Nevada Sales Tax Filing: Deadlines, County Rates, and Late Penalties

Nevada sales tax filing runs on a schedule the Department of Taxation assigns you based on your taxable sales volume, and every seller’s permit holder owes a return each period even when there were no sales. You report on the Combined Sales/Use Tax Return (Form REV-F013), break your sales down by county at the correct combined rate, and submit by the last day of the month following the reporting period. Miss that date and a graduated penalty starts at 2% and climbs to 10%, with interest of 0.75% per month running from the original due date.

How Often You File and When It’s Due

Nevada assigns your filing frequency based on taxable sales volume, not the amount of tax you collect.1Nevada Legislature. Nevada Code 372 – Sales and Use Taxes

  • Monthly filing if your taxable sales exceed $10,000 in any month.
  • Quarterly filing if your taxable sales stay at or below $10,000 per month.
  • Annual filing if you already file quarterly and either owed no tax for the preceding three quarters or had total taxable sales of $1,500 or less over the preceding four quarters. You lose annual status if taxable sales exceed $1,500 during the 12-month period or $10,000 in any single month.

Returns are due on the last day of the month following the close of the reporting period.1Nevada Legislature. Annual filers submit by January 31 for the prior calendar year. Rates Are Set by County

The statewide minimum sales tax rate is 6.85%, and each county adds its own local surcharges on top.4Nevada Department of Taxation. The return breaks down sales by county, so the rate you charged at the point of sale (or applied for delivery) has to match what you report. If you sell at more than one location or ship to buyers in different counties, tag each transaction with its county in your books. Reconstructing that split at filing time is where mistakes happen, and both underpayment and overpayment create work later.

What to Have Ready Before You File

Pull records for every transaction in the reporting period: total gross sales, exempt sales with the documentation supporting each exemption, and the county of each sale. Subtract exempt sales from gross to get taxable sales by county, then apply the combined rate for that county to arrive at the tax due.

Nevada law presumes gross receipts are taxable unless you can prove otherwise, so exemption documentation is the difference between a clean audit and a reclassification.1Nevada Legislature. Nevada Code 372 – Sales and Use Taxes The exemptions most sellers use:

  • Resale sales to a buyer who holds a valid resale certificate and intends to resell the goods in the ordinary course of business. Keep the certificate on file.
  • Sales to the United States government, the State of Nevada, and any Nevada county, city, or political subdivision.
  • Food for human consumption. Grocery items are exempt; prepared food intended for immediate consumption, alcoholic beverages, vitamins, and pet food are not.

You also owe use tax on items you bought without paying Nevada sales tax. The most common trigger is buying supplies or inventory from an out-of-state vendor that did not collect Nevada tax. Another is pulling inventory off the shelf for personal or business use. How to Submit the Return and Pay

Nevada’s filing portal is at mynvtax.nv.gov, using credentials tied to your seller’s permit. For paper, the current form is the Combined Sales/Use Tax Return (Form REV-F013).3Nevada Department of Taxation. Combined Sales/Use Tax Return Either way, you enter sales by county and the system (or the form) does the math.

The portal calculates tax from the county data you enter. Compare its summary to your own totals before hitting submit. Filing the return does not pay the tax; you still owe payment separately.

Electronic payments run through ACH debit (direct bank transfer using your routing and account number) or credit card. Credit card payments carry a third-party processing fee, so ACH is cheaper. Paper filers get a printable payment voucher to mail with a check, and the check envelope needs a Postal Service postmark by the due date.2Nevada Department of Taxation. A successful electronic filing produces an on-screen confirmation number and an email receipt. Keep both. That confirmation is your proof if the Department later says a return came in late.

What It Costs to File Late

  • 1 to 10 days late: 2% of the tax due.
  • 11 to 15 days late: 4%.
  • 16 to 20 days late: 6%.
  • 21 to 30 days late: 8%.
  • More than 30 days late: 10%, the maximum.

Interest runs on top of the penalty at 0.75% per month or any fraction of a month, from the original due date until you pay.7Nevada Legislature. Nevada Code 360 – General Provisions That is 9% annualized. A single day late means at least the 2% penalty plus a full month of interest. The jump from day 10 to day 11 doubles the penalty rate, so once you are late, every day matters.

Asking for a Penalty Waiver

If the late payment came out of circumstances beyond your control, you can ask for the penalty and interest to be waived or reduced under NRS 360.419. You apply on Form TAX-F011 with documentation supporting your claim. Common qualifying situations include a serious medical emergency, a natural disaster, or inability to obtain the records you needed despite reasonable effort. The Department will not even review the request until the underlying tax is paid in full, so a waiver cannot buy time. Each case is decided on its own facts, with no guarantee of approval.

If You Sell Into Nevada From Out of State

Remote sellers owe Nevada sales tax once they cross either of two thresholds in the current or preceding calendar year:1Nevada Legislature. Nevada Code 372 – Sales and Use Taxes

  • More than $100,000 in cumulative gross receipts from retail sales to Nevada customers, or
  • 200 or more separate retail sales transactions to Nevada customers.

Either threshold triggers the obligation on its own. Once you cross it in a calendar year, you must collect for the rest of that year and the full following calendar year. Remote sellers work with the same county-level rate structure as in-state sellers, so you need to know where each buyer is located and apply the correct combined rate.

Marketplace Sales

Amazon, eBay, Etsy, and Walmart Marketplace are classified as marketplace facilitators under Nevada law. Once a platform exceeds the $100,000 gross receipts or 200-transaction threshold, it collects and remits Nevada sales tax on sales made through the platform, including sales by third-party sellers.1Nevada Legislature. There is a narrow exception. If a facilitator and a marketplace seller sign a written agreement shifting collection back to the seller, and the seller holds a valid Nevada permit or registration, the facilitator no longer collects for that seller. In practice, the major platforms rarely enter these agreements.

If you sell only through a facilitator that already collects for you, you still owe a Nevada return for any direct sales made outside the platform. Track marketplace-collected tax separately in your books from tax you owe directly, or you will end up double-remitting or overstating what you owe.

Fixing a Past Problem

If you should have been filing and were not, Nevada offers a voluntary disclosure process that can bring penalty relief. You have to apply before the Department contacts you: if an audit or investigation is already underway, you are not eligible.9Nevada Department of Taxation. Once approved, you file the missing returns and pay the back tax with interest for the applicable look-back period. The tax and interest remain, but avoiding penalties can be significant for a business that has been non-compliant for several years.

If you spot an error on a return you already filed, correct it with an amended return for each period affected. The amended return has to show what you originally reported, the correct amounts, and the difference.10Legal Information Institute. If it shows an underpayment, file and pay the difference right away. The penalty and interest clock runs from the original due date, so waiting only adds to what you owe.
