NYC DOE disability retirement is a pension benefit for Department of Education employees who can no longer perform their job because of a physical or mental condition. Which system handles your claim depends on your role: the Teachers’ Retirement System (TRS) covers pedagogical staff such as teachers and guidance counselors, and the Board of Education Retirement System (BERS) covers non-pedagogical staff such as school aides, custodians, and clerical workers. Both systems offer two tracks — ordinary disability, for conditions from any cause, and accidental disability, for injuries from a qualifying on-the-job accident — with different eligibility rules and different benefit formulas.

Who Qualifies for Ordinary Disability Retirement
Ordinary disability retirement covers disabilities from any cause, work-related or not. Service credit minimums depend on your tier:

You must be an in-service member or on an official leave of absence when you file. For BERS members no longer employed, the Medical Board must find that you were already incapacitated at the time you stopped working.2BERS NYC. BERS Words Summer 2015
Who Qualifies for Accidental Disability Retirement
Accidental disability retirement is available when the disability results from an on-the-job accident that was not caused by your own willful negligence. There is no minimum service credit; a member can qualify in the first year of employment.3BERS NYC. Tier 4 Summary
Under TRS, a qualifying “accident” must be a sudden and unexpected event. Injuries from ordinary workplace risks, routine job activities, or an applicant’s own misstep generally do not qualify.4TRS NYC. How Much the Pension Pays
TRS Ordinary Disability
Tier I and II members receive a pension of 1.2% of Final Average Salary (FAS) per year of service before July 1, 1970, and 1.53% of FAS per year after that date, plus an annuity from their accumulated savings.5TRS NYC. Ordinary Disability Retirement Brochure
Tier IV and Tier VI members receive the greater of one-third of FAS or 1/60 of FAS multiplied by years of total service credit, plus an annuity based on their Annuity Savings Accumulation Fund balance.5TRS NYC. TRS Accidental Disability
Pedagogical employees who are not eligible for Workers’ Compensation receive two-thirds of FAS. Paraprofessionals and others who are eligible for Workers’ Compensation receive one-third of FAS.4TRS NYC. BERS Ordinary Disability
Tier 3 and Tier 4 members receive the greater of 1⅔% of FAS times years of credited service, or 33⅓% of FAS.2BERS NYC. How to Apply
Filing a disability retirement claim means gathering medical evidence and submitting a formal application package to your retirement system. The process is broadly similar between TRS and BERS; the forms differ.
TRS applicants submit the disability retirement application coded for their tier — OD4 or OD6 for ordinary disability, AD4 or AD6 for accident disability — together with a personal report of disability, a physician’s report with treatment notes, a HIPAA-compliant medical records release, and all supporting documentation.5TRS NYC. You can file on your own or through someone authorized to act for you, such as a power of attorney or court-appointed guardian. You have the right to be represented by an attorney at any point, though representation is not required.8NYS Comptroller. Disability Benefits
Filing Deadlines
Under both TRS and BERS, applicants generally must file within three months of their last date on the active payroll. Medical Board Review
Once your file is reviewed for completeness, the retirement system schedules you for an examination by its Medical Board. TRS estimates the administrative review takes about four weeks before the exam is scheduled.5TRS NYC. Ordinary Disability Retirement Brochure The Board evaluates whether you are permanently incapacitated for duty and, in accident cases, whether a qualifying workplace accident caused the disability.9TRS NYC. How Does TRS Decide if I Receive a Disability Retirement The Board’s recommendation goes to the Teachers’ Retirement Board or the BERS board, which adopts a resolution certifying the decision, and you are notified by mail.
There is no fixed overall processing time. Once approved, benefit payments generally begin eight to twelve weeks after the determination date.10NYS Comptroller. If Your Claim Is Denied
A denial by the Medical Board is not the end of the case, but the appeal path involves a serious choice.
Option one is a Special Medical Committee review. Under TRS, the request must be filed within 30 days of receiving the examination transcript, using a form that includes a waiver: by requesting the review, you agree that the committee’s determination is final and give up the right to pursue the matter in court.5TRS NYC. Ordinary Disability Retirement Brochure The committee is made up of three physicians drawn from a panel maintained by the City’s administrator of health services, each with at least ten years of practice in their specialty, and its conclusions supersede those of the original Medical Board.11NYC Administrative Code. § 13-552.2 Medical Review in Member Disability Cases If you initiate the review, you and the City split the committee’s fees equally; if the agency head requests it, the City pays.
Option two is an Article 78 petition in state court, which requires an attorney and must be filed within four months of the determination.4TRS NYC. Many denied applicants retain private attorneys who specialize in public employee retirement cases before deciding which route to take.
Interactions With Other Benefits
Workers’ Compensation
Members applying for certain types of disability retirement may be required to file for Workers’ Compensation as well. When both are awarded, the pension is reduced by the full amount of the Workers’ Compensation benefit.10NYS Comptroller. Applying for Disability Retirement If a Workers’ Compensation claim is still pending, you can ask the retirement system to place a lien against future awards so you receive your full pension in the interim. Accepting a lump-sum Workers’ Compensation settlement without first consulting the retirement system can have unintended consequences for your monthly pension.
UFT Short-Term Disability
UFT-represented employees on an authorized unpaid medical leave may be eligible for short-term disability payments from the UFT Welfare Fund while the retirement application is pending. As of November 2024, the weekly benefit is $575 for teachers and other pedagogues and $475 for paraprofessionals, payable for up to 52 weeks of continuous disability. Payments stop once your pension begins. To qualify, you must first exhaust all accumulated sick leave including the Cumulative Absence Reserve, and then complete an unpaid waiting period of 28 consecutive days for pedagogical employees or 14 days for paraprofessionals.12UFT. Health Insurance
Disability retirees generally keep access to City health insurance as long as they receive a pension check from a City-maintained retirement system.13NYC.gov. If you qualify for Medicare under the Social Security Act’s disability provisions, you must enroll in Parts A and B when eligible; the City’s plan then becomes secondary, and the City reimburses retirees and eligible dependents for Medicare Part B premiums.14Hostos CUNY. Special Situations
Terminal Illness
TRS members with a terminal diagnosis and a life expectancy of 12 months or less may apply for a lump-sum disability benefit equal to the death benefit that would have been payable if the member had died on their last day of active service.15TRS NYC. World Trade Center Participants
A separate track exists for members who participated in rescue, recovery, or cleanup at the World Trade Center site and related locations between September 11, 2001, and September 12, 2002. Qualifying members who develop certain linked health conditions may apply for accidental disability retirement even outside the standard eligibility rules, as long as their medical records show no evidence of the condition before September 11, 2001.16NYS Comptroller. After You Are Approved
Approval does not end the system’s oversight. TRS and BERS may re-examine disability retirees at the Medical Board’s discretion, and both systems apply age limits: TRS re-examinations may continue until age 65, and BERS until age 60.19TRS NYC. Returning to work has consequences. Under Section 212 of the Retirement and Social Security Law, disability retirees working in New York public service have had an annual earnings limit of $35,000 since 2020.19TRS NYC.
