Which Code Book to Download

There is no single “Uniform Code” PDF. The Uniform Code is a collection of code books, each covering a different piece of building safety, all adopted by reference in Title 19 of the New York Codes, Rules and Regulations.1Department of State. Nine PDFs make up the set:

  • Building Code of New York State — commercial and large residential construction, including structural design, fire-resistant assemblies, and means of egress.
  • Residential Code of New York State — one- and two-family dwellings and townhouses.
  • Fire Code of New York State — fire prevention, hazardous materials storage, and fire protection systems.
  • Plumbing Code of New York State — water supply, drainage, and sanitary piping.
  • Mechanical Code of New York State — HVAC, exhaust, and duct installation.
  • Fuel Gas Code of New York State — gas piping and appliance installation.

Pick the book that matches the work you are doing. Building a new single-family home? Start with the Residential Code, then check the Energy Conservation Construction Code. Renovating an existing commercial space? The Existing Building Code is the entry point, with cross-references to the Building, Fire, Plumbing, and Mechanical Codes as the scope of work demands. Managing occupied rental property? The Property Maintenance Code is the one that governs ongoing habitability.

Use the DOS Version, Not the Generic ICC Code

The ICC retains copyright over the base model codes, so the versions posted on the DOS website are the ones with the New York amendments already built in. Downloading the ICC’s generic International Building Code instead of the Building Code of New York State would miss the state-specific modifications that override or add to the national model language. Permit reviewers work from the DOS editions, and using the wrong version can lead to plan rejections or costly redesigns.

Alongside the code book PDFs, the DOS site hosts technical bulletins, guidance documents, and interpretive memos. These clarify how specific provisions apply in practice. Where the Uniform Code Does Not Apply

New York City is exempt from the Uniform Code. The five boroughs operate under the separate New York City Building Code and Fire Code, administered by the NYC Department of Buildings.1Department of State. Outside the city, local governments may go stricter than the state code, but never below it. Executive Law §379 authorizes cities, towns, villages, and Nassau County to enact local laws imposing higher or more restrictive standards.1Department of State. What the Code Actually Regulates

Once you have the right PDF, expect substantive requirements across several areas.

Structural and Fire Safety

The Building Code sets load-bearing capacity, foundation stability, and resistance to wind, snow, and seismic forces.1Department of State. Automatic sprinkler systems are required in high-rise buildings, large residential complexes, and many commercial properties. Egress and Accessibility

Chapter 10 of the Building Code governs how people get out in an emergency. Required exits, widths, and placements depend on occupancy type and capacity. Exit doors must swing in the direction of travel and include panic hardware where the occupancy load warrants it. Accessibility rules require wheelchair-accessible entrances, elevators in multi-story structures, and designated accessible parking. When an existing building is renovated, the code pushes accessibility improvements where feasible, so older buildings move toward compliance as work is done.

Existing Buildings and Change of Use

Renovating triggers the Existing Building Code. The more extensive the project, the more of the current code applies. Changing a building’s occupancy classification escalates requirements quickly. Converting a warehouse to apartments, for example, creates different safety demands and can require current height and area limits, automatic sprinklers, and a structural evaluation for increased live loads. Even converting to an equal or lesser hazard use still triggers review of egress, accessibility, and building materials.5Department of State. Property Maintenance

The Property Maintenance Code sets the floor for habitability in every existing residential and nonresidential building outside New York City: lighting, ventilation, heating, sanitation, and fire safety.4Department of State. 2025 Property Maintenance Code of New York State Owners keep structural elements, plumbing, heating, and common areas in working order. Tenants handle conditions within their control, such as unit sanitation and not tampering with safety devices.

Energy Conservation

The Energy Conservation Construction Code applies to new construction and major renovations, governing insulation levels, window performance, air sealing, HVAC efficiency, and lighting power density.3Department of State. 2024 Building Code of New York State Residential builders can choose among several compliance paths: prescriptive R-value tables by climate zone, a total-UA alternative allowing trade-offs between components, a simulated performance path, or an energy rating index approach. New York spans several climate zones, so requirements in Buffalo differ substantially from the Hudson Valley. Check the climate zone map in the code before selecting a strategy.

Building Permits and Certificates of Occupancy

Every city, town, village, and county in New York administers and enforces the Uniform Code within its own jurisdiction; the state oversees property in the custody of state agencies.7Department of State. Building Standards and Codes Before construction or renovation begins, owners obtain a building permit from the local code enforcement office, submitting plans prepared by a licensed professional. Inspectors verify compliance at framing, electrical rough-in, plumbing, fire suppression, and insulation stages. Serious problems can prompt a stop-work order.

The final step is a certificate of occupancy certifying that the building complies with the Uniform Code and is safe for its intended use. The CO must include the building permit number, use and occupancy classification, construction type, and the occupant load of any assembly areas.8Legal Information Institute. New York Comp. Some building types, such as public assembly spaces, need annual safety inspections to maintain certification.

Penalties for Ignoring the Code

Executive Law §382 gives local governments authority to enforce the Uniform Code through written orders, fines, and criminal prosecution.9New York State Senate. New York Executive Law Section 382 – Remedies Penalties are tiered by how long a violation persists:

  • First 180 days: up to $1,000 per day, up to one year imprisonment, or both.
  • Days 181 through 360: $25 to $1,000 per day, up to one year imprisonment, or both.
  • After 360 days: $50 to $1,000 per day, up to one year imprisonment, or both.

After six months, the minimum floor kicks in, so there is no longer any zero-dollar day.9New York State Senate. New York Executive Law Section 382 – Remedies Courts can also order the removal of a building or abatement of the violating condition. An application for such relief can be brought by the Secretary of State, a local municipal officer, or any person aggrieved by the violation. Where an alteration impedes egress during a fire or emergency evacuation, both the owner and any contractor or architect who knew about the alteration face liability. Properties that threaten occupant safety can be vacated until corrections are complete.

Variances When Compliance Is Not Feasible

When strict compliance with a specific code provision is impractical because of site-specific constraints, owners can apply for a variance under 19 NYCRR Part 1205, administered by DOS through its regional offices. Start by contacting the appropriate regional office. Mailing paperwork straight to Albany without involving regional staff delays the process.10Department of State. Variances

Regional staff evaluate whether the request qualifies as routine, meaning a minor deviation that does not substantially affect safety, or whether it needs a formal hearing before a Board of Review. Routine requests can be resolved administratively. Complex or contested requests go before the Board, which weighs the deviation, the risks, and any proposed alternative safety measures. A variance may be approved, approved with conditions such as additional fire suppression to offset a narrower exit corridor, or denied. Appeals of code enforcement decisions always require a Board of Review hearing; there is no administrative shortcut.10Department of State. Variances

Applicants should be prepared to show that the hardship is specific to the property itself, such as location, lot shape, or topography, rather than personal convenience or simple cost savings. Self-created hardships, like building without a permit and then asking forgiveness, generally do not qualify.
