New York’s Class DJ Junior License: Curfew, Zones, and Passengers

A New York Class DJ junior license lets a 16- or 17-year-old drive without a supervising adult, but the New York junior license restrictions are strict: the state is split into three driving zones with different curfews, you can carry only one passenger under 21 unless they’re family, you cannot drive in New York City at all, and a single cell phone or texting conviction triggers a 120-day suspension.

Where You Can Drive

Vehicle and Traffic Law Section 501 divides the state into three zones for junior license holders, and the rules tighten as you move toward New York City.1New York State Senate. New York Vehicle and Traffic Law VAT 501 – Drivers Licenses and Learners Permits

Upstate and the Rest of the State

Outside New York City, Nassau County, and Suffolk County, you can drive on your own between 5:00 AM and 9:00 PM. Between 9:00 PM and 5:00 AM, unsupervised driving is limited to direct trips to or from school or to or from a job with a regular schedule. Any other overnight driving requires a licensed parent, guardian, or someone acting in that role in the car with you.1New York State Senate. Nassau and Suffolk Counties

Long Island is tighter. From 5:00 AM to 9:00 PM, unsupervised driving is limited to trips to and from a regular job. You can otherwise drive during those hours if a licensed parent, guardian, driving instructor, or someone standing in a parental role is with you. From 9:00 PM to 5:00 AM, unsupervised driving is allowed only for direct trips between home and a short list of approved destinations: a state-approved cooperative work-study program, an approved post-secondary course for credit, a registered evening high school, an approved driver education course, or farm employment.2New York State Department of Motor Vehicles. New York City

The five boroughs are off-limits. A Class DJ license holder cannot drive in New York City under any circumstances, day or night, supervised or not.1New York State Senate. New York Vehicle and Traffic Law VAT 501 – Drivers Licenses and Learners Permits No work exception, no school exception, no parent-in-the-car exception.

Curfew Exceptions for Work and School

To drive to or from a job during restricted hours, your employer must complete a Certificate of Employment (Form MV-58A) verifying your name, work schedule, job location, and hours. Employment has to be recurring: at least once a week for four consecutive weeks. You must carry the certificate whenever you drive outside the standard 5:00 AM to 9:00 PM window for work.3New York State Department of Motor Vehicles. Certificate of Employment Form MV-58A

The certificate has hard limits. It covers only the commute to and from the workplace, not driving as part of the job, so delivery routes and sales driving are out. Farm employment is the one exception and allows driving during work hours. In Nassau and Suffolk counties, the MV-58A authorizes work driving only between 5:00 AM and 9:00 PM, not overnight. And it is never valid in New York City.3New York State Department of Motor Vehicles. Certificate of Employment Form MV-58A

The school exception is narrower than families often assume. “School” means instruction, education, or training licensed or approved by a state agency, plus U.S. Armed Forces training. Extracurricular activities and social events that don’t carry academic credit don’t qualify, so a Friday night football game or a school dance is not a covered trip.1New York State Senate. Passenger Limit

You can have no more than one passenger under age 21 unless the additional passengers are members of your immediate family. The rule does not ban passengers, and it does not apply to family. But the moment a second friend gets in the car, you are in violation.2New York State Department of Motor Vehicles. The Graduated License Law and Restrictions for Drivers Under 18

The cap lifts if certain adults ride along: a licensed parent, legal guardian, someone standing in a parental role, a driver education teacher, or a driving school instructor. Without one of those people present, the one-under-21 limit applies at all times.2New York State Department of Motor Vehicles. The Graduated License Law and Restrictions for Drivers Under 18

Seatbelts and Phones

Every occupant of a vehicle driven by a Class DJ license holder must wear a seatbelt or an appropriate child restraint, regardless of age or seating position. Every seat counts.4New York State Department of Motor Vehicles. New York States Occupant Restraint Law

Handheld phones and portable electronic devices are prohibited while driving under Vehicle and Traffic Law Sections 1225-c and 1225-d. That includes texting, calling, scrolling, or interacting with any screen, and it applies even when stopped at a red light. For junior drivers, a first conviction carries a mandatory 120-day license suspension. A second conviction within six months of getting the license back triggers a revocation of at least one year.5New York State Department of Motor Vehicles. Cell Phone Use and Texting

Four months without a license, from one texting ticket, is far harsher than the standard adult penalty and often catches families off guard.

Other Violations and the Probationary Phase That Follows

Speeding, reckless driving, following too closely, and other serious moving violations can also lead to suspension or revocation of a DJ license, and multiple lesser convictions in a short period can produce the same result. Junior drivers face those consequences faster than adult drivers would for the same conduct.

Vehicle and Traffic Law Section 510-b, which sets a 60-day suspension and a six-month probationary cycle, applies to probationary licenses rather than to the Class DJ itself.6New York State Senate. New York Vehicle and Traffic Law VAT 510-B – Suspension and Revocation of Licenses of Persons Under the Age of Eighteen A probationary license is what you receive after a DJ suspension is lifted or when you first move up to a senior Class D. A single serious violation during that six-month probationary period leads to a 60-day suspension, and a further violation within six months of restoration results in revocation. A clean record during your DJ period carries directly into that next phase.

Driving in Other States

A Class DJ license can be used in another state only if that state’s laws allow it, and you are bound by the visited state’s restrictions rather than New York’s. Check with the destination state’s motor vehicle authority or police before a trip to confirm whether they honor a New York junior license and what local rules apply.2New York State Department of Motor Vehicles. Upgrading to a Senior License

A DJ license does not convert to a full Class D on its own. There are two paths, and the timing depends on driver education.

If you’re 17 and have completed a state-approved high school or college driver education course, you can upgrade early. Bring your junior license and your Student Certificate of Completion (MV-285) to any DMV office, surrender both, and you’ll be issued a senior Class D license on the spot. You can also hand the MV-285 to the license examiner at your road test, and a senior license will be issued automatically once you’re eligible.2New York State Department of Motor Vehicles. The Graduated License Law and Restrictions for Drivers Under 18

Here is the part that surprises people. If you hold the MV-285 but never actually take it to a DMV office to make the switch, you remain subject to every junior license restriction until you turn 18. Carrying the certificate in your wallet is not enough. The upgrade requires a deliberate DMV visit.7New York State Department of Motor Vehicles. New York State Drivers Manual – Chapter 1 Driver Licenses

The five-hour pre-licensing course, which qualifies you to schedule a road test, is not a driver education course and does not make you eligible to upgrade at 17. Only the full high school or college driver education course with the MV-285 unlocks the early upgrade.7New York State Department of Motor Vehicles. New York State Drivers Manual – Chapter 1 Driver Licenses

Without a driver education course, you hold the DJ license and every one of its restrictions until your 18th birthday, when you become eligible for the senior license.
