Most workers giving birth in New York City can put together 18 to 20 weeks of paid, job-protected leave by using two separate state benefits back-to-back. NYC maternity leave isn’t a single program: it’s short-term disability for your medical recovery, followed by Paid Family Leave for bonding with the baby. Disability pays up to $170 a week during recovery. Paid Family Leave pays 67% of your average weekly wage, up to $1,228.53 a week in 2026. Federal FMLA and NYC’s own pregnancy protections sit on top of both.
Disability Benefits for Medical Recovery
New York’s short-term disability program covers the weeks you’re physically unable to work because of pregnancy or childbirth. It’s the medical piece, and it comes first.1New York State Workers’ Compensation Board. Workers Disability Benefits
The standard periods:
- Up to 4 weeks before your due date, if pregnancy prevents you from doing your job
- 6 weeks after a vaginal delivery
- 8 weeks after a cesarean delivery
The pay is modest. Disability benefits are calculated as half your average weekly wage and cap out at $170 per week.2New York State Senate. New York Workers’ Compensation Code 204 – Disability and Family Leave During Employment A healthcare provider has to certify that you’re medically unable to work.
Paid Family Leave for Bonding
Paid Family Leave, established under the Workers’ Compensation Law, gives eligible employees up to 12 weeks of paid, job-protected leave to bond with a newborn.2New York State Senate. New York Workers’ Compensation Code 204 – Disability and Family Leave During Employment This is strictly bonding leave. You cannot use it for your own medical recovery. You can take it anytime within the first 12 months after the birth, either in one block or in full-day increments.
Eligibility depends on your schedule. If you work 20 or more hours a week, you qualify after 26 consecutive weeks with your employer. If you work fewer than 20 hours a week, you qualify after 175 days. Most private-sector employees are covered, including part-timers.
For 2026, PFL pays 67% of your average weekly wage, capped at 67% of the New York State Average Weekly Wage of $1,833.63. That puts the maximum weekly benefit at $1,228.53.3Paid Family Leave. New York Paid Family Leave Updates for 2026 If you earn less than the state average, you get 67% of your own wages. Benefits come from your employer’s insurance carrier, not the state.
Your employer has to keep your health insurance going during leave on the same terms as if you were working, and you still pay your share of the premium. When you come back, you’re entitled to your same job or a comparable position with equal pay and benefits.4Paid Family Leave. Benefits
Stacking Disability and Paid Family Leave
You cannot collect disability and Paid Family Leave at the same time, but you can run them back-to-back. Most new parents take disability first for the medical recovery weeks, then transition into bonding leave.
- Vaginal delivery: 6 weeks disability + 12 weeks PFL = 18 weeks paid
- Cesarean delivery: 8 weeks disability + 12 weeks PFL = 20 weeks paid
There’s an overall cap: combined disability and PFL cannot exceed 26 weeks in any 52-week period.1New York State Workers’ Compensation Board. Workers Disability Benefits For a standard maternity leave, the cap is a non-issue. It matters if you already used disability earlier in the year or if complications extend your recovery well past the standard period.
If your employer allows it, you can also use accrued vacation or PTO alongside PFL to bring your paycheck closer to your full salary. You just can’t collect more than your regular wages between the two. Whether your employer permits topping off depends on company policy.5Paid Family Leave. Paid Family Leave and Other Benefits
Federal FMLA Job Protection
The federal Family and Medical Leave Act provides up to 12 weeks of unpaid, job-protected leave for birth and bonding.6U.S. Department of Labor. Family and Medical Leave Act FMLA doesn’t pay anything, and it usually runs concurrently with your state disability and PFL, so it doesn’t add extra weeks. What it adds is a separate federal enforcement mechanism protecting your right to return.
FMLA eligibility is narrower than the state programs. You have to meet all three:
- You’ve worked for the employer for at least 12 months
- You’ve logged at least 1,250 hours in the 12 months before leave starts
- Your employer has at least 50 employees within a 75-mile radius of your worksite
Many NYC workers at smaller companies won’t qualify for FMLA but still have full access to New York’s Paid Family Leave and disability, which reach far more employees.7U.S. Department of Labor. Fact Sheet 28H – 12-Month Period Under the FMLA
NYC Protections During and After Pregnancy
New York City’s Human Rights Law requires employers to provide reasonable accommodations for pregnancy, childbirth, and related medical conditions. This applies to all employers in the city regardless of size.8New York City Administrative Code. NYC Administrative Code 8-107 – Unlawful Discriminatory Practices Accommodations can include modified duties, schedule changes, extra breaks, or temporary reassignment. Your employer has to engage in what the law calls a cooperative dialogue to work out what fits.
