Nevada sales and use tax applies to retail sales of physical goods at a statewide minimum rate of 6.85%, which climbs to roughly 8.375% in Clark County once local add-ons are included.1Tax Foundation. Taxes In Nevada Groceries and prescription drugs are exempt. If you buy a taxable item from a seller who doesn’t collect Nevada tax, you owe the matching use tax yourself. Businesses selling in Nevada have to register, collect at the buyer’s location rate, and file returns on a schedule set by their sales volume.
What Nevada Taxes
The tax hits retail sales of tangible personal property — furniture, electronics, clothing, appliances, building materials, anything physical you can take with you. NRS 372.105 imposes the tax on every retailer’s gross receipts from those sales.2Nevada Legislature. Nevada Code 372.105 – Imposition and Rate Labor to fabricate or assemble the product gets folded into the taxable price.
Pure services generally do not get taxed. Hiring an accountant, an attorney, or a housekeeper triggers no sales tax. The line blurs when a service produces a physical item for the customer; then the whole charge becomes taxable.
Software and Digital Products
Software is taxable only when it arrives on a physical medium like a disc or USB drive. Downloads, cloud subscriptions, streaming services, e-books, and digital magazines are outside the tax. Shipping Charges
How the seller writes the invoice decides this one. Transportation, shipping, or postage listed as a separate line is not taxable. Bundle it into the product price, or combine it with handling, crating, or packaging on the same line, and the whole amount becomes taxable. Rates and How Location Sets Them
The 6.85% floor combines several statutory components under NRS Chapters 372, 374, and 377.5Nevada Department of Taxation. Components of Sales and Use Tax Counties layer voter-approved taxes on top for transit, public safety, and local needs. Combined rates run from 6.85% in rural counties to about 8.375% in Clark County (Las Vegas), with a statewide average near 8.24%.
The rate that applies is the rate where the buyer takes possession or where the goods are delivered. A seller in Washoe County shipping to a customer in Clark County collects at the Clark County rate.
Exemptions
Groceries
Food for home preparation is exempt under NRS 372.284 — bread, milk, produce, raw meat. Prepared food meant for immediate consumption, alcohol, pet food, and vitamin supplements stay taxable.6Nevada Legislature. Nevada Code 372 – Sales and Use Taxes A rotisserie chicken from the deli is taxable; a raw chicken from the meat case is not.
Medical Items
NRS 372.283 exempts prescription medicines dispensed by a pharmacist, prosthetic devices, ostomy supplies, hemodialysis products, insulin, feminine hygiene products, and diapers.7Nevada Legislature. Government and Nonprofits
Sales to the federal government, the State of Nevada, and any county, city, or political subdivision are exempt under NRS 372.325. Qualifying religious, charitable, and educational nonprofits are also exempt under NRS 372.326, but they have to apply to the Department of Taxation for that status first.
Use Tax on Out-of-State Purchases
The use tax closes the loophole where a Nevada buyer purchases from a seller who collects no Nevada tax. NRS 372.185 imposes tax on the storage, use, or consumption of tangible personal property in Nevada.8Nevada Legislature. Nevada Code 372.185 – Imposition and Rate The rate matches the combined sales tax rate where you use the item.
Buy furniture online from a seller who collects nothing, and if your county’s combined rate is 8.375%, you owe 8.375% to the Department. If another state’s tax was collected, Nevada credits that amount, so you only owe any remaining difference. Businesses report use tax on their regular sales tax returns; individuals can report it directly to the Department.
When Out-of-State Sellers Must Collect
A remote seller does not escape Nevada tax just because it has no warehouse or storefront here. Under NRS 372.751, remote sellers and marketplace facilitators must collect and remit Nevada sales tax once they exceed either threshold in the current or prior calendar year:
- $100,000 in gross receipts from retail sales to Nevada customers, or

Direct sales and marketplace-facilitated sales both count toward the thresholds. Once a seller crosses either line, registration is due by the first day of the calendar month that begins at least 30 days later.
Marketplace facilitators such as Amazon, eBay, and Etsy have their own parallel duty. When a facilitator meets the thresholds, it collects and remits tax for its third-party sellers on that platform. Individual sellers generally don’t need to collect Nevada tax themselves on marketplace-facilitated sales, though they still handle direct sales made outside the platform.
Buying for Resale
Goods bought specifically to resell are not taxed at that purchase; the tax gets collected later from the end customer. You give the seller a resale certificate. NRS 372.155 presumes all sales are taxable until the seller can prove otherwise, and a properly completed certificate shifts that burden off the seller.
A valid certificate must be signed by the purchaser and include their name, address, the permit number issued by the Department of Taxation, and a general description of what the purchaser sells in the regular course of business. Keep completed certificates on file. A seller who accepts one in good faith is relieved of liability for uncollected tax on that transaction.
Using a resale certificate to avoid tax on items you actually intend to keep for personal or business use is a misdemeanor under NRS 372.175. Auditors catch this more often than sellers expect, especially when a business claims resale on office furniture or equipment it clearly uses internally.
Registering as a Seller
Any business making retail sales in Nevada needs a sales tax permit before the first sale. Registration goes through the Nevada Business Registration form (TAX-F006), available on the SilverFlume portal at nvsilverflume.gov.9Nevada Department of Taxation. Nevada Business Registration
The form asks for your Federal Employer Identification Number (or Social Security Number if you’re a sole proprietor), the physical address of every business location, your NAICS industry code, and an estimated monthly sales figure. That estimate drives the filing frequency the Department assigns you. On the form you indicate whether you need a sales tax permit, a use tax account, or both.
Filing Returns
NRS 372.360 requires every registered business to file a return for each reporting period, due on or before the last day of the following month.10Nevada Legislature. Nevada Code 372.360 – Return: Filing Requirements A monthly filer whose period ends March 31 owes the return by April 30.
The Department assigns one of three filing frequencies based on sales volume:
- Monthly, if taxable sales exceed $10,000 per month.
- Quarterly, if taxable sales fall below $10,000 per month.
- Annual, if prior-year sales were under $1,500.
File through My Nevada Tax at nevadatax.nv.gov, where you enter sales, calculate tax, and pay electronically. Mailing a check with the printed voucher is also allowed. Zero-sales periods still require a return showing no tax due.
Late Filings and Fraud
Late returns carry a graduated penalty based on days past the deadline:
- 1 to 10 days late: 2% of the tax owed
- 11 to 15 days late: 4%
- 16 to 20 days late: 6%
- 21 to 30 days late: 8%

Interest runs 0.75% per month, or any fraction of a month, on unpaid tax. Penalty and interest stack, so an ignored balance grows on both tracks.
The Department may waive penalties for reasonable cause, such as an unforeseen emergency or a genuine misunderstanding of the filing obligation. You submit documentation and hope for approval; it isn’t guaranteed.
Filing a fraudulent return is a gross misdemeanor under NRS 372.760, carrying a fine between $300 and $5,000, up to 364 days in jail, or both. The Department does not need to show a massive tax loss; any intentionally false return can lead to criminal prosecution. The risk sits most heavily on anyone collecting sales tax from customers and keeping it instead of remitting it.
