A pack of 20 cigarettes bought in New York State carries a $5.35 state excise tax, and a pack bought inside New York City carries an additional $1.50 city excise tax. Add the $1.01 federal excise tax and standard sales tax, and the New York cigarette tax load reaches roughly $9 per pack in the five boroughs before the manufacturer’s price even enters the picture. On top of that, minimum pricing laws keep the shelf price from falling below set floors, so discount packs effectively don’t exist here.
The $5.35 State Excise Tax
New York Tax Law § 471 sets the state excise tax at $5.35 for every pack of 20 cigarettes.1New York State Senate. New York Tax Law Article 20 – 471 Packs containing more than 20 are taxed at roughly $1.34 for each additional group of five. This is the highest state cigarette excise tax in the country; the next-highest states trail by more than a dollar per pack.
You don’t pay this tax at the register as a separate line item. Licensed stamping agents buy adhesive tax stamps from the Department of Taxation and Finance and affix them to the bottom of every pack before shipping to retailers.2New York State Department of Taxation and Finance. Cigarette and Tobacco Products Tax Retailers recover the cost by building it into the shelf price, so the $5.35 is already baked in by the time you pick a pack up.
An Extra $1.50 in New York City
Buy cigarettes anywhere in the five boroughs and you pay an additional $1.50 per pack in city excise tax.3NYC Department of Finance. Cigarette and Other Tobacco Products Tax Combined with the state tax, that’s $6.85 in excise tax alone before federal tax or sales tax.
Distributors sending product into the city must use a joint state-and-city tax stamp rather than a state-only stamp. The joint stamp confirms both the $5.35 state tax and the $1.50 city tax were paid.2New York State Department of Taxation and Finance. Cigarette and Tobacco Products Tax A Manhattan retailer caught selling packs with only a state stamp is treated as selling untaxed cigarettes for city purposes.
The Federal Excise Tax
The federal government adds its own tax of $50.33 per 1,000 small cigarettes, which works out to about $1.01 per pack of 20.4Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax The rate has held steady since April 2009 and applies the same everywhere in the country.
Manufacturers pay it before the cigarettes leave the factory, and the cost flows downstream through wholesalers and retailers to the consumer.5U.S. Department of the Treasury, Alcohol and Tobacco Tax and Trade Bureau. Federal Excise Tax Increase and Related Provisions You never see it as a separate charge, but it’s embedded in every pack’s price.
Sales Tax on Top of Excise Tax
New York applies ordinary sales tax to cigarette purchases, calculated on the full retail price with all excise taxes already included. You’re paying tax on top of other taxes. The state base rate is 4%, and counties, cities, and the Metropolitan Commuter Transportation District layer their own rates on top.6New York State Department of Taxation and Finance. Find Sales Tax Rates Combined rates run from about 7% to 8.875%, with the top rate in New York City.
For cigarettes specifically, the state uses a prepaid sales tax system. Wholesalers and stamping agents remit a portion of the sales tax in advance when they purchase inventory. Retailers then collect the full sales tax from customers at the register and claim a credit for the prepaid amount on their returns.7New York State Department of Taxation and Finance. Prepaid Sales Tax on Cigarettes The result for consumers is identical to normal sales tax; the mechanics just protect state revenue upstream.
What You Actually Pay Per Pack
For a pack bought in New York City, the tax layers stack up like this:
- Federal excise tax: $1.01
- State excise tax: $5.35
- City excise tax: $1.50
- Sales tax: 8.875% of the retail price
Outside the city, you drop the $1.50 and the sales tax rate falls to whatever applies locally, but the $5.35 state tax and $1.01 federal tax travel with every pack sold in New York.
Minimum Price Floors Keep Packs Expensive
Even if a retailer wanted to compete on price, New York law won’t let them cut too far. The Cigarette Marketing Standards Act prohibits selling cigarettes below cost, and the Department of Taxation and Finance publishes minimum wholesale and retail prices that vary by the manufacturer’s list price.8New York State Department of Taxation and Finance. Publication 509 – Minimum Wholesale and Retail Cigarette Prices
New York City goes further. Local Law 145 sets an absolute floor of $13.00 per pack regardless of brand.9NYC Department of Health and Mental Hygiene. New Law – Minimum Prices for Tobacco Products Most packs sell well above that once retailer margins and sales tax are added. Outside the city, minimum retail prices depend on the brand but generally start in the low-to-mid teens.
Can You Buy Cheaper Out of State or Online?
Short answer: no, not legally, and shipping is largely blocked anyway. The federal PACT Act makes it illegal to mail cigarettes through the U.S. Postal Service except in narrow situations such as shipments within Alaska or Hawaii, small personal gifts, and returns to manufacturers.10United States Postal Service. Shipping Restrictions and HAZMAT – What Can You Send in the Mail Private carriers like UPS and FedEx have largely stopped shipping cigarettes to consumers.
Any seller who does ship cigarettes across state lines to consumers has to verify the buyer’s age through a commercial database, collect and remit the destination state’s excise taxes, file monthly reports with that state’s tax authority listing the buyer and quantity, and use a delivery service that records the recipient’s signature.11Office of the Law Revision Counsel. 18 USC 1716E – Tobacco Products as Nonmailable Knowing violations are a federal felony punishable by up to three years in prison.
New York also requires individuals who buy cigarettes out of state for personal use to report and pay the state excise tax themselves. Enforcement against a traveler bringing a carton home from vacation is rare in practice, but organized smuggling operations trucking cigarettes from low-tax states face both state criminal charges and federal PACT Act prosecution.
Reservation Sales Are Not a Loophole
Cigarettes sold on Native American reservations in New York follow a separate framework. Wholesalers delivering to reservation sellers still have to affix New York State tax stamps, but they are not required to collect the prepaid sales tax on packs sold to members of the Indian nation or tribe.7New York State Department of Taxation and Finance. Prepaid Sales Tax on Cigarettes Cigarettes resold to non-members are fully subject to all applicable state taxes. The Oneida Indian Nation is the one exception: it imposes its own taxes and applies its own stamps, so packs sold there don’t need New York State stamps.
Penalties for Unstamped Cigarettes
New York treats possession and sale of unstamped cigarettes seriously, with penalties that scale up with quantity and prior offenses under Tax Law § 1814:
- Possessing or selling any amount of unstamped cigarettes for sale, if you’re not a licensed agent, is a misdemeanor.12New York State Senate. New York Tax Law 1814 – Cigarette and Tobacco Products Tax
- A repeat misdemeanor within five years, or possession or sale of 10,000 or more unstamped cigarettes, becomes a class E felony, punishable by up to four years in prison.12New York State Senate. - Possession or sale of 30,000 or more unstamped cigarettes jumps to a class D felony, punishable by up to seven years.12New York State Senate. New York Tax Law 1814 – Cigarette and Tobacco Products Tax13New York State Senate. New York Penal Law 70.00 – Sentence of Imprisonment for Felony
One evidentiary rule matters for ordinary people: possessing more than 400 unstamped cigarettes, roughly two cartons, creates a legal presumption that the cigarettes are subject to the excise tax.12New York State Senate. New York Tax Law 1814 – Cigarette and Tobacco Products Tax That alone doesn’t trigger criminal charges, but it shifts the burden to you to explain why those packs shouldn’t be treated as taxable inventory. Separate civil penalties under Tax Law § 481 can also apply on top of any criminal charges, and the state has authority to seize untaxed cigarettes and the vehicles used to transport them.
