North Carolina Non-Resident Income Tax: Rates, Filing, and Deadlines

If you live outside North Carolina but earn money inside it, you owe North Carolina income tax on that specific income at a flat rate of 3.99% for the 2026 tax year. The North Carolina non-resident income tax applies to wages for work physically performed in the state, rental and sale income from North Carolina property, business or self-employment income sourced there, and gambling winnings from North Carolina. You file using Form D-400 and Schedule PN once your total gross income from all sources crosses the state’s standard deduction for your filing status.

Who the State Treats as a Non-Resident

North Carolina defines a non-resident as someone who is not a resident of the state at any point during the tax year.1North Carolina General Assembly. North Carolina Code 105-153.3 – Definitions A resident, in turn, is someone domiciled in North Carolina or living there for more than a temporary purpose. Spend more than 183 days in the state and you are presumed a resident, though that presumption can be rebutted.

Domicile is your permanent legal home, measured by things like where you vote, where your driver’s license is issued, and where your primary residence sits. If your permanent base is elsewhere and you have no intention of making North Carolina your long-term home, you are a non-resident. If you moved into or out of the state during the year, you are a part-year resident instead; part-year residents use the same supplemental form as non-residents but follow different allocation rules.

What Income North Carolina Can Tax

The state only reaches income with a North Carolina source. Three categories count:2North Carolina General Assembly. North Carolina Code 105-153.4 – North Carolina Taxable Income Defined

  • Wages, salary, or self-employment earnings from work you physically perform in North Carolina, including income from a partnership, sole proprietorship, or S-corporation operating there.
  • Rental income, gains from selling North Carolina real estate, and income tied to tangible personal property located in the state.
  • Gambling winnings from activities in North Carolina, including lottery prizes and casino winnings.

Remote work is the common trap. The test is where you physically perform the work, not where your employer is headquartered. If you live in Virginia and drive to a Charlotte office three days a week, those three days of wages are North Carolina source income. Employers paying wages for work performed in the state are required to withhold North Carolina tax from non-resident employees, and the North Carolina Lottery Commission withholds state tax on prizes of $600 or more.3North Carolina Department of Revenue. One narrow exception: income earned by entering the state solely to perform disaster-related work during a declared disaster response period, at the request of a critical infrastructure company, is not treated as North Carolina source income.4North Carolina General Assembly. The Rate and How the Calculation Works

North Carolina has a flat income tax. For 2026, the rate is 3.99%, down from 4.5% in 2024, so make sure any software or preparer is using the current figure.5North Carolina Department of Revenue. Tax Rate Schedules

The non-resident calculation is a proration. You start with your total adjusted gross income (with certain North Carolina modifications), then apply the ratio of your North Carolina source income to your total income from all sources.2North Carolina General Assembly. North Carolina Code 105-153.4 – North Carolina Taxable Income Defined That ratio is also what prorates the standard deduction, so you get a proportional benefit rather than the full amount. The 3.99% rate then applies to your North Carolina taxable income.

When You Have to File

You must file a North Carolina return if both of these are true: you received income from North Carolina sources during the year, and your total gross income from all sources exceeds the North Carolina standard deduction for your filing status.4North Carolina General Assembly. North Carolina Code 105-153.8 – Income Tax Returns Standard deduction amounts are set by statute and vary by filing status; current figures are posted by the Department of Revenue.6North Carolina General Assembly. North Carolina Code 105-153.5 – Modifications to Adjusted Gross Income

The second prong catches people. The threshold looks at your worldwide gross income, not just the North Carolina slice. If you earned $80,000 at your home-state job and $3,000 on a weekend consulting trip to Raleigh, the $80,000 pushes you over the line and you have to file in North Carolina on the $3,000. Even when the proration leaves you owing nothing, the return itself is still required, and skipping it exposes you to penalties.

