NYC Birth Certificate Correction: Eligibility, Evidence, and Fees

To fix an error on a New York City birth certificate, you file a correction application with the NYC Department of Health and Mental Hygiene’s Office of Vital Records. Most corrections cost $40, take about 12 weeks, and can be submitted by mail or in person. Some changes only need paperwork and supporting documents; others require a court order before the Health Department will act. Who Can File the Application

If you are the person named on the certificate and at least 18, you can apply yourself. For anyone under 18, a parent or legal guardian files on their behalf, and guardians must attach the original court-issued guardianship order.2NYC Health Code. One requirement catches many families off guard. If both parents are named on the certificate and the child is under 18, both parents must sign the application and submit copies of their photo ID, even if they are separated or divorced. What Kind of Correction Are You Making

The path depends on what you’re changing. Some corrections are administrative; others require a certified court order that you then bring to the Health Department.

Fixing a Child’s First or Middle Name

Adding or correcting a first or middle name is administrative. You need one document showing the correct name alongside the date of birth: an immunization record, school letter, religious institution record, or physician’s letter. Changing a Name to Something Entirely New

A true name change, rather than a typo fix, is a legal name change. You need a certified court order from Civil Court if you live in NYC, or the equivalent court where you live. Correcting a Last Name

To match a child’s last name to a parent’s actual surname, you can use the parent’s birth certificate, passport, marriage certificate (if the parents married before the child was born), naturalization certificate, or an older sibling’s birth certificate. Correcting a Parent’s Information

If a parent’s name, date, or place of birth was recorded wrong, you can fix it with the parent’s original birth certificate, marriage record, naturalization certificate, a religious institution document, or a sibling’s birth certificate. Adding a Second Parent

How you add a parent depends on the birth parent’s marital status around the pregnancy. If the birth parent was married to the biological father or second parent during the pregnancy, you complete the relevant section of the standard correction application.3New York City Department of Health and Mental Hygiene. If the birth parent was not married during pregnancy but later married the biological father or second parent, you can either complete an Acknowledgment of Parentage form or obtain an Order of Filiation from Family Court. If the birth parent married someone other than the biological father after the birth, you need an Order of Adoption from Family or Supreme Court.4NYC Health. Changing the Gender Marker

NYC lets you change the gender marker to male, female, or X through self-attestation. No medical documentation or provider letter is needed. You attest under penalty of perjury that the change reflects your true gender identity, using form VR 218. Unlike the standard correction form, the attestation page must be notarized. If you’re also changing your name, include a certified legal name change court order. Removing a Doctor’s or Midwife’s Name

Removing the attending physician or midwife from the certificate almost always requires a State Supreme Court order. Two narrow exceptions: the hospital confirms in writing that it made an error and the child is 12 months old or younger, or the provider’s medical license has been surrendered or revoked.4NYC Health. Supporting Documents and What Counts as Evidence

The Health Department will not approve a correction unless the evidence shows the “true facts” and that an error was made when the certificate was filed.2NYC Health Code. For older records, supporting documents generally must be at least 10 years old or have been created before the child’s seventh birthday. A recent school letter or medical record will not satisfy this. Bring originals. The Health Department does not accept photocopies or notarized copies of supporting evidence. You also need a current, unexpired, signed photo ID; mail applicants can send a clear photocopy of the front and back.4NYC Health. Fees

The nonrefundable processing fee is $40 per order, whether you are correcting one piece of information or several at once. Certified copies of the corrected certificate cost $15 each, so a correction with one copy runs $55.7NYC311. How Long It Takes

Processing runs about 12 weeks from the date the Health Department receives your application. Mail delivery can add roughly two weeks on top of that.8NYC Health. If the Health Department Denies Your Correction

A denial is not the end of the road, but the next step is a courtroom. You will receive an official denial letter, and that letter is a prerequisite for filing a petition in New York State Supreme Court. The petition is a formal lawsuit where you present evidence to a judge; the Health Department and any parent named as a respondent can file opposition papers. Updating Other Records After the Correction

A corrected birth certificate is a starting point, not a finish line. If you changed your name or date of birth, several federal records need their own updates.

For Social Security, you apply for a replacement card. You can start online, but the SSA will require you to bring original documents (including the corrected birth certificate) to a local field office. Accepted proof of the correct date of birth includes the corrected birth certificate, a hospital birth record, a religious record from before age five, a valid passport, or a final adoption decree.10Social Security Administration. For a U.S. passport containing an error that matches what you just fixed, submit Form DS-5504 by mail with your current passport, one color passport photo, and the corrected birth certificate. There is no fee to correct a data or printing error. If you report the error within one year of the passport’s issuance, the replacement is issued with a full validity period (10 years for adults, 5 years for children under 16).
