NYC Energy Conservation Code compliance means preparing an energy analysis and inspection package that the Department of Buildings (DOB) will accept before it issues permits, and then verifying the installed work before it issues a Certificate of Occupancy. A version change is in motion: applications filed on or after March 30, 2026, must meet the 2025 NYCECC, while complete applications filed before that date stay under the 2020 code.1NYC Buildings. Which Projects Trigger the Code
The NYCECC applies to new buildings, additions, and alterations that touch a building’s thermal envelope or energy-consuming systems. Replacing windows, upgrading a boiler, adding insulation, or installing new lighting all fall within scope if the work changes how the building uses energy.2NYC Department of Buildings. Minor alterations and ordinary repairs that do not affect the thermal envelope or building systems are generally exempt. Patching roof without changing its insulation value, or replacing a fixture in kind, typically falls below the compliance threshold. If a project claims an exemption under the 2025 code, the design professional must note the basis for the exemption on the drawings and provide a simple tabular analysis describing the work scope to validate it.3NYC Department of Buildings. What Changes on March 30, 2026
The 2025 NYCECC incorporates ASHRAE 90.1-2022 for commercial buildings and brings several shifts that affect what has to be in a submission:
- New chapters require projects to earn additional efficiency credits beyond baseline compliance.
- Alterations to existing structures face broader energy requirements than under the 2020 code.
- Historic buildings lose their blanket exemption and must submit an energy analysis; a partial exemption requires a Historic Building Report documenting why compliance would harm character-defining features.

If a complete application is filed before March 30, 2026, the project stays under the 2020 code. Anything filed on or after that date must meet 2025 standards, even if design work began under the old code. Classify the Building First
The code draws a firm line between residential and commercial, and the classification drives which software you use and which forms you file. Pick a Compliance Pathway
The NYCECC offers several ways to prove that a design meets requirements. The choice depends on building type, complexity, and how much flexibility the design needs.
- Prescriptive pathway. The design must meet defined specifications for insulation, window performance, and system efficiencies. No modeling. If every component hits or exceeds the listed values, the building passes. Works well for single-family homes and small commercial alterations.
- Performance pathway. Whole-building energy modeling shows the design performs better than a modeled baseline. This lets architects and engineers trade off between components. A building with more glazing than the prescriptive path allows can still comply if the mechanical systems are efficient enough to compensate.

Assemble the Energy Compliance Volume
The Energy Compliance Volume is the set of drawings, forms, and analysis reports that prove the design meets the NYCECC. It gets folded into the construction documents and must be internally consistent. Every R-value on an insulation detail, every U-factor on a window schedule, and every equipment efficiency rating has to match across the architectural drawings, the energy analysis, and the EN-series forms.
The core documents:
- TR8, the Technical Report Statement of Responsibility, which identifies the registered design professional or progress inspector responsible for verifying that the built work matches the approved plans. - The COMcheck, REScheck, or tabular analysis that feeds the EN forms.
All applicable progress inspections must be listed on an EN-labeled sheet in tabular format and must match the inspections identified on the TR8.3NYC Department of Buildings. File Through DOB NOW: Build and Pay the Fee
The complete Energy Compliance Volume is submitted through DOB NOW: Build. The design professional uploads the TR8, EN-series forms, and construction drawings, then selects the applicable work types and compliance pathways.9NYC Department of Buildings. - One-, two-, or three-family dwellings: $220
- Alterations for all other buildings: $525
- New buildings, or alterations that change the Certificate of Occupancy for non-residential or high-rise residential: $875

Review, Objections, and Post-Approval Changes
After filing, DOB conducts a technical review against the applicable code. Timelines vary with agency backlog and typically run several weeks. If the submission meets requirements, DOB issues a Notice of Approval, which allows the applicant to pull work permits.
Objections are common for complex commercial projects. When DOB flags discrepancies between drawings and the energy analysis, missing forms, or a wrong compliance pathway, the project team must revise and resubmit. Each round adds time, which is why getting the Energy Compliance Volume right on the first filing matters more than filing quickly.
The approval attaches to the specific version of plans that were submitted. If the design changes after approval, such as a different boiler model, revised window specifications, or added square footage, the team must file a post-approval amendment (PAA). A PAA costs $100 per submission and goes through its own review cycle.11NYC Department of Buildings. Progress Inspections and Final Sign-Off
Plan approval does not end the process. Every energy-related component must be verified through progress inspections conducted by the registered architect or professional engineer named on the TR8. These happen at specific construction milestones. Insulation must be inspected before drywall closes up the walls, duct sealing before ceilings are finished, and mechanical systems before they are concealed.
When energy-related work is complete, the progress inspector submits the final TR8 certification through DOB NOW, confirming that every inspection listed on the original TR8 and on any TR8s filed with PAAs has been satisfied. This Energy Code Sign-off is a prerequisite for DOB to issue a final Certificate of Occupancy or Letter of Completion. Without it, the building cannot be legally occupied and the project stays open in city records. The city retains the right to audit certifications at any time.
Historic Buildings No Longer Get a Free Pass
Before the 2025 code, historic and landmarked buildings had a blanket exemption from the NYCECC. That is gone. What NYCECC Compliance Does Not Cover
The NYCECC governs how a building is designed and built. Separate laws govern how it performs and what it burns once occupied. Local Law 97 sets greenhouse gas emissions limits for most buildings over 25,000 gross square feet, with the first period running 2024 through 2029 and stricter limits in 2030; overages carry a penalty of $268 per metric ton of CO2 equivalent over the cap.13NYC Buildings. Local Law 154 – Building Electrification The mechanical systems chosen to satisfy LL154 must still hit NYCECC efficiency standards. Meeting the energy code at construction does not satisfy these other regimes, and vice versa.
Penalties for Getting It Wrong
Failing to complete energy code inspections, falsifying reports, or submitting inaccurate certifications can lead to fines and suspension of the responsible professional’s license. The compliance framework depends on professionals self-certifying their work, and DOB treats false certifications accordingly.
Related energy laws carry separate penalties. Under Local Law 33 of 2018, failure to display a building’s energy efficiency grade results in a $1,250 fine per violation.15NYC Buildings. The better move is upstream: classify the project correctly, choose the right compliance pathway, coordinate the documents, and make sure progress inspections actually happen before the walls close up.
