New Florida Driver’s License Laws: REAL ID, Digital ID, and Renewals

The new Florida driver’s license laws do four things most drivers need to know about: they invalidate certain out-of-state licenses tied to immigration status, tighten the 30-day deadline for new residents to switch to a Florida license, align the state with federal REAL ID enforcement that began May 7, 2025, and authorize a digital “Smart ID” you can show instead of your plastic card at a traffic stop. Miss the details and you can end up with a citation, a towed vehicle, or a wasted trip to the service center.

Out-of-State Licenses Florida Will Not Accept

Under Section 322.033, Florida refuses to recognize any out-of-state driver license that belongs to a class issued exclusively to people who could not prove lawful U.S. presence when the license was granted.1Florida Senate. Florida Code 322.033 – Unauthorized Aliens and Undocumented Immigrants; Invalid Out-of-State Driver Licenses Several states issue “drive-only” or “limited purpose” licenses to residents regardless of immigration status, and those specific classes are what the law targets. A standard REAL ID-compliant license from any state is not affected.

The Florida Department of Highway Safety and Motor Vehicles maintains a list of affected license classes covering roughly 18 jurisdictions, and each entry identifies the markings that flag the restricted class, such as “Federal Limits Apply,” “Drive Only,” or “Not Valid for Identification.”2Florida Department of Highway Safety and Motor Vehicles. The consequences are real. An officer who stops someone holding one of these invalidated licenses will issue a citation for driving without a valid license under Section 322.03.1Florida Senate. New Residents Have 30 Days

If you move to Florida and start working here, enroll your children in public school, or establish your home here, you have 30 days to get a Florida driver license before you are driving illegally.5Florida Senate. Florida Code 322.031 – Nonresidents; When License Required The clock starts on the date you begin employment or your children begin school, not the day you sign a lease. Your out-of-state license stays valid during those 30 days. After that, the penalties are the same as for any unlicensed driver.

A few exceptions apply. Active-duty military stationed in Florida do not need to swap their license just because their children attend Florida public schools. Cross-state commuters who live elsewhere are exempt, as are full-time college students enrolled at a Florida institution. If none of those fits, treat the 30-day window seriously.

REAL ID and the Gold Star

Federal REAL ID enforcement began on May 7, 2025. Since that date, you need a REAL ID-compliant driver license or another federally accepted ID such as a valid U.S. passport to board a domestic flight or enter certain federal facilities.6Transportation Security Administration. A Florida license without the star still works for driving and most everyday purposes, but TSA will not accept it at airport security. To upgrade, you have to visit a service center in person with the full set of identity documents described below. There is no online path if you have never submitted those documents before. If you already hold a REAL ID-compliant Florida license, the star carries over through normal renewals with no extra step.

Using the Digital Smart ID at a Traffic Stop

Section 322.032 authorizes the Florida Smart ID, a digital version of your driver license accessible through a smartphone app. The system queries FLHSMV records in real time, so what the app shows always reflects your current license status.7The Florida Legislature. People get one thing wrong here. Section 322.15 explicitly allows a driver to present or submit a digital proof of driver license in lieu of the printed license.8The Florida Legislature. Florida Code 322.15 – License to Be Carried and Exhibited on Demand The catch: if the officer cannot immediately verify the digital credential, they can demand your physical card on the spot. Carrying the plastic card as a backup remains a smart practical move, especially in places with unreliable cell service. Legally, though, the Smart ID can stand on its own when verification works.

You cannot get the digital credential until FLHSMV has issued you a physical license. The app is not a shortcut around the documentation requirements or the in-person application.7The Florida Legislature. Florida Code 322.032 – Digital Proof of Driver License or Identification Card

Documents You Have to Bring

Section 322.08 sorts the documentation into four categories: proof of identity, proof of Social Security number, proof of residential address, and, if it applies, name-change documentation.9Florida Senate.   • Identity: one primary document, such as a certified U.S. birth certificate, a valid U.S. passport or passport card, a naturalization certificate, or a valid permanent resident card.
  • Social Security number: the statute requires proof satisfactory to the department. FLHSMV accepts your Social Security card, a W-2, or a 1099 showing your full number. A military ID also works.
  • Residential address: two documents showing your current Florida address. Utility bills dated within the last 60 days, a lease, a Florida vehicle registration, a deed or mortgage statement, and a Florida voter registration card are all commonly accepted.
  • Name changes: if your legal name differs from the name on your identity document, bring the original linking documents, whether a marriage certificate, divorce decree, or court order.

A REAL ID application requires these documents in person. Photocopies are generally not accepted for the primary identity document, so gather everything before your appointment.

The Appointment, the Vision Test, and the Fees

Schedule an appointment through FLHSMV’s online system or your local Tax Collector’s office. Walk-ins work in some locations, but appointments cut wait times. At the counter, a service agent reviews your documents, administers a vision test, takes a digital photo, and captures your signature.10Florida Department of Highway Safety and Motor Vehicles. The vision test requires at least 20/70 acuity in each eye, or both eyes together, and a minimum field of vision of 130 degrees. If one eye is blind or 20/200 or worse, the other eye must test at 20/40 or better. Applicants who test worse than 20/40 in either eye get referred to a licensed eye specialist for possible correction.10Florida Department of Highway Safety and Motor Vehicles. The fee for an original or renewal Class E license, the standard non-commercial license, is $48.00. Tax collector offices may add a $6.25 service fee. Veterans who have previously provided proof of veteran status are exempt from the service fee.11Florida Department of Highway Safety and Motor Vehicles. After processing, you receive a temporary paper permit; the permanent card is produced centrally and mailed, typically within seven to ten business days.

Address Changes, Name Changes, and Renewals

When you move to a new address within Florida, you have 30 calendar days to update the address on your license.12The Florida Legislature. Florida Code 322.19 – Change of Address, Name, or Citizenship Status Missing that deadline is a nonmoving violation carrying a $30 fine.13Florida Senate. Florida Code 318.18 – Amount of Penalties Most people can update online or by mail. If your original license was issued using certain temporary immigration documents, you have to make the change in person with your current immigration paperwork. Name changes follow the same general timeline and require original documents linking your old and new names.

A standard Florida driver license is valid for eight years. Drivers 80 or older get a six-year license.14The Florida Legislature. Florida Code 322.18 – Original Applications, Renewals, and Duplicates You may renew online if you are a U.S. citizen or permanent resident and did not use an online or mail renewal last time. Online renewal is not available for commercial driver licenses.

The most important age-related rule: every driver 80 or older must pass a vision test at renewal, no exceptions. Renewing in person means the test happens at the counter. Renewing by mail or online means submitting a vision test from a licensed physician or optometrist on a department-approved form before the renewal can process. If you fail and the issue cannot be corrected, FLHSMV will deny the driving privilege but issue a free state identification card so you are not left without valid ID.14The Florida Legislature.
