New Jersey’s vape tax has two rates. Liquid nicotine is taxed at $0.30 per fluid milliliter at the wholesale level, and bottled container e-liquid is taxed at 30% of the listed retail price when sold to a consumer.1New Jersey Division of Taxation. Division of Taxation, Tobacco and Vapor Products Tax Both rates tripled in 2025 under P.L. 2025, c.068, so any business still calculating at $0.10 per milliliter or 10% is undercharging.2New Jersey Legislature. P.L. 2025, c.068 New Jersey’s standard 6.625% sales tax sits on top of both.
The Two Rates and Who Pays Them
Which rate applies depends on how the product is packaged, not what’s in it.
Liquid Nicotine at $0.30 per Milliliter
Distributors and wholesalers owe $0.30 for every fluid milliliter of liquid nicotine they sell, use, or distribute in New Jersey, measured by the manufacturer’s listed volume with fractional milliliters taxed proportionally.2New Jersey Legislature. P.L. 2025, c.068 This category covers prefilled pods and cartridges sold as part of, or for direct use with, a closed-system device.
A compensating use tax at the same $0.30 rate applies when a distributor or wholesaler sells liquid nicotine at retail or uses it internally.2New Jersey Legislature. P.L. 2025, c.068 If neither the wholesale tax nor the use tax has been paid up the chain, the retail dealer or consumer becomes liable.
Container E-Liquid at 30% of Retail
Standalone bottles of e-liquid sold for use in refillable devices are taxed at 30% of the listed retail sale price.3New Jersey Division of Taxation. Tax Increase on Cigarette, Tobacco, and Vapor Products The retailer collects it from the customer at the point of sale and is personally liable for remitting it.4New Jersey Legislature. Sales Tax Is Separate
Vapor products are tangible personal property, so New Jersey’s 6.625% sales tax applies in addition to the product-specific tax. A customer buying a bottle of e-liquid pays the 30% container e-liquid tax plus 6.625% sales tax on the same transaction, and the retailer itemizes and remits each separately.
Container E-Liquid vs. Liquid Nicotine: Where Shops Get It Wrong
This is the single most common compliance mistake, and the Division of Taxation treats a misclassified product as a deficiency.
“Liquid nicotine” is the broad category: any nicotine solution designed or sold for use with an electronic smoking device. “Container e-liquid” is a narrower subset — a container of liquid marketed for use in a vaping device, but specifically excluding prefilled cartridges or pods that are sold as part of the device itself.5Justia Law. New Jersey Code 54:40B-2 – Definitions
In practice:
- Bottles of e-juice for refillable tanks and drippers are container e-liquid, taxed at 30% of retail.
- Prefilled pods and cartridges for closed-system devices are liquid nicotine, taxed at $0.30 per milliliter at wholesale.
A shop carrying both must track them on separate lines. If the two get mixed up, one product gets overtaxed and the other undertaxed, and the undertaxed side is what the state will come after.
The $50 Vapor Business License
Any business that sells container e-liquid at retail in New Jersey must hold a vapor business license from the Division of Taxation.6Justia Law. New Jersey Code 54:40B-3.3 – License, Vapor Business The license costs $50 per location and must be renewed annually; it lapses every March 31. A business with multiple storefronts needs a separate license for each one, even in the same building.
The license must be displayed at the location where container e-liquid is sold. A move to a new address triggers a 30-day window to notify the Division.6Justia Law. New Jersey Code 54:40B-3.3 – License, Vapor Business Licenses are not transferable; if the owner dies, goes bankrupt, or otherwise loses control of the business, the Division may extend the license to a successor for a limited time at its discretion.
Selling container e-liquid without a valid license, or during suspension or revocation, violates the Tobacco and Vapor Products Tax Act. The Division can suspend or revoke after a hearing for any violation of the Act or if the licensee stops operating in the capacity the license was issued for.6Justia Law. New Jersey Code 54:40B-3.3 – License, Vapor Business
Registering the Business
Before any sales, the business registers with the New Jersey Division of Revenue and Enterprise Services by filing Form NJ-REG, the state’s Business Registration Application.7New Jersey Division of Taxation. NJ Division of Taxation – Starting a Business in NJ That form covers the Sales Tax Certificate of Authority and other applicable tax obligations. Corporations, LLCs, and partnerships need a federal Employer Identification Number from the IRS first.8Division of Revenue and Enterprise Services. Division of Revenue and Enterprise Services – Getting Registered
After NJ-REG, retailers selling container e-liquid separately apply for the $50 vapor business license. Distributors and wholesalers of liquid nicotine have their own registration obligations under the Tobacco and Vapor Products Tax Act. Both pieces need to be in place before the first sale.
Filing Returns
Registered vapor product businesses file the Vapor Business Tax Return (Form VB-100) with the Division of Taxation.9New Jersey Division of Taxation. Tobacco and Vapor Products Tax Forms Distributors and wholesalers subject to the liquid nicotine tax also use the tobacco products tax forms and schedules on the Division’s site. Payments go through the Division’s online filing system. Save every confirmation receipt.
Keep invoices, purchase records, inventory counts, and copies of filed returns for at least four years. That is the window in which New Jersey can audit, and producing clean records on demand is the fastest way to close an inquiry.
The 2025 Floor Tax on Existing Inventory
When New Jersey raises vapor product tax rates, businesses holding inventory at the time of the change owe the difference. Distributors, wholesalers, and retail dealers take a physical inventory count, calculate the additional tax at the new rate, and file a floor stocks tax return.10State of New Jersey Department of the Treasury. Tobacco and Nicotine Products Wholesale Sales and Use Tax Notice With rates tripling in 2025, any business that held liquid nicotine or container e-liquid when the increase took effect should have already filed and paid. The Division treats an unpaid floor tax the same as any other deficiency.
Penalties for Late Filing or Nonpayment
New Jersey’s late filing penalty is 5% of the tax due for each month or partial month a return is late, capped at 25% of the balance.11New Jersey Division of Taxation. NJ Division of Taxation – When to File and Pay Interest accrues from the original due date. These apply to vapor product returns the same as other state tax filings.
The bigger exposure is the license itself. The Division can suspend or revoke a vapor business license for any violation of the Tobacco and Vapor Products Tax Act.6Justia Law. New Jersey Code 54:40B-3.3 – License, Vapor Business A revoked license means no legal container e-liquid sales anywhere, and reinstatement is far harder than staying current.
Other Rules That Limit What You Can Sell
Tax compliance is not enough on its own. Three other rules decide what a New Jersey vape business can legally stock and sell.
Flavor ban. New Jersey permanently banned the sale and distribution of flavored vape products, including menthol and mint.12New Jersey Department of Health. Vaping Information A retailer caught selling flavored vapor products faces license revocation on top of other penalties. FDA marketing authorization for a flavored product does not override the state ban.
Age 21. The minimum purchase age in New Jersey is 21.13New Jersey Department of Health. Department of Health – Tobacco Control – Prevention Verify with a valid government-issued photo ID on every transaction. A sale to anyone under 21 risks the license, not just a fine.
Shipping and federal authorization. USPS effectively banned mailing vapor products to consumers in October 2021, with narrow exceptions for approved business-to-business shipments and consumers in Alaska and Hawaii. Private carriers have adopted their own restrictions. Separately, every e-cigarette product sold in the United States must have FDA marketing authorization, typically through a premarket tobacco application.14U.S. Food and Drug Administration. Tobacco Products Marketing Orders Only a small number of products have received that authorization. Stocking unauthorized products creates both federal enforcement risk and state license risk.
