New Hampshire does not charge sales tax on SaaS. The state has no general sales tax and no use tax, so a Software as a Service subscription sold to or from a New Hampshire customer carries no sales tax liability at the point of purchase. The catch is that SaaS companies earning revenue in the state still owe New Hampshire’s business taxes, and a narrow slice of SaaS products can fall under a separate 7% Communications Services Tax.
No Sales Tax, No Use Tax, No Local Add-Ons
New Hampshire is one of five states with no general sales tax, and it has no companion use tax either.1NH Department of Revenue Administration. Does New Hampshire Have a Sales Tax? There is no mechanism for taxing a SaaS transaction, whether the buyer is a consumer or a business. Municipalities cannot impose their own sales or use tax, so no local layer catches the sale either. The Department of Revenue Administration does not even issue resale or exemption certificates, because there is nothing to be exempt from.2New Hampshire Department of Revenue Administration. That answer holds across SaaS categories. Accounting platforms, project management tools, design software, analytics dashboards, developer tools: none are subject to a transaction tax in New Hampshire.
When the 7% Communications Services Tax Can Catch SaaS
The one transaction tax that can overlap with SaaS is the Communications Services Tax under RSA 82-A, imposed at 7% on two-way communications services purchased in New Hampshire.3New Hampshire General Court. New Hampshire Code 82-A:3 – Imposition of Tax, Intrastate Communications Services The statute defines communications services broadly to cover VoIP, facsimile, mobile telecommunications, cable television, and essentially any electromagnetic system capable of two-way communication.4New Hampshire General Court. New Hampshire Code 82-A:2 – Definitions
Most SaaS products are untouched. The exposure arises when a platform’s core function is transmitting messages, voice, or data between users rather than giving one user a tool to do work. A cloud phone system almost certainly qualifies. A collaboration tool with a secondary chat feature probably does not. When the question is close, the primary function of the platform controls. Providers whose software qualifies as a communications service must register with the Department of Revenue Administration and file monthly returns.5NH Department of Revenue Administration. Business Taxes You Will Owe on New Hampshire Revenue
Not having a sales tax does not mean New Hampshire leaves SaaS income alone. The state taxes business income at rates that rival corporate income taxes elsewhere, and this is where SaaS companies tend to be surprised.
Business Profits Tax
The Business Profits Tax applies at 7.5% on taxable business profits for taxable periods ending on or after December 31, 2023.6New Hampshire General Court. New Hampshire Code 77-A:2 – Imposition of Tax For 2026, a business organization must file if its gross business income exceeds $109,000.7New Hampshire Department of Revenue Administration. NH Department of Revenue Administration Shares Tax Tips and Filing Guidance It reaches every business form: sole proprietors, partnerships, LLCs, and corporations. A SaaS company earning revenue in New Hampshire will owe BPT on its apportioned profits.
Business Enterprise Tax
The Business Enterprise Tax is a separate 0.55% levy on the enterprise value tax base, which includes compensation, interest, and dividends paid out by the business.8NH Department of Revenue Administration. Business Taxes For 2026, a business must file if gross receipts exceed $298,000 or the enterprise value tax base exceeds $298,000.7New Hampshire Department of Revenue Administration. BET paid can be credited against BPT liability, and unused BET credits carry forward for up to ten taxable periods.8NH Department of Revenue Administration. Business Taxes For a profitable SaaS company, the BET often works as a minimum tax floor rather than a second bill.
Selling SaaS Into New Hampshire From Out of State
If you sell SaaS to New Hampshire customers from somewhere else, you have no sales tax obligation to New Hampshire. Nothing to collect, nothing to register for, nothing to remit. RSA 78-E states that New Hampshire “does not impose a traditional broad-based sales and use tax” and that state law and policy do not require businesses to build systems for collecting one.9New Hampshire General Court. New Hampshire Code 78-E:1 – Findings and Purpose
The same statute addresses the 2018 Supreme Court decision in South Dakota v. Wayfair, which let states require remote sellers to collect sales tax based on economic activity rather than physical presence. New Hampshire acknowledged the ruling without adopting it, since there is no sales tax here for remote sellers to collect.
If You Are a New Hampshire SaaS Company Selling Elsewhere
Your home state’s silence on sales tax does not shield you from other states’ rules. Roughly 25 states tax cloud software in some form, each with its own definitions and economic nexus thresholds. If your sales into one of those states cross its threshold, you will generally need to register, collect, and remit sales tax there.
RSA 78-E provides some procedural protections for New Hampshire remote sellers responding to demands from other states, but it does not override another state’s taxing authority under Wayfair.9New Hampshire General Court. New Hampshire Code 78-E:1 – Findings and Purpose Taxability of a SaaS sale is determined by where the customer sits, not where you operate from. For a New Hampshire SaaS company with customers across the country, multi-state sales tax compliance is an operational reality rather than a hypothetical one.
