New York HazMat Endorsement: Testing, TSA Check, and Renewal

To get a New York HazMat endorsement, you need to hold a valid New York CDL, pass a written knowledge test at the DMV, mail in an application with proof of your legal status, and clear a TSA security threat assessment that includes fingerprinting. Plan on at least 60 days from start to finish, because the federal background check alone can take 45 days or more and there is no way to speed it up.

Who Can Apply

Four things have to be true before you start:

You hold a Class A, B, or C New York CDL.
You are at least 21 years old, as required by New York Vehicle and Traffic Law § 502(2)(a).¹
You are a U.S. citizen or lawful permanent resident and can prove it with an accepted document — a U.S. passport, an original or certified birth certificate, a Consular Report of Birth Abroad (FS-240), a Certificate of Naturalization (N-550 or N-570), a Certificate of Citizenship (N-560 or N-561), or a valid Permanent Resident Card.²
You have a valid USDOT Medical Examiner’s Certificate.³

If you don’t have your CDL yet, get that squared away first. The HazMat endorsement is an add-on, not a standalone license.

Entry-Level Driver Training if You’ve Never Held the Endorsement

First-time applicants have to complete federal Entry-Level Driver Training before they can sit for the knowledge test. The requirement took effect February 7, 2022, and it doesn’t apply retroactively — if you held a HazMat endorsement on any state’s CDL before that date, you can skip this step.⁴

The training is theory-only. There’s no behind-the-wheel component. You take it from a provider listed on the FMCSA Training Provider Registry at tpr.fmcsa.dot.gov, filtered by “Hazardous Materials” and your location. Online courses run from roughly $20 to over $100, and because the curriculum is federally mandated, the content is the same regardless of what you pay. When you finish, the provider reports your completion to the registry, and the DMV checks the registry before letting you test.

The Knowledge Test

The HazMat knowledge test is a multiple-choice exam at a New York DMV office covering hazardous materials regulations, placarding, handling, loading and unloading, and emergency response. You need 80% to pass, and each attempt costs $5.¹⁵

One thing to expect: passing the test does not put the endorsement on your license. It’s step one. Fingerprinting and the background check happen separately, on their own timeline.

Mailing In the Application

After you pass the test, complete the Application for a Hazardous Materials Endorsement (Form HAZ-44) and mail it, along with a copy of your proof of legal status, to the DMV HazMat Unit at the address on the form.² The application can’t be submitted online or handed in at a DMV counter.

Check the document you’re including against the list in Section III of the HAZ-44. Sending something that isn’t on that list is one of the most common reasons applications come back, and each round trip through the mail costs weeks.

TSA Fingerprinting and Background Check

Federal and state law require every HazMat applicant to pass a TSA security threat assessment that includes a criminal history check and fingerprinting.⁶ Fingerprinting is done at an IdentoGO enrollment center in New York State. Schedule the appointment on the IdentoGO website or by phone, and bring your New York CDL plus a second form of ID.

The fee is $85.25, non-refundable, payable by credit card, money order, company check, or certified check. It covers the full five-year assessment period.⁷

TSA recommends enrolling at least 60 days before you need the endorsement, because processing can exceed 45 days when demand is high.⁷ The DMV can’t add the endorsement to your license until both federal and state checks clear. There is no expedite option.

Criminal History That Disqualifies You

TSA sorts disqualifying offenses into two buckets. Knowing which one applies to your record can save you the fees and the wait.

Permanent Disqualifications

Certain felonies bar you from the endorsement no matter how long ago they happened:

Espionage, sedition, or treason
A federal crime of terrorism under 18 U.S.C. 2332b(g), or a comparable state offense
A crime involving a transportation security incident
Improper transportation of hazardous material under 49 U.S.C. 5124
Unlawful possession, use, sale, manufacture, or distribution of explosives or explosive devices
Murder
Making threats involving explosives or lethal devices against public facilities or transportation systems
Certain RICO violations where a predicate act is itself a permanently disqualifying crime

Attempts and conspiracies to commit these offenses count the same as the completed crime.⁸

Interim Disqualifications

A second group of felonies disqualifies you only if you were convicted within seven years of your application, or released from incarceration within five years:

Unlawful possession, use, sale, or distribution of a firearm or other weapon
Arson, extortion, bribery, smuggling, or robbery
Kidnapping or hostage taking
Rape or aggravated sexual abuse
Assault with intent to kill, or voluntary manslaughter
Distribution or possession with intent to distribute a controlled substance
Fraud, dishonesty, or misrepresentation, including identity fraud and money laundering tied to listed offenses (welfare fraud and passing bad checks are excluded)
Immigration violations

Once enough time has passed, these convictions no longer block the endorsement.⁸

Mental Health Findings

TSA will also deny the endorsement if a court or government authority has found that you pose a danger to yourself or others because of mental illness, that you lack the capacity to manage your own affairs, that you were incompetent to stand trial, or that you were involuntarily committed to an inpatient mental health facility.⁸

If TSA Denies You

A denial isn’t necessarily final. When TSA finds potentially disqualifying information, it mails a Preliminary Determination of Ineligibility letter that explains the basis. You have 60 days from receiving it to respond.⁹

You can request an appeal, a waiver, or both. An appeal argues that TSA’s information is wrong, such as a mistaken identity or a conviction that was reversed. A waiver accepts the disqualifying event but asks TSA to grant the endorsement based on mitigating factors. TSA weighs the circumstances of the offense, restitution, completion of court-ordered treatment, medical documentation of recovered mental capacity, and other evidence of rehabilitation.⁹ TSA also runs a help line at 1-855-347-8371 for applicants working through this process.

How Long the Endorsement Lasts and How to Renew It

Your HazMat endorsement is valid for five years, on its own clock — the expiration doesn’t line up with your CDL.² DMV normally mails a renewal notice about 60 days out, separate from any CDL notice.⁵ Put the date on your own calendar too. The endorsement expires whether the letter arrives or not.

Renewal takes two things:

Retake and pass the HazMat knowledge test within two years before your CDL expires, at the same 80% score and $5 per attempt.⁵
Submit new fingerprints and clear a fresh TSA security threat assessment every five years, at the same $85.25 fee.¹⁰

Start early. If the endorsement lapses, you can’t legally haul placarded hazardous materials until the new background check clears, and that clearance can take 45 days or more.

Penalties for Driving Placarded Loads Without the Endorsement

Transporting placarded hazardous materials without a valid HazMat endorsement is a federal criminal misdemeanor.¹¹ Federal civil penalties for knowingly violating hazardous materials transportation laws can reach $79,976 per violation, or $186,610 if the violation causes death, serious injury, or substantial property destruction, and each day of a continuing violation counts as a separate offense. Your CDL can also be disqualified. The process to get the endorsement is slow, but the exposure for going without it is far worse.
