New York concealed carry reciprocity is effectively nonexistent: the state does not honor a concealed carry permit from any other state or the District of Columbia, and carrying a loaded handgun in New York on an out-of-state license is a Class C violent felony carrying a mandatory minimum of three and a half years in prison. Outbound, the picture is better. Roughly two dozen states recognize a New York permit, and 29 more allow concealed carry without any permit at all.
New York Honors No Out-of-State Permits
New York’s licensing framework in Penal Law Section 400.00 contains no provision recognizing concealed carry permits from other jurisdictions.1New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms There is no reciprocity agreement with any state. The absence is deliberate, not an oversight. Whether your permit comes from Pennsylvania, Florida, Texas, or anywhere else, it has no legal weight the moment you cross the state line.
This applies the same way to a Connecticut resident commuting into Westchester, a Florida visitor flying into JFK, and a Pennsylvania driver passing through on I-80. The only concealed carry credential New York recognizes is a New York pistol license. Non-residents may apply, but they must meet the same requirements as residents. There is no streamlined visitor process and no short-term permit.
The Penalty for Carrying on an Out-of-State Permit
Possessing a loaded handgun in New York without a valid state-issued license is charged as criminal possession of a weapon in the second degree, a Class C violent felony.2New York State Senate. New York Penal Code 265.03 – Criminal Possession of a Weapon in the Second Degree Under the state’s determinate sentencing rules for violent felonies, a conviction carries a minimum of three and a half years and a maximum of fifteen years in prison.3New York State Senate. New York Penal Code 70.02 – Sentence of Imprisonment for Violent Felony Offense The minimum is mandatory. A judge cannot go below it.
Having a valid permit from another state is not a defense, not a mitigating factor, and not grounds for a reduced charge. New York prosecutors, and prosecutors in New York City especially, routinely bring this charge against out-of-state visitors stopped in vehicles or flagged at airports with a loaded firearm they believed was covered by a home-state license. Good faith does not change the exposure.
The One Federal Protection for Travelers Passing Through
The Firearm Owners Protection Act, 18 U.S.C. § 926A, lets you transport a firearm through New York if you are traveling between two places where you may lawfully possess and carry it.4Office of the Law Revision Counsel. 18 USC 926A – Interstate Transportation of Firearms The protection is narrow, and New York enforces its edges aggressively. Three conditions must all be met:
- You must be legally allowed to possess the firearm at both origin and destination. If either end prohibits your possession, the protection does not apply.
- The firearm must be unloaded and stored so it is not readily accessible from the passenger compartment. In a vehicle without a separate trunk, it must be in a locked container. A glove compartment or center console does not qualify.
- Travel must be continuous. The statute covers transportation, not stops. Checking into a hotel, breaking the trip for sightseeing, or any stop beyond basic travel needs like fuel can forfeit the protection.
Ammunition must also be stored so it is not readily accessible from the passenger compartment, either locked with the firearm or in a separate locked container in the trunk. Travelers connecting through New York airports have been arrested while attempting to check firearms on connecting flights, with authorities treating the airport stop as a break in continuous travel. FOPA is a last-resort shield, not a workaround for carrying.
States That Honor a New York Permit
Outbound reciprocity is better than inbound, though still limited. Roughly two dozen states recognize a New York carry permit, either through specific recognition policies or because they honor permits from all U.S. jurisdictions. These are states with broad recognition frameworks on their own books, not states that negotiated anything with Albany, because New York does not negotiate reciprocity.
Another 29 states have constitutional carry laws that let any person who may lawfully possess a firearm carry concealed without a permit. In those states your New York permit is technically unnecessary, but it still has value. It documents that you passed a background check, which can simplify a traffic stop and can exempt you from certain restrictions such as the federal school-zone prohibition.
Before any trip, confirm the destination’s current rules directly rather than relying on a map that may be months out of date. Two details catch travelers:
- Some states honor only resident permits. Most New York permits are resident permits, but a non-resident New York license may not be recognized where a resident New York license would be.
- Age thresholds vary. Some states require carry permit holders to be 21. Others set 18 for their own residents but 21 for visitors.
Getting a New York License Instead
If you need to carry in New York, the only route is a New York pistol license, and non-residents go through the same process as residents. Applications are filed with the local licensing authority, typically the county clerk or local police department. Statutory application fees outside New York City are set by the county legislature and range from $3 to $10, though fingerprinting and other costs add considerably more.1New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms Expect roughly six months from a complete application to a decision.
Once issued, permits must be recertified with the State Police every three years, or every five years for premises-restricted permits.5Gun Safety in New York State. Pistol Permit Recertification Missing the deadline is grounds for cancellation, which means starting over from scratch rather than renewing.
New York City Requires a Separate License
A New York State carry license issued by a county outside the five boroughs is not valid inside New York City. Penal Law Section 400.00 states that a carry license “shall not be valid within the city of New York unless a special permit granting validity is issued by the police commissioner.”6NYPD License Division. NYS Penal Law Section 400.00 and Rules of the City of New York This catches upstate and Long Island permit holders who assume a state-issued license covers the whole state.
The NYPD License Division handles city handgun licenses through an online application system. The application fee is $340, plus $88.25 for fingerprinting.7NYPD License Division. New Application Instructions A “Special Carry” license lets a county permit holder also carry in the city, but it requires maintaining the underlying county license. If the county license is revoked or suspended, the Special Carry license is automatically void.
Even a Valid New York Permit Has Hard Limits
A New York carry license does not open all doors. Penal Law Section 265.01-e designates more than twenty categories of “sensitive locations” where a licensed carrier commits a crime by bringing a firearm.8New York State Senate. New York Penal Code 265.01-E – Possession of a Firearm in a Sensitive Location The restricted areas include:
- Government buildings and courts
- All schools and educational institutions, from preschool through university
- Hospitals, behavioral health providers, and substance abuse treatment facilities
- Public parks, playgrounds, and zoos, with an exception for the Forest Preserve and privately held land within public parks
- Houses of worship, except for individuals specifically responsible for security there
- Public transit vehicles and facilities
- Bars and other venues licensed for on-premises alcohol consumption, plus theaters, conference centers, banquet halls, and sporting event venues
- Homeless, domestic violence, family, and runaway youth shelters
- Protests and public assemblies
Portions of this list have been challenged in court. In Antonyuk v. James, the Second Circuit largely upheld the sensitive-locations framework while leaving a narrow injunction on the houses-of-worship restriction as applied to certain plaintiffs. Litigation continues, but the broader structure is enforceable. Treat the full list as live law unless a court has specifically struck down a category.
Federal law separately prohibits firearm possession within 1,000 feet of a school zone unless the carrier holds a state-issued license and the state verified qualifications before issuing it.9Office of the Law Revision Counsel. 18 US Code 922 – Unlawful Acts A valid New York license satisfies that exception. An out-of-state permit does not, because New York does not recognize it in the first place.
One Related Trap: Semi-Automatic Rifles
Since September 2022, New York has required a license to purchase or take possession of any semi-automatic rifle, using the same form and process as the pistol license.1New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms A current pistol license can add a semi-automatic rifle endorsement without a separate application. Without a pistol license, you must apply for one to acquire a semi-automatic rifle. Most states require no license for a rifle purchase, so first-time buyers in New York are often surprised.
