Nevada Sales Tax Exemption Form: Resale, Nonprofit, and Streamlined

The Nevada sales tax exemption form you need depends on why the purchase qualifies. Businesses buying goods to resell use the Nevada Resale Certificate (TAX-F005). Religious, charitable, and educational nonprofits use Form REV-F005 to apply once for a letter of exemption that lasts five years.1Nevada Department of Taxation. Application for Sales/Use Tax Exemption for Religious/Charitable/Educational Organizations Companies that buy inventory across state lines can use the Streamlined Sales Tax Exemption Certificate instead of the Nevada-specific form. Government buyers don’t need a form at all.

Which Form Fits Your Situation

Nevada recognizes three broad categories of exempt buyers, and each uses a different document.

Sales to the United States government, the State of Nevada, and any Nevada county, city, or political subdivision are automatically exempt.2Nevada Legislature. Nevada Code 372.325 – Sale to United States, State or Political Subdivision The buyer identifies itself as a government purchaser and the seller excludes the sale from taxable receipts. No certificate changes hands.

Religious, charitable, and educational nonprofits qualify under a separate statute, NRS 372.326.3Nevada Legislature. Nevada Code 372.326 – Personal Property Sold by or to Nonprofit Organization Created for Religious, Charitable or Educational Purposes A federal 501(c)(3) determination letter is not enough on its own; the organization has to apply to the Nevada Department of Taxation and receive a Nevada letter of exemption before it can buy tax-free.

Retailers and wholesalers buying inventory they intend to sell to customers use a resale certificate.4Nevada Legislature. Nevada Code 372 – Sales and Use Taxes – Section 372.155 To use the certificate, you must hold an active Nevada seller’s permit.

Filling Out the Nevada Resale Certificate (TAX-F005)

The resale certificate is the form most businesses reach for. The current version, TAX-F005, is available from the Nevada Department of Taxation.5Nevada Department of Taxation. Nevada Resale Certificate It has no fixed expiration date and stays valid as long as your Nevada seller’s permit is active and in good standing.

The form asks for:

  • Your seller’s permit number, issued when you registered with the Department of Taxation.
  • A brief description of your business, such as “restaurant supplies” or “auto parts retail,” so the seller can confirm the purchase fits your normal operations.
  • A description of the property being purchased. Generic entries like “miscellaneous supplies” invite scrutiny. A plumbing supplier should list copper fittings and PVC pipe rather than “inventory.”
  • The name of the seller.
  • Your signature certifying that the goods are genuinely being bought for resale in the regular course of business.

If the seller doesn’t need a Nevada permit because they sell only exempt property or make no Nevada sales, they note that on the form in place of a permit number.6Legal Information Institute. Nevada Administrative Code 372.730 – Resale Certificates

How Nonprofits Get and Use Their Letter of Exemption

Nonprofits don’t complete a certificate at each transaction. They apply once, using Form REV-F005, and if approved receive a letter of exemption good for five years.1Nevada Department of Taxation. Application for Sales/Use Tax Exemption for Religious/Charitable/Educational Organizations

The application must include the organization’s bylaws, articles of incorporation, financial statements showing income and expenditures, and copies of any exemption letters from other government agencies. Charitable organizations also submit an outline of their charitable activities, fundraisers, goals, and a business or strategic plan. The Department reviews whether the organization actually meets the statutory definition of a religious, charitable, or educational entity before it issues the letter.

Once the letter is issued, the organization gives a copy to each retailer it buys from, and the retailer keeps that copy on file. The Department mails a renewal notice at least 90 days before the five-year mark, but not receiving that notice does not extend the exemption. Track the expiration date yourself and file for renewal at least 90 days before it lapses.

When the Streamlined Sales Tax Certificate Is an Option

Nevada is one of 24 member states in the Streamlined Sales and Use Tax Agreement, so buyers can use the Streamlined Sales Tax Exemption Certificate in place of the Nevada-specific resale form.7Streamlined Sales Tax. Exemptions This helps companies that buy from vendors in several states, because one certificate works across all 24 members. You don’t have to be registered through the Streamlined system to use it. Not every exemption category listed on the form is honored in every member state, though, so if you’re claiming something other than a standard resale exemption, confirm with the vendor or the Department of Taxation first.

Giving the Certificate to the Seller

You hand the completed certificate to the vendor, not to the Department of Taxation. Sellers can accept it as a paper original, an email attachment, or a digital upload. The timing rule matters: the seller must receive either a fully completed certificate or all the information needed to complete one within 90 days of the sale. If the Department later requests proof, the seller has an additional 120 days to obtain a completed certificate from the buyer.6Legal Information Institute. Nevada Administrative Code 372.730 – Resale Certificates

Once the seller accepts a properly completed certificate, liability for the tax shifts to the buyer. The seller is generally not on the hook unless the seller fraudulently failed to collect the tax or encouraged the buyer to submit a false certificate.8Nevada Legislature. Nevada Code 372.170 – Liability of Purchaser That protection disappears if the certificate the seller accepted was obviously incomplete or facially invalid.

Records You Have to Keep

Sellers must keep every exemption certificate and letter of exemption they receive. Businesses that file sales tax returns are required to retain all records, invoices, and related documents for at least four years.9Nevada Department of Taxation. Nevada Tax Notes For businesses that fail to file, the retention period is eight years.10Nevada Legislature. Nevada Code 372 – Sales and Use Taxes – Section 372.735 Those clocks run from the date the records were created, not the date of the last related transaction.

During an audit, the Department asks the seller to produce the certificates that justify why tax wasn’t collected on specific sales. If you can’t produce a valid one, the Department can assess the full tax against you as the seller, plus interest and penalties. Organize certificates by customer name or date, and consider digitizing them so they’re searchable.

Penalties for Misusing a Resale Certificate

Using a resale certificate to buy something you know you won’t resell has two consequences. The Department can impose a civil penalty of 10% of the tax that should have been paid.4Nevada Legislature. Nevada Code 372 – Sales and Use Taxes – Section 372.155 The buyer is also guilty of a misdemeanor, which can mean criminal prosecution and a criminal record.11Nevada Legislature. Nevada Code NRS 372.175 – Improper Use of Resale Certificate, Penalty

Even a legitimate resale purchase can turn taxable after the fact. If you originally bought an item for resale but later use it in your own business or for personal purposes, you owe use tax on the item measured by the price you paid.8Nevada Legislature. Nevada Code 372.170 – Liability of Purchaser A restaurant that buys kitchen equipment on a resale certificate and then installs it permanently in its own kitchen has done exactly that. Tax is owed as of the date you first used the item for a non-resale purpose.

Purchases That Are Exempt Without Any Form

Some purchases are exempt by their nature, no matter who’s buying. No certificate is needed because the exemption is written directly into the statute for the product. The main categories are:

Sellers should recognize these categories so they don’t collect tax on qualifying items in the first place. The exemption applies automatically at the register.
