North Carolina Amended Return: Forms, Deadlines, and Penalties

To amend a North Carolina tax return, file a new Form D-400 with the “Amended Return” circle filled in at the top, attach a completed Schedule AM explaining every change, include any supporting documents, and send the package to the North Carolina Department of Revenue (NCDOR) either through an approved e-file vendor or by mail. The older Form D-400X is no longer used.1North Carolina Department of Revenue. When, Where and How to File Your Amended Individual Income Tax Return You need a separate amended return for each tax year you’re correcting.

When You Have to Amend, and When It’s Optional

The NCDOR requires an amended return in four situations: you discovered an error or received new information after filing, you need to report a North Carolina net operating loss, the IRS changed your federal return, or you voluntarily filed a federal amendment that increases your North Carolina tax.2North Carolina Department of Revenue. 2025 Individual Income Tax Instructions

If a federal change would decrease your state tax, amending is optional. It’s also the only way to get that money back, so most people in that position file anyway.

How Long You Have to File

For a refund, the deadline is the later of three years after the original return’s due date or two years after you paid the tax. If you rely on the two-year window, your refund cannot exceed what you actually paid during those two years.3North Carolina General Assembly. North Carolina Code 105-241.6 – Statute of Limitations for Refunds For most people who filed and paid on time, the three-year window controls. A 2025 return due April 15, 2026, has to be amended by April 15, 2029.

A much shorter deadline applies when a federal change is what triggered the amendment. That six-month rule is covered below.

Putting the Amended Return Together

Form D-400

Start with a fresh Form D-400. Fill in the “Amended Return” circle at the top right, then enter the corrected amounts on Lines 1 through 21.1North Carolina Department of Revenue. When, Where and How to File Your Amended Individual Income Tax Return The corrected figures replace what you originally reported. Use black or blue ink on paper.

Schedule AM

Attach Schedule AM to the front of the D-400. On it, you identify yourself, check the box for the reason you’re amending, and write a detailed explanation of each change. Vague descriptions slow processing. If a corrected W-2 raised your wages by $3,000, say exactly that rather than writing “income adjustment.”2North Carolina Department of Revenue. 2025 Individual Income Tax Instructions

Schedule AM also reconciles what you previously paid and any overpayment from the original return against the new numbers. Follow the instructions on the form itself for Lines 22 and 24, and use NCDOR-adjusted figures if the department previously changed your original overpayment.2North Carolina Department of Revenue. 2025 Individual Income Tax Instructions

Schedules That Have to Come Along

If you filed Schedule S, Schedule A, Schedule PN, Schedule PN-1, or Form D-400TC with the original return, include them with the amendment even if nothing on them changed. This trips people up. An unchanged schedule left out of the package can get the whole thing treated as incomplete.2North Carolina Department of Revenue. 2025 Individual Income Tax Instructions

Supporting Documents

Attach documentation for the specific changes you’re making. The NCDOR calls out several categories:1North Carolina Department of Revenue. When, Where and How to File Your Amended Individual Income Tax Return

  • A copy of Form 1040-X and supporting federal schedules, if you also amended federally.
  • A copy of the IRS audit report or determination letter, if the IRS initiated the change.
  • W-2 and 1099 statements, if withholding changed.
  • NC K-1 forms, if pass-through entity payments are involved.
  • Form NC-NOL along with Federal Form 1040-X or Form 1045 (including Schedules A and B), if the amendment involves a North Carolina net operating loss.2North Carolina Department of Revenue. 2025 Individual Income Tax Instructions

Assemble the complete package before you submit anything. The NCDOR won’t process an amendment that lacks substantiating documents.

Submitting the Return and Paying

The NCDOR accepts amended returns electronically through approved e-file vendors, which can file current, amended, and prior-year returns for up to two years before the current tax year.4North Carolina Department of Revenue. eFile for Individuals Not every software product supports North Carolina amended e-filing, so check with your provider first.

If you file on paper, mail the package to:

Penalties and Interest

North Carolina imposes a flat 5% failure-to-pay penalty on any tax not paid when due, but that penalty does not apply to additional tax shown on an amended return as long as you pay the full amount when you file.6North Carolina General Assembly. North Carolina Code 105-236 – Penalties; Situs of Violations That’s a strong reason to include payment with the amendment rather than file first and pay later.

When a required amended return isn’t filed on time, the failure-to-file penalty is 5% of the tax owed for the first month plus 5% for each additional month or partial month, capped at 25%.6North Carolina General Assembly. North Carolina Code 105-236 – Penalties; Situs of Violations This matters most when a federal change requires an amendment and you miss the six-month window.

Interest accrues on any unpaid balance from the original due date of the return, not from the date you file the amendment. The NCDOR sets the rate semiannually, and it stands at 7% per year for January 1 through June 30, 2026.7North Carolina Department of Revenue. Interest Rate By statute the rate cannot fall below 5% or exceed 16%.8North Carolina Department of Revenue. Interest Overview

Interest can also run in your favor. If the NCDOR owes you a refund on an amended return, interest starts accruing 45 days after the latest of your filing date, the original due date (ignoring extensions), or the date of the overpayment.8North Carolina Department of Revenue. Interest Overview

If a Federal Change Is What Triggered the Amendment

When the IRS changes your federal adjusted gross income, filing status, deductions, or credits, and that change affects your North Carolina tax, you have six months from the date you’re notified to file an amended state return. Missing the deadline exposes you to penalties and forfeits your right to any state refund the federal change might have produced.9North Carolina General Assembly. North Carolina Code 105-159 – Federal Determinations and Amended Returns That forfeiture is what makes this deadline sharp. Even when the federal change puts money back in your pocket, you lose the matching state refund entirely if you’re late. Attach the federal audit report or IRS determination letter as support.

The same six-month clock applies if you voluntarily filed a federal 1040-X and the changes increase your North Carolina tax. If the federal amendment instead decreases your state tax, filing is optional and runs on the standard refund deadlines described above.9North Carolina General Assembly. How Long the Refund Takes

Expect to wait up to six months from the date you file to receive a refund on an amended return.10North Carolina Department of Revenue. The Refund Process That’s much longer than a typical original return, and paper filings during peak season can run longer still.

If more than five months have passed with no refund, call the NCDOR at 1-877-252-3052 and select the Individual Income Tax option, then the Refund option, to speak with an agent.10North Carolina Department of Revenue. The Refund Process Calling earlier usually won’t get you more information since the return is still working through processing.

One Federal Side Effect to Check

If your North Carolina amendment changes how much state income tax you paid or owed, and you itemized on your federal return, your federal state and local tax deduction may no longer be accurate. A state refund produced by an amended return can also be taxable federal income the following year under the tax-benefit rule. The IRS notes that a change on a state return may affect federal liability and directs taxpayers to the state agency for state-specific guidance.11Internal Revenue Service.
