Under the NYC building code, bathroom requirements start with a simple baseline and expand into dozens of technical rules: every legal dwelling unit needs at least one toilet, one sink, and one bathtub or shower connected to approved water and sewer systems, and everything from ceiling height to fixture spacing to electrical outlets has to meet Department of Buildings standards.1UpCodes. Required Fixtures in Every Bathroom
Plumbing Code Table 403.1 sets the minimum fixture count for residential buildings. R-2 apartment houses and R-3 one- and two-family homes each need one toilet, one sink, and one bathtub or shower per dwelling unit.1UpCodes. New York City Plumbing Code 2022 – Chapter 4 Fixtures, Faucets and Fixture Fittings A half-bath with just a toilet and sink is legal as a secondary room, but it never satisfies the full-bathroom requirement. The DOB will not sign off on a unit that lacks the complete set.
Every toilet installed in the five boroughs must be a WaterSense-labeled high-efficiency model using no more than 1.28 gallons per flush.3New York City. NYC Green Codes Task Force – Enhance Water Efficiency Standards That is 20 percent below the older federal 1.6-gallon standard.4US EPA. Residential Toilets Dual-flush toilets must meet 1.28 gallons on every cycle, not just the reduced setting. A non-compliant toilet fails inspection, and swapping one out after the tile and plumbing are finished is an expensive fix.
Bathroom Dimensions and Fixture Clearances
Building Code Section 1208.2 sets the minimum ceiling height in bathrooms, toilet rooms, and laundry rooms at 7 feet, a full foot lower than the 8-foot minimum for bedrooms and living rooms.5New York City Administrative Code. NYC Building Code 1208.2 – Minimum Ceiling Heights That gives renovators a little room for dropped ceilings or exposed ductwork. Pipes and beams can dip below the ceiling line as long as the 7-foot clearance holds across the usable floor.
Horizontal clearances are tighter and less forgiving. A toilet must sit at least 15 inches from its center to any side wall, partition, or vanity. Adjacent fixtures need at least 30 inches center-to-center. In front of every toilet, sink, and bidet, you need 21 inches of open floor to the nearest wall, fixture, or door.6International Code Council. 2022 New York City Plumbing Code 405.3.1 – Water Closets, Urinals, Lavatories and Bidets These numbers feel snug in a typical NYC bathroom, and they are, but they exist so a person can sit, stand, and move without bumping into anything.
Shower Compartments
Shower stalls carry their own dimensional rules. The interior cross-sectional area must total at least 900 square inches, and the narrowest inside dimension cannot fall below 30 inches, measured from finished wall to finished wall, excluding showerheads, valves, soap dishes, and grab bars.7New York City Administrative Code. NYC Plumbing Code 417.4 – Shower Compartments A stall that looks roomy on paper but pinches below 30 inches at a bench or offset wall will not pass. Because those measurements are taken at finished dimensions, tile thickness and waterproofing membranes have to be accounted for during rough framing.
Door Swing
Bathroom doors cannot swing into the required clear floor space of any fixture unless the room provides additional clear space beyond the door’s arc, calculated per ICC A117.1 Section 305.3.8New York City Administrative Code. NYC Building Code 1107.2.1 – Type B+NYC Unit Doors and Doorways Small-apartment renovations often stall right here. An inward-swinging door that clips the toilet clearance zone forces a redesign, and the usual fixes are pocket doors, outward-swinging doors with adequate hallway clearance shown on the plans, or a different fixture layout.
Walls, Floors, and Waterproofing
Building Code Section 1210 governs surfaces in the bathroom. Any material exposed to water or cleaning chemicals has to be smooth, hard, and waterproof.9New York City Administrative Code. NYC Building Code 1210 – Toilet and Bathroom Requirements Carpet is prohibited in any bathroom because it traps moisture and grows mold.
In commercial and public bathrooms, floor finishes must be smooth, hard, and non-absorbent, with a waterproof base running at least 4 inches up the wall at the floor-wall junction. Residential dwelling units are not bound by that 4-inch base rule, but practical waterproofing still matters, because water pooling at that junction will damage unprotected surfaces over time.
Shower walls and the walls above bathtubs with showerheads need a smooth, non-absorbent finish reaching at least 72 inches above the drain inlet. Walls within 2 feet of a toilet or urinal need the same kind of finish up to at least 4 feet above the floor. Grouts and sealants in wet zones should be rated for high-moisture use, or inspectors will flag them at the final walkthrough.
Ventilation and Lighting
Every bathroom needs to move air, either through a window or a fan. In R and I-1 residential occupancies, natural ventilation calls for a window of at least 3 square feet total, with at least 1.5 square feet operable to the outside.10UpCodes. New York City Building Code – 1203.4.1.3 Bathrooms and Toilet Rooms in R and I-1 Occupancies Those numbers are smaller than the 12-square-foot glazing minimum for habitable rooms, reflecting that bathrooms are typically smaller.
Windowless bathrooms need mechanical exhaust. For private dwellings, the NYC Mechanical Code requires 50 CFM if the fan runs only during use, or 20 CFM if it runs continuously while the unit is occupied. Public-use toilet rooms need 70 CFM intermittent or 50 CFM continuous, calculated per toilet or urinal.11UpCodes. New York City Mechanical Code 2022 – Chapter 4 Ventilation Exhaust air must vent directly outdoors. Recirculating bathroom air into other parts of the building is not allowed.