Prenatal Appointments
Under the NYC Earned Safe and Sick Time Act, you can use accrued sick leave for prenatal medical appointments without losing wages.9New York City Administrative Code. NYC Administrative Code 20-911 – Short Title That covers doctor visits, lab work, and other pregnancy-related healthcare before your main leave begins. Most private-sector and nonprofit employees working in the city are covered.
Lactation Rooms at Work
NYC employers must provide a dedicated lactation room for employees who need to express breast milk. The room has to be sanitary, separate from a restroom, shielded from view, and free from intrusion. At minimum it needs an electrical outlet, a chair, a flat surface for a pump, and nearby access to running water. A refrigerator for breast milk storage has to be available near your work area.10NYC Commission on Human Rights. Local Law 185 of 2018
Employers have to maintain a written lactation accommodation policy, hand it to every employee at the start of employment, and post it in the workplace. If you request a lactation room, your employer must respond within five business days.8New York City Administrative Code. NYC Administrative Code 8-107 – Unlawful Discriminatory Practices
What You Pay In and How Benefits Are Taxed
Paid Family Leave is funded entirely by employee payroll deductions. For 2026, the rate is 0.432% of gross wages per pay period, with a maximum annual contribution of $411.91.11New York State Department of Financial Services. PFL Decision on Premium Rate for 2026 Once your contributions hit $411.91 for the year, deductions stop.
PFL benefits are taxable income for both federal and state purposes, and taxes are not automatically withheld from the payments. You can request voluntary withholding from the insurance carrier or set money aside yourself to avoid a surprise at tax time.4Paid Family Leave. Benefits Short-term disability benefits, by contrast, are generally not subject to federal income tax when funded through employee after-tax contributions.
How to File Your Claim
Give your employer at least 30 days’ advance notice before your leave begins. Because a due date is foreseeable, the 30-day rule applies in most pregnancies. If the baby comes early, notify your employer as soon as you can.12Cornell Law Institute. 12 NYCRR 380-3.1 – Employee Notice Requirements for Paid Family Leave
For bonding leave, the two forms are:
- PFL-1, the leave request form, completed by both you and your employer
- PFL-2, the bonding certification, submitted with a birth certificate or a healthcare provider’s certification of birth
You send these forms and supporting documents to your employer’s PFL insurance carrier, not to the state.13Paid Family Leave. Form Package for Bonding Most carriers accept online submissions, fax, or mail. Keep copies of everything. Your employer is required to post the insurance carrier information in the workplace.
Once the carrier has your completed application, it has 18 days to pay benefits or deny the claim with an explanation.4Paid Family Leave. Benefits Denials must state the reason and include instructions for requesting arbitration. PFL disputes are handled through arbitration, not the courts.14Paid Family Leave. If Your Employer Retaliates
Your employer cannot fire you, demote you, cut your pay, or otherwise punish you for requesting or taking Paid Family Leave. If you think that happened, there’s a formal process. First, deliver a Formal Request for Reinstatement (Form PFL-DC-119) to your employer. The employer then has 30 days to correct the situation or respond.15New York State Workers’ Compensation Board. Formal Request for Reinstatement Regarding Paid Family Leave
If your employer ignores the form, misses the deadline, or responds unsatisfactorily, you can file a discrimination complaint on Form PFL-DC-120. A Workers’ Compensation Law Judge can hear the case and order reinstatement, back wages, and attorney fees if the judge finds a violation.
Self-Employed Workers in NYC
If you’re self-employed, PFL coverage isn’t automatic, but you can opt in. Timing matters: enroll within the first 26 weeks of becoming self-employed and coverage starts relatively quickly. Miss that window and you’ll have to pay premiums for two full years before you can actually collect benefits. During that waiting period you’re paying in with nothing to draw on. Given the low annual cost, early enrollment is worth considering if there’s any chance you’ll want parental leave later.11New York State Department of Financial Services.
