To file a Northport tax grievance, submit Form RP-524 to the Town of Huntington Assessor’s Office on or before the third Tuesday in May. Northport is a village inside the Town of Huntington, and the town assessor sets the valuation that drives your bill, so the challenge goes through Huntington rather than the village.1Town of Huntington. Grievance FAQs The tentative assessment roll comes out May 1, which gives you a short window to review your number and prepare your case.2Town of Huntington. Important Dates on the Assessment Calendar
Check Your Assessment Before You File
Pull the tentative roll as soon as it’s published on May 1. You can review your assessment at the Assessor’s Office in Room 100 of Huntington Town Hall, 100 Main Street, Huntington, NY 11743.1Town of Huntington. Grievance FAQs
Huntington, like most New York municipalities, does not assess at full market value. The state publishes an equalization rate showing what percentage of market value the assessor is actually using.3New York State Department of Taxation and Finance. Equalization Rates To translate your assessed value into what the town thinks your home is worth, divide the assessed value by the equalization rate expressed as a decimal. If your home is assessed at $4,000 and the equalization rate is 0.50, the assessor is valuing it at $8,000. If similar homes nearby have sold for $6,500, you have a case worth making.
Before filing anything, talk to the assessor. The New York State Department of Taxation and Finance recommends an informal conversation first, which often produces a useful exchange of information for both sides.4New York State Department of Taxation and Finance. Contest Your Assessment Sometimes the office has outdated details about your property, and a correction is all you need. If that doesn’t move the number, file the formal complaint. You have to go through the administrative process before you can take the matter to court.
The Four Grounds for Challenge
New York law recognizes four grounds, each targeting a different kind of error:5FindLaw. New York Code RPT 701 – Definitions
- Excessive assessment — the assessed value exceeds market value, or you were denied an exemption you qualified for.
- Unequal assessment — your property is assessed at a higher percentage of market value than other properties on the same roll.
- Unlawful assessment — the assessment itself shouldn’t be on the roll, for instance a property outside the taxing jurisdiction or a fully exempt property listed as taxable.
- Misclassification — the property sits in the wrong class, which changes the tax rate applied to it.
Most Northport homeowners file under excessive or unequal assessment. Pick the ground that fits before you fill out the form, because the evidence you need differs.
Build the Evidence
The Board of Assessment Review decides on evidence, not assertions. The strongest support is comparable sales: recent transactions involving homes similar to yours in size, age, condition, and location, where the sale price came in below the assessor’s implied market value for your home.6New York State Department of Taxation and Finance. Completing the Grievance Form
Your estimate of market value should reflect what the property was worth as of the valuation date, which in most municipalities is July 1 of the prior calendar year.6New York State Department of Taxation and Finance. Completing the Grievance Form Confirm the applicable date with the Huntington Assessor’s Office. A sale that closed close to the valuation date carries more weight than one from months later.
Other supporting evidence includes a recent appraisal from a licensed appraiser, your own purchase price if you bought the property near the valuation date, or a construction cost estimate for newly built homes. Submit organized documentation. The board moves through many files in a compressed period, and a clean package is easier to grant.
Filing Form RP-524
The formal complaint uses Form RP-524, “Complaint on Real Property Assessment.”7New York State Department of Taxation and Finance. Complaint on Real Property Assessment You can pick it up at the Assessor’s Office or download it from the state tax department. Complete every relevant section. Leaving parts blank can lead to dismissal and can block you from pursuing the matter in court later.8New York State Department of Taxation and Finance. General Information and Instructions for Filing Complaints on Real Property Assessments
The form asks for the tax map number, the current assessed value from the tentative roll, your estimate of market value, the legal ground you’re asserting, and the specific reduction you want. Put a real number on the request. The board needs a defined target.
The Grievance Day Deadline
In Suffolk County, Grievance Day is the third Tuesday in May.9New York State Department of Taxation and Finance. Grievance Procedures That’s earlier than most New York towns, where the deadline is the fourth Tuesday. An originally signed copy of Form RP-524 must reach the Huntington Assessor’s Office on or before that date. Faxed and emailed copies are not accepted.1Town of Huntington. Grievance FAQs
Miss Grievance Day and you almost always lose the right to challenge the assessment for that tax year. If you mail the form, use certified mail with return receipt requested and make sure it arrives on time. Hand delivery to Room 100 at Huntington Town Hall is the safest option.
Anyone who pays property taxes on the property can file, including the owner, a purchaser, or a tenant required to pay property taxes under a lease.9New York State Department of Taxation and Finance. Grievance Procedures You can also authorize a representative or attorney to file and appear for you.
The Board of Assessment Review Hearing
After Grievance Day, the Board of Assessment Review schedules hearings. The board is independent of the assessor and reviews your evidence against the assessor’s data on the property. You may be asked to appear and explain your case, though many decisions are made on the written submission alone.
The board mails a written decision, usually several weeks after hearings wrap up. If it reduces your assessed value, the lower figure goes onto the final assessment roll and your tax bill for the coming year is calculated from that number.
If the Board Denies Your Grievance
A denial can be appealed to court, and the clock is tight. Both judicial options require filing within 30 days of the filing of the final assessment roll or the published notice of that filing, whichever is later.10New York State Department of Taxation and Finance. Small Claims Assessment Review
SCAR is the low-cost route for homeowners. To qualify, you must own and live in a one-, two-, or three-family home used exclusively as a residence.9New York State Department of Taxation and Finance. Grievance Procedures The filing fee is $30. In Suffolk County, SCAR petitions are filed in Suffolk County Supreme Court through the state’s electronic filing system, though self-represented homeowners may file on paper.11Suffolk County. File a Small Claims Assessment Review Petition After filing, you must serve copies on the clerk of the assessing unit, the assessor, the school district clerk, and the Suffolk County Comptroller within 10 days.
One trap worth knowing: if your property’s equalized value exceeds $450,000, the total reduction you can request through SCAR is capped at 25 percent of the assessed value.11Suffolk County. File a Small Claims Assessment Review Petition
Article 7 Tax Certiorari
Commercial owners and others who don’t qualify for SCAR file an Article 7 proceeding in New York State Supreme Court. It’s a full judicial review, usually handled by an attorney, with discovery and expert testimony, and it takes considerably longer than SCAR. The same 30-day filing deadline applies.10New York State Department of Taxation and Finance. Understanding Real Property Tax Assessment Review Proceedings in New York State
After a Successful Grievance
A reduction applies to the current assessment year. The assessor prepares a new tentative roll every year, and your property can be reassessed higher next time, which would require a new grievance. Checking the May 1 roll each year is a few minutes well spent.
If you escrow your taxes through a mortgage, the reduction reaches your monthly payment through your lender’s annual escrow analysis, not immediately.12Consumer Financial Protection Bureau. Escrow Accounts When that analysis shows a surplus because your taxes dropped, federal rules require the lender to refund any surplus of $50 or more within 30 days of the analysis.13eCFR. 12 CFR 1024.17 – Escrow Accounts The monthly escrow portion should drop to match the lower tax amount from that point forward. If the next analysis cycle passes without an adjustment, call your lender and ask them to recalculate.
