once a guest stays 30 or more consecutive days, they’re treated as a permanent resident and the lodging tax stops applying.1City of North Las Vegas. Transient Lodging Establishment Room Tax Instructions and Guidelines The days must be consecutive. A guest who checks out on day 29 and back in the next day may not qualify, because the clock resets. Rules on this vary by local ordinance, so confirm with the collecting authority if you handle extended stays.

Government Travelers

Federal and state government employees traveling on official business can qualify for exemption, but the payment method is as important as the traveler’s status. In Las Vegas, the room charges must be paid directly by the agency, not by the employee with cash, a personal check, or a personal credit card. Qualifying entities include the U.S. Government, the State of Nevada, the U.S. Military, and foreign diplomats.3City of Las Vegas. Transient Lodging Establishment Room Tax Instructions and Guidelines A standard sales tax exemption certificate does not apply to room tax. Keep proof of direct agency payment on file; if the documentation doesn’t hold up in an audit, the operator ends up owing the tax.

Registering and Filing

Before collecting any lodging tax, an operator needs a Nevada State Business License from the Secretary of State and, if there are employees, a Federal Employer Identification Number from the IRS. The property’s physical address has to be registered with the local county finance office or city clerk. Most jurisdictions require a business registration form covering ownership and anticipated rental activity.

Lodging tax is administered locally, not by the state. Returns and payments go to the county, city, or designated authority where the property is located, such as the RSCVA in Washoe County. Most jurisdictions require monthly filing, with the return and payment due by the 15th of the month following the month the taxes accrued.1City of North Las Vegas. Keep thorough records of every transaction: guest stays, room charges, mandatory fees, and taxes remitted. Under Nevada Administrative Code, governing bodies must retain lodging tax records for at least three years and make them available to the Department of Taxation for inspection.8Nevada Legislature. Tax on Rental of Transient Lodging Operators should plan on holding their own records for at least the same stretch, because a local audit can reach back that far.

Penalties for Late Payment

Under NRS 244.3352, a county must charge a penalty of up to 10% of the amount owed (not counting interest) or an administrative fee set by the county commissioners, whichever is greater. Interest then accrues at up to 1.5% per month from the date the tax was due until it’s paid.2Nevada Legislature. Nevada Revised Statutes 244.3352 – Mandatory Tax on Revenues From Rental of Transient Lodging Some jurisdictions apply the statutory ceiling. Elko charges a flat 10% late charge after the due date.9City of Elko. At 1.5% per month, a missed payment grows fast. If you’ve fallen behind, contact the local collecting authority before interest keeps compounding. Chronic noncompliance can also put your business license at risk, which would end your rental operation entirely.
