If your business has sales tax nexus in Nevada, the Nevada sales tax filing requirements are straightforward: register for a seller’s permit with the Department of Taxation, charge the correct rate based on where your buyer receives the goods, and file the Combined Sales/Use Tax Return by the 20th of the month following each reporting period. That 20th-of-the-month deadline is new as of 2025, replacing the old end-of-month due date, so even long-time filers need to adjust their calendars.1Nevada Department of Taxation. Who Has to File
Your filing obligation begins when your business establishes nexus in Nevada. Two paths get you there:
- Physical nexus: an office, warehouse, inventory, or employees in the state.
- Economic nexus: more than $100,000 in gross retail sales to Nevada customers, or 200 or more separate transactions, during a calendar year.
Once you cross either economic threshold, you must register and file for that year and the following calendar year.2Nevada Legislature. Nevada Code 372 – Sales and Use Taxes Filing is required for every assigned period, even if you collected no tax during the window.3Nevada Department of Taxation. One boundary worth knowing: if your only Nevada sales go through a marketplace like Amazon, eBay, or Etsy, Nevada’s marketplace facilitator law under NRS 372.751 generally puts the collection and remittance burden on the platform once it exceeds the $100,000 or 200-transaction threshold.2Nevada Legislature. Nevada Code 372 – Sales and Use Taxes Confirm with the Department before assuming you have no separate filing duty, especially if you also sell through your own channels.
Registering for a Seller’s Permit
Before any returns can be filed, you need a Nevada seller’s permit. Register through the Nevada Tax Center at tax.nv.gov or send a paper application to the Department of Taxation. During registration the state assigns your filing frequency based on anticipated sales volume. New businesses typically start monthly. If your liability stays consistently low, the Department may later move you to a quarterly or annual schedule.
What Rate to Charge
Nevada’s statewide minimum sales tax rate is 6.85%, but the rate you actually charge depends on where your buyer takes delivery. The state uses destination-based sourcing: tax follows the county where tangible personal property is delivered to the purchaser.2Nevada Legislature. Nevada Code 372 – Sales and Use Taxes County rates run from 6.85% in counties such as Humboldt and Eureka up to 8.375% in Clark County, which includes Las Vegas.4Nevada Department of Taxation. This matters for your return because taxable sales are reported by county. A business shipping to buyers in both Clark County and Elko County applies a different rate to each group. The Department publishes a county rate map covering all 17 counties, and checking it before each filing period helps prevent allocation errors.5Nevada Department of Taxation. What Goes on the Return
The Nevada sales tax return is form REV-F013, the Combined Sales/Use Tax Return. You can file electronically through the Nevada Tax Center or submit a paper copy.6Nevada Department of Taxation. Combined Sales and Use Tax Return Either way, pull together:
- Total gross sales from Nevada transactions before deductions.
- Exempt sales broken out from the gross total, including resale transactions, sales to government entities, and sales to qualifying nonprofits with a valid Nevada tax-exempt letter.
- Taxable sales allocated by delivery county, with the correct rate applied to each.
- Use tax on purchases your business made without paying Nevada sales tax, such as equipment bought from an out-of-state vendor that did not collect it. The rate mirrors your county’s sales tax rate.7Nevada Department of Taxation. Sales and Use Tax
Common exempt categories under Chapter 372 include livestock, seeds, and feed used for food production; qualifying farm machinery and equipment; prescription drugs and prescribed medical devices such as durable medical equipment, prosthetic devices, mobility equipment, and oxygen delivery equipment; motor vehicle fuel taxed under a separate chapter; and mine output already subject to the net proceeds of mines tax.2Nevada Legislature. Nevada Code 372 – Sales and Use Taxes
Resale transactions require a certificate from the buyer, who must be registered and hold a valid Nevada permit. Keep those certificates on file, because the law presumes gross receipts are taxable until you prove otherwise. Use tax trips up a lot of businesses because it is self-reported; skipping it does not save money, it just creates audit exposure.
When Returns Are Due
Returns and payments must be submitted by the 20th of the month following the reporting period. If the 20th falls on a weekend or recognized holiday, the deadline shifts to the next business day.1Nevada Department of Taxation. Department of Taxation New Sales Tax Filing Date Your assigned frequency sets the cadence:
- Monthly filers: a January return is due by February 20th.
- Quarterly filers: a January-through-March return is due by April 20th.
- Annual filers: a full-year return is due by January 20th of the following year.
You file for every assigned period, even one with no taxable sales.3Nevada Department of Taxation. Sales and Use Tax General Information
How to File and Pay
Most filers use the Nevada Tax Center at tax.nv.gov. After logging in, select the return period, enter sales figures by county, review the calculated totals, and submit. The portal generates a confirmation number and downloadable receipt right away. Keep it with your records.
The portal supports ACH debit, which pulls the exact amount from your bank account. Credit card payments go through a third-party processor that charges a fee. Paper filers can mail a check or money order payable to the Nevada Department of Taxation; write your permit number on the check so the payment posts to the right account.
The Collection Allowance for On-Time Filers
Nevada rewards timely filing with a small discount. If your return and payment arrive by the deadline, you can deduct 0.25% of the sales tax due as a collection allowance.2Nevada Legislature. Nevada Code 372 – Sales and Use Taxes It applies only to sales tax, not use tax.6Nevada Department of Taxation. Combined Sales and Use Tax Return On a $10,000 sales tax liability, that is $25 back. Small per filing, but it adds up across a year of monthly returns, and one late filing forfeits it entirely.
Penalties for Late or Incorrect Filing
Missing the deadline costs more than the lost allowance. Nevada’s late-filing penalty is tiered:3Nevada Department of Taxation. Sales and Use Tax General Information
- 1–10 days late: 2% of the tax due
- 11–15 days late: 4%
- 16–20 days late: 6%
- 21–30 days late: 8%
- 31+ days late: 10% (the cap)
Interest also accrues at 0.75% per month, or any fraction of a month, on the unpaid balance.
The stakes rise for non-filing or fraud. Refusing to submit a required return can bring a fine of up to $500 per offense. Filing a false return with intent to evade tax is a gross misdemeanor punishable by a fine between $300 and $5,000, up to 364 days in jail, or both.2Nevada Legislature. Nevada Code 372 – Sales and Use Taxes
Reporting sales to the wrong county has its own penalty track because local tax distributions depend on accurate county reporting. A first offense draws a warning letter. A second violation in the same calendar year brings a penalty equal to the misreported tax or $1,000, whichever is less. A third and each subsequent violation that year jumps to three times the misreported tax or $3,000, whichever is less.2Nevada Legislature. Nevada Code 372 – Sales and Use Taxes
If You Should Have Been Filing but Were Not
Businesses that discover a past filing obligation can apply to the Department’s voluntary disclosure program. You must apply before the Department opens an audit or investigation. If approved, the Department waives the penalties and interest that would otherwise apply under NRS 360.300.8Nevada Department of Taxation. Application for Voluntary Disclosure of Failure to File Return
Once approved, you have 90 days to file the delinquent returns and pay the tax owed. If the disclosure period runs longer than eight years, you only need to file returns for the most recent eight. Your estimated liability must be in good faith: if the estimate falls short of actual liability by 10% or more and you cannot show you tried to be accurate, the Department reinstates all penalties and interest on the full amount. The program is particularly useful for out-of-state sellers who realize after the fact that they crossed Nevada’s economic nexus threshold months or years ago.
