New York propane tank regulations sit primarily in the State Fire Code, which adopts NFPA 58 and sets the rules for where a tank can go, how far it has to sit from buildings and property lines, who is allowed to install it, and how it must be inspected and maintained. For a typical residential aboveground tank between 125 and 500 gallons, the minimum distance from any building is 10 feet. Getting the details right matters because violations can trigger daily civil penalties in the tens of thousands of dollars and give your insurer grounds to deny a claim.
Where a Tank Can Legally Sit
Chapter 38 of the New York State Fire Code (Section 3804) requires propane containers to be placed at specified distances from buildings, public ways, and the lot lines of any neighboring property that can be built on. - Under 125 gallons water capacity: 5 feet from buildings.
- 125 to 500 gallons: 10 feet from buildings.
- 501 to 2,000 gallons: 25 feet from buildings.
- Larger commercial-scale tanks (2,001 gallons and up) require 50 feet or more.
Underground and mounded tanks are allowed shorter distances. A mounded container of 501 to 2,000 gallons, for example, needs 10 feet from a building rather than the 25 feet required aboveground. Loose combustible materials and weeds must be cleared at least 10 feet around any LP-gas container. Inspectors flag this one often, especially in summer.
Clearances from Ignition Sources and Building Openings
Beyond the setback from the building itself, NFPA 58 imposes separate clearances from ignition sources and air intakes. For ASME containers filled on-site, the pressure relief valve discharge, filling connection, and liquid-level gauge vent must sit at least 10 feet from any exterior ignition source, direct-vent appliance opening, or mechanical ventilation intake. Exchangeable DOT cylinders need 5 feet of clearance from those same sources. Permits and Who Can Install the Tank
The Fire Code requires a permit before an LP-gas container meeting the size threshold can be installed and filled. A propane distributor is not allowed to fill a tank at a location unless a permit has been issued by the local fire official or building department. The application typically calls for a site plan showing the proposed tank location, setback distances, and piping layout. Fees and specific submission requirements are set by each municipality, so call your local code enforcement office before scheduling delivery.
Installers must be certified by the New York State Department of State, Division of Licensing Services, under Article 21-B of the Executive Law and 19 NYCRR Part 1210.3New York Department of State. Hiring an uncertified installer creates compliance problems that can affect your insurance, your permit, and your ability to get the tank filled.
Enforcement of the Fire Code sits with the “authority having jurisdiction,” which in practice means your local code enforcement officer, fire marshal, or building inspector. Inspections and Maintenance
The Fire Code requires routine inspections for leaks, corrosion, and other hazards, performed by qualified personnel following current NFPA 58 protocols. If your tank is leased, the propane supplier usually handles scheduled inspections. If you own the tank, arranging them is on you.
Pressure Relief Valves
Every propane tank has a pressure relief valve that vents gas if internal pressure gets too high. For ASME tanks holding more than 2,000 gallons water capacity, NFPA 58 and the National Board Inspection Code require pressure relief valves to be tested every five years, and any valve over 10 years old must be tested or replaced before the next scheduled inspection. Smaller residential tanks have less prescriptive testing rules, but replacing the relief valve at 10 years is standard industry practice.
Leak Testing and Records
A professional leak test uses pressure to confirm the whole system is sealed. Propane companies typically perform one when filling a new installation for the first time or after any service that opens the gas lines. New York also requires detailed documentation of installations and inspections. Maintenance records, inspection results, and permits must be retained and available for regulatory review. Keeping organized records also protects you if you have an insurance claim or sell the property.
Underground Tanks
A distinction that trips people up: propane is classified as a liquefied petroleum gas and is explicitly excluded from the DEC’s Chemical Bulk Storage program under 6 NYCRR Part 596. The DEC still gets involved if a release contaminates soil or groundwater. Spill reporting obligations under ECL Article 17 can apply regardless of the substance, and the DEC keeps enforcement authority over environmental contamination from petroleum-derived products.6NYSDEC. Bulk Storage
NFPA 58 requires underground propane tanks to have cathodic protection against corrosion, typically sacrificial anodes electrically connected to the tank and buried in the backfill. The anodes must be inspected and tested at intervals no longer than three years to confirm they are still doing their job. Skipping these checks is a quiet compliance failure that stays quiet until a corroded tank leaks.
Portable DOT Cylinders
Portable DOT-specification propane cylinders (the kind used for grills, generators, and space heaters) fall under federal requalification rules. For cylinders used only in LPG service, there is a practical alternative: instead of a full hydrostatic pressure test, a complete external visual inspection meeting CGA C-6 or C-6.3 can be done when requalification comes due. Cylinders requalified by visual inspection must then be reinspected every five years. The inspector checks for leakage, corrosion, gouges, dents, damaged footrings or protective rings, and fire damage. The original test date is stamped into the collar of every DOT cylinder. If the stamp is unreadable or the date has passed, most exchange retailers will simply refuse the cylinder.
Insurance and Liability
Homeowners insurance policies generally require compliance with applicable fire codes and safety standards as a condition of coverage. A tank installed without a permit, sited too close to the house, or worked on by an uncertified installer gives the insurer grounds to deny a claim. If a fire, explosion, or leak causes damage and the investigation turns up code violations, the loss can end up entirely on you. Confirm with your insurer before installation that your policy covers propane-related risks, and ask whether an environmental contamination rider is available or required.
Under New York common law, property owners have a duty to maintain reasonably safe premises, and that duty covers the propane equipment on the property. If a defective or badly maintained tank injures someone or damages neighboring property, the owner faces claims for personal injury, property damage, and cleanup costs. Propane companies that install or service systems negligently carry their own exposure.
Penalties for Non-Compliance
New York imposes steep penalties for violations related to propane storage and environmental contamination. The DEC’s enforcement policy for bulk storage and spill response has historically applied civil penalties of up to $25,000 per day for release-reporting failures and related violations.9NYSDEC. A paperwork lapse will not draw the same response as an unreported leak that reaches a neighbor’s well.
Criminal charges are possible in serious cases. Environmental crimes under the ECL and reckless endangerment under the Penal Law are both on the table where violations create significant safety risks or environmental harm. Civil lawsuits from injured neighbors or affected property owners can produce large compensation awards without any criminal prosecution. Businesses that install or service propane systems face the added risk of license revocation.
Fire Code violations enforced locally carry their own separate penalties, which vary by municipality. Local code enforcement officers can issue stop-work orders, deny occupancy permits, and impose fines for unapproved installations or setback violations.
