New York Form TR-570, the LLC/LLP Request for Information, is a questionnaire the New York State Department of Taxation and Finance mails to limited liability companies and limited liability partnerships shortly after they register with the Department of State. Fill it out completely, have a member or authorized officer sign it, and return it by mail or fax within 15 days of the date printed on the form. Unsigned or incomplete forms get sent back.
Why the Tax Department Sent It to You
The Tax Department uses TR-570 to set up your business tax account, decide which returns you’ll be expected to file, and place you in the correct tax categories. The trigger is a recent registration with the New York Department of State, which includes conversions from a different entity type such as a general partnership or sole proprietorship.1New York State Department of Taxation and Finance. Responding isn’t optional. Without the information the form collects, your account may show as incomplete, and you may not receive the filing reminders and notices tied to your account.
What to Have in Front of You Before You Start
You’ll move through the form faster if you pull these together first:
- Your nine-digit EIN (or the note “Applied for” if the IRS hasn’t issued it yet).
- Your six-digit NAICS industry code, which appears on the IRS confirmation letter that came with your EIN, or on the U.S. Census Bureau’s NAICS lookup.
- Your business mailing address and physical business address, with a daytime phone number.
- The name, address, Social Security Number or ITIN, and ownership percentage for every member or partner.
- Details of any prior business entity your LLC or LLP succeeds, if applicable.
Working Through the Parts
Business Addresses
Enter your mailing address and your physical location. If they differ, complete both blocks. Street address goes on the top line, city, state, and ZIP on the middle line, phone on the bottom. A “care of” line belongs in the mailing address block only.
Federal Tax Election
Show how your LLC is classified for federal tax purposes. Multi-member LLCs are usually partnerships; single-member LLCs are usually disregarded entities, and you’d also check “Yes” in the single-member field. If your LLC elected S corporation status with the IRS, check “Other” and write in “S Corp.” This entry determines which New York returns the department will expect from you, so take a moment to confirm it matches what you filed federally.
EIN and NAICS Code
Enter the EIN as nine digits with no dashes. If your EIN application is pending, write “Applied for” on the line beneath the EIN box. Then enter your six-digit NAICS code.
Members or Partners
List each member of the LLC or partner of the LLP: name, Social Security Number or ITIN, address, and ownership percentage. Every field for every person must be filled in. If you’re the sole member, list yourself. This part carries a signature and date line, and the signer is confirming the member information is accurate. Blank fields here are the most common reason forms come back.
Successor Status
If your LLC or LLP is not taking over an existing business, check the box that says so and skip to Part 9. If it is a successor, give the prior entity’s name, EIN, and the date of succession so the department can link the old account records to yours.
Other Tax Registrations
Part 9 covers additional tax types: sales tax, withholding tax, highway use tax. Check every box that applies. Handling it here opens those accounts at the same time and saves you from filing separate registration forms later.
Signing and Sending It Back
A member or authorized officer must sign and date the form. The Tax Department will reject and mail back anything unsigned or incomplete, so run through each part one more time before it leaves your desk. The mailing address and fax number are printed on the form. Keep a copy for your records. With only 15 days from the date on the form, fax is the faster option if you’re close to the deadline.
If Your Accountant or Attorney Is Handling It
A representative who fills out and returns TR-570 for you needs authorization on file with the Tax Department. You can generate POA-1 through the Tax Department’s Online Services web application, print it, sign it, then scan and upload it. If you prefer paper, complete and sign it and fax it in; fax is the department’s preferred method for paper submissions. Do not attach a paper POA-1 to your TR-570. What Filing Obligations Follow From TR-570
Sending the form back sets up your account. It does not stand in for your ongoing returns, which flow from the federal tax election you reported:
- Single-member LLC treated as a disregarded entity: report business income and expenses on your personal New York State income tax return.
- Partnership: file Form IT-204, Partnership Return, if the LLC or LLP has New York source income.
- Corporation or S corporation: file a New York State corporation franchise tax return.
Most LLCs and LLPs with New York source income also file Form IT-204-LL and pay an annual filing fee. One Thing TR-570 Is Not For
If what you actually need is a copy of a previously filed return, TR-570 is the wrong form. Requests for copies go on DTF-505, Authorization for Release of Photocopies of Tax Returns and/or Tax Information. That form requires a copy of valid identification, costs 25 cents per page, and takes about 30 days to process once the department has a complete request.5New York State Department of Taxation and Finance.
