NY Penal Law 405.00: Permits, Bond, and Certified Pyrotechnicians

A public fireworks show in New York is legal only with a permit issued under New York Penal Law 405.00. To get that permit for a fireworks display, you file a written application with the authority that controls the site, hire pyrotechnicians who hold a valid state certificate of competence to fire the show, and post a bond or insurance policy of at least $1,000,000. The application has to be in at least five days before the display date.1New York State Senate. New York Penal Law 405.00 – Permits for Public Displays of Fireworks

Where to Apply

The permitting body depends on where the display will happen, not where the sponsoring organization is based. On state property, the Office of Fire Prevention and Control issues the permit. For a county park, it’s the county park commission or the agency that runs the park. In a city, it’s the local licensing agency, or an officer designated by the city’s legislative body if no such agency exists. Villages designate a permit officer through the board of trustees, and towns do the same through the town board for unincorporated areas outside villages.1New York State Senate. Because authority is split this way, there is no single statewide form. Contact the specific permit authority for your site early to get its paperwork and to learn about any local requirements layered on top of the statute.

What Goes in the Application

Section 405.00(2) lists what the written application must contain:1New York State Senate. New York Penal Law 405.00 – Permits for Public Displays of Fireworks

  • The name of the sponsoring organization, and the names and certificate numbers of every person who will fire the show.
  • The date, time of day, and exact location of the display.
  • The number and type of each firework to be discharged.
  • How and where the fireworks will be stored before the display.
  • A diagram of the grounds showing the firing point, nearby buildings, roads, overhead lines, trees, and the lines behind which the audience will be kept.
  • Any additional information the permit authority considers necessary to protect people and property.

The site diagram is where applications most often stumble. Reviewers use it to confirm the firing point is far enough from structures, roads, and spectator lines to contain a worst-case malfunction, and to check for overhead obstructions like power lines or tree canopy. The fireworks inventory has to line up with the site so officials can see that the space actually accommodates the shell sizes you want to fire.

The $1,000,000 Bond or Insurance Minimum

Before the permit issues, the applicant has to post a bond or an equivalent insurance policy of at least $1,000,000. The permit authority can require more but not less. The state, counties, cities, villages, and towns are exempt when they sponsor their own displays.1New York State Senate. New York Penal Law 405.00 – Permits for Public Displays of Fireworks

The bond runs to the governmental entity that issued the permit, for the benefit of anyone injured or whose property is damaged. Injured parties can sue directly on it. Most applicants meet the requirement through commercial general liability insurance arranged through the fireworks vendor rather than a surety bond. Whichever form it takes, the coverage has to reach acts of the permit holder, its agents, employees, contractors, and subcontractors.

Filing Deadline and Validity

The application has to reach the permit authority at least five days before the display date.1New York State Senate. New York Penal Law 405.00 – Permits for Public Displays of Fireworks Five days is a floor, not a cushion. If the reviewer has questions about the diagram or wants more documentation, that window closes fast, so file earlier.

Once granted, the issuing authority forwards a copy to the state Office of Fire Prevention and Control. The permit is valid only for the date, time, and location described in the application. Any change to those details means a new or amended permit.

Certified Pyrotechnicians Have to Fire the Show

The statute doesn’t just call for a “competent” person. Every individual who will fire the display must hold a valid certificate of competence as a pyrotechnician issued under the General Business Law and Article 16 of the Labor Law, and the application has to include a verified statement with each operator’s name and certificate number.1New York State Senate. The New York Department of Labor administers the certificate program. Certificates come in three classes, and it matters which one your operator carries:2New York State Department of Labor. Application for a Pyrotechnician’s Certificate of Competence

  • Class A covers both proximate-audience shows (such as stage special effects) and non-proximate shows (traditional outdoor fireworks).
  • Class B covers non-proximate shows only.
  • Class C covers proximate-audience shows only.

Match the class to your event. A hired operator with a Class B certificate cannot legally fire indoor stage pyrotechnics, and a Class C holder cannot fire an outdoor aerial show.

Assistants who help the certified operator on site do not need their own certificate, but they must be at least 18, trained in the tasks they’ll perform, and informed of the safety hazards. The lead operator is responsible for their conduct.3New York State Department of Labor. Regulations for Pyrotechnics Permits

Safety Distances That Shape the Site

New York’s Fire Code requires storage and displays to comply with NFPA 1123 for outdoor shows or NFPA 1126 for proximate-audience shows. Minimum separation between the firing point and the audience scales with shell size. For vertical mortars under NFPA 1123:

  • 3-inch shell: 210 feet
  • 4-inch shell: 280 feet
  • 5-inch shell: 350 feet
  • 6-inch shell: 420 feet
  • 8-inch shell: 560 feet
  • 10-inch shell: 700 feet
  • 12-inch shell: 840 feet

A small park may safely accommodate 3-inch shells and no more. Angled mortars, salute shells, and ground-level effects carry their own, sometimes stricter, distance rules. Build the site diagram and the shell inventory together so they match.

Federal Requirements That Sit on Top

A state permit and certified operator are not the whole picture. The Bureau of Alcohol, Tobacco, Firearms and Explosives classifies display fireworks as explosive materials, and anyone who imports, manufactures, deals in, receives, or transports them needs a federal explosives license or permit first.4Bureau of Alcohol, Tobacco, Firearms and Explosives. Fireworks Dealers need a dealer’s license; a display company that only buys and uses fireworks needs either a user permit (for interstate transactions or more than six acquisitions in a year) or a limited permit (for six or fewer in-state acquisitions in a 12-month period).5eCFR. 27 CFR Part 555 Subpart D – Licenses and Permits Every employee who handles the materials must pass an ATF background check.6ATF Regulations. 27 CFR 555.33 – Background Checks and Clearances

For most sponsoring organizations, the federal side is handled by the fireworks vendor. Confirm that with your vendor in writing before the event.

Penalties for Firing Without a Permit

Penal Law 270.00 covers the consequences of stepping outside the framework:7New York State Senate. New York Penal Law 270.00 – Unlawfully Dealing With Fireworks and Dangerous Fireworks

  • Selling or furnishing fireworks worth less than $500 is a class B misdemeanor, carrying up to three months in jail and a fine of up to $500.8New York State Senate. New York Penal Law 80.05 – Fines for Misdemeanors
  • Selling or furnishing fireworks worth $500 or more is a class A misdemeanor.
  • Possessing, using, or detonating fireworks without a permit is a violation.
  • Selling fireworks or sparkling devices to anyone under 18 is prohibited regardless of value.

Running a display without the permit also strips away the bond-and-insurance backstop, leaving the operator personally exposed to any injury or property damage claim, and the fireworks themselves can be seized and destroyed under Penal Law 405.05.