Artificial lighting is required in every bathroom whether or not a window exists. Any fixture in the wet zone above a tub or inside a shower must be rated for damp or wet locations, and light switches have to sit far enough from water to eliminate shock hazards.
Plumbing Behind the Wall
The system inspectors verify before the walls close up runs deeper than the fixtures. Every fixture needs its own liquid-seal trap with a seal depth between 2 and 4 inches.12UpCodes. New York City Plumbing Code 2022 – Chapter 10 Traps, Interceptors and Separators That water seal blocks sewer gas from rising through the drain.
Horizontal drainage piping must slope toward the sewer at a grade that lets gravity carry the waste. For pipes 2½ inches or smaller, the minimum slope is one-quarter inch per foot.13New York City Administrative Code. NYC Plumbing Code 704.1 – Slope of Horizontal Drainage Piping Getting the pitch wrong is one of the most common plumbing failures. Too shallow and solids accumulate; too steep and water outruns the waste, leaving deposits that narrow the pipe.
Every fixture also connects to a vent stack that terminates outdoors. Venting balances pressure inside the drainage system so traps don’t get siphoned dry. On the supply side, fittings must comply with ASME A112.18.1/CSA B125.1 for backflow protection, and potable water openings need an air gap, vacuum breaker, or other listed device.14UpCodes. Lead-Free Materials
Federal law overlays the plumbing code. Under Section 1417 of the Safe Drinking Water Act, every pipe, fitting, and fixture that contacts drinking water must be “lead free,” meaning a weighted average of no more than 0.25 percent lead across wetted surfaces. Solder and flux are capped at 0.2 percent.15US EPA. Use of Lead Free Pipes, Fittings, Fixtures, Solder, and Flux for Drinking Water Toilets, bidets, urinals, fill valves, and shower valves are exempt from the weighted-average calculation because they don’t deliver water for drinking or cooking, but sink faucets, supply lines, and any fixture someone might fill a glass at are fully covered. Since September 2023, manufacturers and importers must certify compliance before their products can be sold.
Electrical Safety
Water and electricity together demand specific protections. The National Electrical Code, adopted in NYC with local amendments, requires Class A ground-fault circuit interrupter protection on all bathroom receptacles. A GFCI trips at 5 milliamps, fast enough to prevent electrocution if a plugged-in appliance meets water. Every bathroom receptacle must sit on a dedicated 20-amp branch circuit. When that circuit serves only one bathroom, it can also power the lights and exhaust fan.
Light fixtures near water carry extra restrictions. Cord-connected fixtures, pendants, track lighting, and ceiling fans cannot be installed within 3 feet horizontally and 8 feet vertically of the top of the tub rim or shower threshold. Any fixture within the tub or shower footprint up to 8 feet above the rim must be rated for damp locations, and if it sits in the direct spray path, it must be rated for wet locations. Standard light switches belong outside arm’s reach from the tub or shower.
Accessibility Standards
New construction and substantial renovations trigger accessibility rules based on the 2010 ADA Standards for Accessible Design and ICC A117.1. Even projects that don’t meet the threshold for full ADA compliance often fall under the code’s “Type B+NYC” unit provisions, which apply broadly to multifamily buildings with four or more units.
Accessible bathrooms need a wheelchair turning space, either a 60-inch-diameter circle or a T-shape within a 60-inch square. The T-shape requires 36-inch-wide arms with each arm clear of obstructions for at least 12 inches in each direction and the base clear for at least 24 inches.16U.S. Department of Justice. 2010 ADA Standards for Accessible Design In a typical NYC bathroom, hitting those dimensions alongside standard fixture clearances requires early planning. Retrofitting turning space into an existing layout rarely works without moving walls or fixtures.
Grab bars follow specific placement rules. The rear wall behind the toilet needs a horizontal bar at least 36 inches long, mounted 33 to 36 inches above the finished floor. The side wall needs a 42-inch bar at the same height, starting no more than 12 inches from the rear wall and extending at least 54 inches from it. Sinks must offer knee and toe clearance underneath, and bathroom doors need maneuvering clearance on the bathroom side per ICC A117.1 Section 404.2.3.8New York City Administrative Code. Permits, Inspections, and Penalties
Not every bathroom project needs a permit, but most do. Cosmetic work such as painting, plastering, installing cabinets, and resurfacing floors can proceed without DOB approval, though the contractors doing the work still need a license from the Department of Consumer and Worker Protection. Anything beyond cosmetics, including adding a new bathroom, moving plumbing, rerouting gas lines, or adding electrical outlets, requires an ALT2 permit filed by a licensed Professional Engineer or Registered Architect.2NYC Department of Buildings. Some applications move through the Professional Certification program, where a licensed PE or RA certifies that the plans meet all applicable codes. That shifts compliance liability onto the certifying professional and can compress the wait for a permit from weeks to near-immediate. Professionals who certify non-compliant work face fines exceeding $20,000 and possible suspension of their filing privileges.
Building without a required permit gets expensive quickly. Class 1 violations run from $2,500 to $25,000, with per-day penalties of $500 to $1,000 until the violation is corrected.2NYC Department of Buildings. Those violations attach to the property rather than the contractor, so they follow the building and can complicate any future sale or refinance.