Forms and How to File

Non-residents file Form D-400, the North Carolina Individual Income Tax Return, together with Schedule PN, the Part-Year Resident and Nonresident Schedule. Schedule PN is where the allocation happens: you list your total federal income line by line alongside the portion earned in North Carolina, and the form derives the ratio applied to your tax.7North Carolina Department of Revenue. Individual Income Tax Forms and Instructions Have your federal Form 1040, every W-2, and any 1099 showing North Carolina income in front of you before you start. Misallocating income between states is one of the quickest ways to draw a notice from the Department of Revenue.

You can file electronically through the state’s eFile system using approved commercial software, which gives faster confirmation and refund processing.8North Carolina Department of Revenue. eFile for Individuals If you file on paper, the mailing address depends on whether you owe. Quarterly Estimated Payments

If you expect to owe $1,000 or more in North Carolina tax after withholding and credits, you have to pay in quarterly.10North Carolina Department of Revenue. Estimated Income Tax This hits non-residents with self-employment income, rental income, or business income from North Carolina sources, where no one is withholding on their behalf.

For the 2026 tax year, estimated payments are due April 15, June 15, and September 15 of 2026, and January 15, 2027.11North Carolina Department of Revenue. Deadline, Extension, and Penalties

The 2026 return is due April 15, 2026. Paper returns must be postmarked by that date.13North Carolina Department of Revenue. NCDOR Urges Taxpayers to File by April 15 Deadline If you need more time, file Form D-410 by April 15 for an automatic extension.14North Carolina Department of Revenue. D-410 Information An extension to file is not an extension to pay. Interest starts running on any unpaid balance from April 15, extension or not.

Filing late carries a failure-to-file penalty of 5% of the net tax due for each month or part of a month the return is late, capped at 25%.15North Carolina Department of Revenue. Penalties and Fees Overview If you have a valid extension, the clock on that penalty runs from the extended due date instead. Unpaid balances also accrue interest at the Department’s current rate.12North Carolina Department of Revenue. Interest Rate If you cannot pay in full, still file on time. The filing penalty is the expensive one.

Avoiding Double Tax With Your Home State

North Carolina has no reciprocity agreements with neighboring states, so earning there always means a North Carolina return. Relief from double taxation usually comes from your home state, which typically allows a credit for taxes paid to another state. If you live in South Carolina and pay North Carolina tax on Charlotte wages, South Carolina generally lets you offset your South Carolina liability by the North Carolina amount. The credit is claimed on your resident return, not on the North Carolina return. North Carolina offers a similar credit, but only to its own residents, not to non-residents filing in the state.16North Carolina Department of Revenue. Retirement Income From a Former North Carolina Employer

If you are drawing retirement income from a former North Carolina employer and you now live elsewhere, North Carolina cannot tax those payments. Federal law bars states from taxing the retirement income of non-residents.17Office of the Law Revision Counsel. 4 USC 114 – Restriction on Taxation of Certain Pension Income The protection covers 401(k) distributions, traditional and Roth IRAs, 403(b) plans, 457 deferred compensation plans, government pensions, SEP-IRAs, and military retired pay. Once you establish domicile in another state, the pension checks are your new state’s business, not North Carolina’s.

Military Spouse Exemption

If your spouse is an active-duty servicemember stationed in North Carolina, your wages earned there can be fully exempt from North Carolina tax under the Servicemembers Civil Relief Act, as amended by the Veterans Benefits and Transition Act of 2018. The exemption applies when all three of these are true:18North Carolina Department of Revenue. Important Tax Information Regarding Spouses of United States Military Servicemembers

  • The servicemember is in North Carolina on military orders.
  • You are in the state solely to be with the servicemember.
  • You are domiciled in the same state as the servicemember, or you elect to use the servicemember’s state of legal residence for tax purposes.

The 2018 amendment lets you elect your spouse’s legal residence even if you were never personally domiciled there. If the servicemember claims Texas, you can claim Texas, and your North Carolina wages are exempt from state tax. Marriage alone does not shift your domicile, so the election has to be made affirmatively.
