North Carolina new hire reporting is the legal obligation every employer in the state has to send basic information about each newly hired or rehired employee to the NC New Hire Directory within 20 days of that worker’s first paid day. The data feeds the state’s child support enforcement system and also helps flag fraud in unemployment and workers’ compensation claims.
Which Employers Have to Report
If you withhold federal income tax from anyone’s wages in North Carolina, you are an employer for this purpose. The statute uses the IRS definition under Internal Revenue Code section 3401(d), so there is no size threshold. A sole proprietor making a first hire has the same duty as a national chain. Government agencies and labor organizations are covered too.1North Carolina General Assembly. Which Workers You Report
Report every employee who fills out a W-4 when hired. That means full-time, part-time, and temporary workers alike. You also have to file a fresh report for a rehire if the person is coming back after being laid off, furloughed, separated, or terminated for at least 60 consecutive days.2North Carolina New Hire Directory. Independent contractors are not reportable under North Carolina law. The state does not require new hire reports for 1099 workers.2North Carolina New Hire Directory. What Information the Report Must Contain
For each new hire you need:
- Full legal name
- Residential address
- Social Security number
- Date the employee first performed services for pay
You also need your own company name, address, Federal Employer Identification Number (FEIN), and North Carolina state employer identification number.1North Carolina General Assembly. North Carolina Code 110-129.2 – State Directory of New Hires Established; Employers Required to Report; Civil Penalties for Noncompliance; Definitions
Because almost all of this comes straight off the W-4, the statute lets you simply submit a copy of the W-4 itself. If you do, write your company name, FEIN, and address at the top of each form, and add the hire date in any available blank space.3North Carolina New Hire Directory. Reporting Fundamentals – North Carolina New Hire Directory An equivalent form of your own design works too, provided it captures every required field. Verify your FEIN and state employer ID against your most recent tax filings before submitting; mismatched identifiers cause processing delays.
The 20-Day Deadline
You have 20 days from the employee’s first day of paid work to file the report. The clock starts on the day the person first performs services for pay, not the day you process their paperwork, and the same 20-day window applies to rehires.
If you submit electronically or magnetically, you have a second option: file twice per month, with each batch spaced no fewer than 12 and no more than 16 days apart.1North Carolina General Assembly. North Carolina Code 110-129.2 – State Directory of New Hires Established; Employers Required to Report; Civil Penalties for Noncompliance; Definitions The spacing rule is strict. A batch filed outside the 12-to-16-day window does not satisfy the requirement.
How to Submit
Reports go to the NC New Hire Directory, which the Department of Health and Human Services operates. You have three channels:
- Online at ncnewhires.ncdhhs.gov, where you can enter data manually or upload a file and keep the electronic confirmation as proof of compliance.4North Carolina New Hire Directory. North Carolina New Hire Directory

The Massachusetts mailing address is correct; North Carolina uses an external processing center for intake, and the data still lands in the state directory.
Remote and Multistate Hires
Under federal rules, you report a new hire to the state where the employee works, not where your business is based.6Administration for Children and Families. New Hire Reporting A remote worker who lives and works in North Carolina gets reported to the NC New Hire Directory even if your office sits across a state line.
If you have employees in more than one state, you can register as a multistate employer with the U.S. Department of Health and Human Services and pick a single state to receive all your reports. You have to transmit reports electronically and have at least one employee in the state you designate. Registration is through the OCSE Child Support Portal at ocsp.acf.hhs.gov or by emailing the federal registration form.7U.S. Department of Health and Human Services. Penalties for Missing a Report
A district court can impose a civil penalty of up to $25 for each new hire you fail to report. If the court finds you and the employee conspired to avoid reporting, say to duck a child support withholding order, or to file a false report, the ceiling jumps to $500 per unreported person. Penalty money goes to the state’s General Fund.1North Carolina General Assembly. Twenty-five dollars a head sounds small, but it compounds fast for employers who onboard in batches or skip filings as a habit, and the conspiracy tier carries real weight when a court finds intent.
