NYC child support payments are calculated under New York’s statewide formula, collected in most cases through automatic wage withholding, routed to the state’s Child Support Processing Center in Albany, and paid out to the receiving parent by direct deposit or prepaid debit card. The obligation continues until the child turns 21, and missed payments trigger enforcement quickly.
How Much You Pay
New York uses a fixed formula rather than judicial discretion. The court combines both parents’ incomes and applies a percentage based on the number of children:
- One child: 17%
- Two children: 25%
- Three children: 29%
- Four children: 31%
- Five or more children: 35%
These percentages apply to combined parental income up to $193,000, effective March 1, 2026.1New York State Senate. New York Family Court Act 413 – Parents Duty to Support Child Above that cap, the judge can either keep applying the same percentages or weigh other factors like the child’s standard of living. Each parent’s share of the total is proportional to their share of the combined income: earn 70% of it, pay 70% of the support amount.
Three add-on expenses are split in the same income ratio: work- or school-related childcare, the child’s health insurance premiums, and unreimbursed medical costs such as co-pays.2New York City Bar. Child Support The court may add discretionary items like tutoring or extracurriculars, but those are not automatic.
The Self-Support Reserve
The formula will not push a paying parent below the self-support reserve, set at 135% of the federal poverty guideline for a single person.1New York State Senate. New York Family Court Act 413 – Parents Duty to Support Child If the standard calculation would drop the payer below that line, the court reduces the order. This most often applies to minimum-wage or part-time earners.
Wage Garnishment Caps
Federal and state law limit how much an employer can withhold. If you support another spouse or child outside the order, withholding is capped at 50% of disposable earnings, or 55% when you are more than 12 weeks behind. If you support no one else, the cap is 60%, rising to 65% past 12 weeks in arrears.3New York State Senate. New York Civil Practice Law and Rules 5241 – Income Execution for Support Enforcement Social Security disability benefits are subject to the same caps. Supplemental Security Income cannot be garnished for child support.
How to Make Payments
Most NYC child support flows through wage withholding. Once a support order is entered, the court typically sends an Income Withholding Order directly to the paying parent’s employer, and deductions start coming out of each paycheck automatically.4Administration for Children and Families. Processing an Income Withholding Order or Notice The employer sends the money to the New York State Child Support Processing Center in Albany, which handles distribution.
Self-employed parents, and anyone without an active withholding order in place, have to send payments themselves. The state offers several channels:5The State of New York. Pay Child Support
- Online through ExpertPay.com or Childsupportbillpay.com/newyork, using a bank account, credit or debit card, or digital wallets including PayPal, Venmo, Apple Pay, and Google Pay
- By mail, with a check or money order to the NYS Child Support Processing Center, PO Box 15363, Albany, NY 12212-5363
- In person, with cash at participating MoneyGram retail locations
Pay through official channels. Cash handed directly to the other parent, even with a handwritten receipt, does not reliably count as a documented payment if a dispute comes up later. The state’s system is what creates the record.
How Payments Are Received
Once the Child Support Processing Center receives a payment, it disburses the funds to the receiving parent. When Payments End
In New York, child support runs until the child turns 21, not 18. This surprises parents used to other states, where the obligation typically ends at 18.1New York State Senate. New York Family Court Act 413 – Parents Duty to Support Child Support can end earlier if the child marries, enters the military, or is otherwise emancipated. Turning 18, graduating high school, or starting college does not stop the obligation. Required health insurance coverage for the child also continues until 21.
The 21st birthday does not wipe out unpaid arrears. Any outstanding balance survives and keeps accruing interest until it is paid off.
What Happens If Payments Stop
Enforcement in New York moves quickly, and administrative tools work in the background before a case ever reaches a judge. The Office of Child Support Services can intercept federal and state tax refunds and apply them to arrears.7Cornell Law Institute. 18 NYCRR 346.9 – Tax Refund Offset Process The state can also place liens on real property and seize bank accounts. Once arrears equal four months of support, the court can suspend the delinquent parent’s driver’s license, professional and business licenses, and recreational licenses like hunting and fishing permits.8New York State Senate. New York Family Court Act 454 – Powers of the Court on Violation of a Support Order
If a court finds the nonpayment willful, meaning the parent could pay but chose not to, penalties get serious. A judge can impose up to six months in jail for contempt.8New York State Senate. New York Family Court Act 454 – Powers of the Court on Violation of a Support Order Failure to pay is treated as prima facie evidence of willfulness, so the non-paying parent carries the burden of proving they genuinely could not afford the payments. Every New York support order must carry a printed warning that willful noncompliance can lead to jail.9New York State Senate. New York Family Court Act 440
Interest keeps accruing on unpaid support while all of this is happening. Falling behind is easier than catching up, and courts have no obligation to forgive past-due amounts.
Changing the Payment Amount
Support orders can be modified when circumstances change, but the existing order stays fully enforceable until a judge signs a new one. That is the single most important point: file before arrears build up, not after. A modification only takes effect from the date the petition is filed, never retroactively.
New York recognizes three grounds for a modification:10New York State Senate. New York Family Court Act 451
- A substantial change in circumstances affecting either parent’s finances or the child’s needs
- Three years have passed since the order was entered, last modified, or adjusted
- Either parent’s gross income has changed by 15% or more since the last order, with the caveat that a decrease only qualifies if it was involuntary and the parent is actively looking for comparable work
The three-year and 15% triggers apply only to orders entered or modified on or after October 13, 2010, and parents can opt out of them in a written agreement.
If a Parent Moves Out of New York
An NYC order remains enforceable across state lines under the Uniform Interstate Family Support Act, and it can be registered in another state and enforced there on its original terms. As long as the paying parent, the receiving parent, or the child still lives in New York, New York keeps exclusive authority over the order, and another state cannot modify it unless both parents agree in writing to move jurisdiction. If you leave the state and need to change the amount, start by contacting NYC’s Office of Child Support Services or the child support agency where you now live to work out which court has authority.11NYC Human Resources Administration. A Note on Taxes
Child support is tax-neutral. The paying parent cannot deduct payments, and the receiving parent does not report them as income.12Internal Revenue Service. Tax Information for Non-Custodial Parents Spousal maintenance follows different rules.
