NJ UEZ Sales Tax Rate: What’s Covered, Zones, and Vendor Checks

The New Jersey UEZ sales tax rate is 3.3125%, exactly half the state’s standard 6.625% rate. It applies to qualifying retail sales made by certified vendors inside one of the state’s 37 designated Urban Enterprise Zones, a program the legislature created in 1983 to steer investment into economically distressed communities.1New Jersey Department of Community Affairs. New Jersey Urban Enterprise Zones Act Not every sale at a UEZ business gets the discount, and the rules about how the sale is completed matter as much as where the store sits.

When the Reduced Rate Applies

The sale has to physically happen at the vendor’s location inside the zone. Under N.J.A.C. 18:24-31.4(e), the purchaser must either accept delivery at the vendor’s UEZ location or the vendor must deliver the goods from that location.2State of New Jersey. NJ Division of Taxation – UEZ Requirements A store can ship goods to an address outside the zone after a sale is completed in person, but the transaction itself has to originate at the storefront.

This is where most of the confusion sits. Phone orders, internet orders, and catalog purchases from a UEZ-certified business do not qualify for the reduced rate, because the sale was not completed by the purchaser in person at the vendor’s zone location.2State of New Jersey. NJ Division of Taxation – UEZ Requirements Those sales get the full 6.625%. If you want the half-rate, you need to walk in.

What the Reduced Rate Does Not Cover

The 3.3125% rate applies to most tangible personal property sold at retail: clothing, furniture, electronics, building materials, and similar everyday goods. Several categories are excluded by law and must be charged at the standard rate even when the vendor is UEZ-certified:

  • Motor vehicles, including cars, trucks, and motorcycles, even when the dealership is inside a zone
  • Alcoholic beverages taxable under the state’s Alcoholic Beverage Tax Law
  • Cigarettes subject to the state Cigarette Tax Act
  • Electricity and natural gas sales

Certified vendors are required to keep separate records distinguishing reduced-rate transactions from those taxed at the full rate.3New Jersey Division of Taxation. Urban Enterprise Zone

Where the Zones Are

New Jersey currently designates 37 municipalities as Urban Enterprise Zones:4Urban Enterprise Zone Authority. UEZ Locations

  • Asbury Park, Bayonne, Bridgeton, Camden, Carteret, East Orange, Elizabeth, Gloucester City, Guttenberg
  • Hillside, Irvington, Jersey City, Kearny, Lakewood, Long Branch, Millville, Mount Holly
  • Newark, New Brunswick, North Bergen, North Wildwood, Orange, Passaic, Paterson, Pemberton Township
  • Perth Amboy, Phillipsburg, Plainfield, Pleasantville, Roselle, Trenton, Union City, Vineland
  • West New York, West Wildwood, Wildwood City, Wildwood Crest

The designation covers specific geographic areas within each municipality, not the entire town. A storefront on one block of Newark or Camden may be inside the zone while one a few streets away is not, so the municipal name alone does not confirm UEZ status.

Some areas next to established zones are classified as UEZ-impacted business districts. Qualified businesses in those districts receive the same 50% sales tax reduction, though they are not eligible for the program’s other benefits.5Justia. How to Tell Whether a Vendor Can Legally Charge 3.3125%

Only businesses holding a valid UZ-2 certificate from the Division of Revenue and Enterprise Services may collect sales tax at the reduced rate.6New Jersey Division of Taxation. Urban Enterprise Zone Tax Certificates A business that charges 3.3125% without that certificate is personally liable for the uncollected half of the tax, plus interest and penalties. If a receipt shows the reduced rate but you want to confirm it, the vendor should be able to produce a UZ-2 on request.

If You Run a Business Inside a Zone

To charge the reduced rate, you have to be certified first. Eligibility is defined in N.J.S.A. 52:27H-62: the business must be authorized to operate in New Jersey, actively conducting business at a location within the zone, and current on state tax obligations.7Justia. New Jersey Code 52-27H-62 – Definitions Businesses established after the zone’s original designation also have to meet workforce requirements tied to zone residency, prior unemployment or public assistance, or federal low-income criteria.

Applications are filed through a New Jersey Premier Business Services account by selecting the Urban Enterprise Zone service and completing the UEZ Certification Application.8Urban Enterprise Zone Authority.
