NYC Restaurant Sales Tax: Rates, Filing, and Exemptions

Restaurants in New York City charge 8.875 percent sales tax on nearly everything they sell. That rate is built from a 4 percent state tax, a 4.5 percent city tax, and a 0.375 percent Metropolitan Commuter Transportation District surcharge.1NYC Department of Finance. What Gets Taxed at 8.875 Percent

Tax Law Section 1105(d) covers all food and drink sold by restaurants, taverns, caterers, and similar establishments for on-premises consumption.3New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax On-premises includes the dining room, a sidewalk cafe, a shared food court, or anywhere else near the establishment where the customer eats. Style of service is irrelevant. Counter service, table service, buffet, and food truck windows all sit at 8.875 percent.

Several categories are taxable even when the customer takes the food away:

  • Heated food — anything the vendor keeps warm with heat lamps, warming trays, or ovens, or cooks to order, stays taxable off-premises.4Cornell Law Institute. New York Codes Rules and Regulations Title 20 527.8 – Sale of Food and Drink
  • Sandwiches — always taxable, in every form, including vending machines.
  • Beverages — beer, wine, cocktails, sodas, and any other drink sold by a restaurant are taxed at the full rate.5NYC311. Sales Tax
  • Carry-out food packaged with utensils, napkins, or plates — the accessories turn it into prepared food.

The taxable amount also includes cover charges, minimum charges, and entertainment fees on the check.3New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax A $5 live-music surcharge on Friday nights is part of the taxable receipt.

What Restaurants Can Sell Tax-Free

A restaurant can sell food tax-free only when the sale looks like a grocery-store transaction. Under 20 NYCRR 527.8, off-premises food escapes the tax when two conditions both hold: the food is unheated, and it’s sold in the same form, quantity, and packaging a regular food store would use.4Cornell Law Institute. Cold cuts, salads, and bakery products sold by the pound, dozen, or loaf for home consumption are not taxable. A bag of untoasted bagels sold by the dozen is exempt. Toast those same bagels and the sale becomes taxable, because the food is now heated. A whole loaf of bread or a container of milk in its original packaging is exempt. The test is whether the restaurant acted more like a grocery counter than a kitchen.

Tips and Mandatory Gratuities

A voluntary tip — one the customer chooses to leave and can change or eliminate — is not part of the taxable receipt.6New York State Department of Taxation and Finance. Gratuities and Service Charges Suggested tip amounts on the check are still voluntary as long as the customer can override them.

Mandatory gratuities on large-party checks are where restaurants trip themselves up. A mandatory gratuity avoids the tax only when all three of these are true:

  • The charge appears as a separate line item on the bill.
  • The charge is specifically labeled as a gratuity.
  • The entire amount is passed through to employees.

Miss any one of those and the full mandatory gratuity gets taxed at 8.875 percent.6New York State Department of Taxation and Finance. Gratuities and Service Charges Service charges or fees that aren’t labeled as gratuities are always taxable, even when the money ends up with staff.

Delivery and Third-Party Apps

When your restaurant delivers food, either with your own drivers or through a delivery service you arrange, the delivery charge is part of the taxable receipt. Do not assume DoorDash, Uber Eats, or Grubhub is collecting your sales tax for you. New York’s marketplace facilitator law specifically carves restaurant food out of the transactions where the platform has to collect.7New York State Department of Taxation and Finance. Sales Tax Collection Requirement for Marketplace Providers The restaurant is still on the hook for the tax on orders that come through an app. Reconcile platform statements against your own sales records so nothing slips through.

Employee Meals and Comps

Free employee meals are not subject to sales tax, but the restaurant owes use tax on the cost of any taxable ingredients that went into them. Those ingredients were purchased tax-free for resale, and diverting them to a non-sale use triggers the use tax.8New York State Department of Taxation and Finance. Discounted employee meals work differently. Any charge for food or drink, whether the employee pays cash or the amount is withheld from wages, is a taxable sale. Collect sales tax on whatever the employee actually pays.8New York State Department of Taxation and Finance. Register Before Your First Sale

You cannot legally make a taxable sale in New York without a Certificate of Authority from the Department of Taxation and Finance. Apply with Form DTF-17 at least 20 days before your first sale.9New York State Department of Taxation and Finance. Operating without one exposes you to a penalty of up to $500 for the first day and $200 for each day after, capped at $10,000, plus possible criminal charges.11Cornell Law Institute. New York Codes Rules and Regulations Title 20 539.4 – Revocation or Suspension of Certificates of Authority

Filing Schedule and the Vendor Collection Credit

Your filing frequency depends on how much tax you owe:12New York State Department of Taxation and Finance. Filing Requirements for Sales and Use Tax Returns

  • Annual, if total tax due for the filing period is $3,000 or less.
  • Quarterly, the default for most restaurants, when taxable receipts stay under $300,000 per quarter.
  • Monthly (part-quarterly), once taxable receipts hit $300,000 or more in any single quarter.

High-volume restaurants with more than $500,000 in annual sales tax liability may be enrolled in PrompTax, which requires accelerated payments during each month. Filing goes through the Tax Department’s Business Online Services portal using the sales tax web file option, and payment pulls directly from your bank account.13New York State Department of Taxation and Finance. Quarterly and annual filers who submit on time and pay in full earn a vendor collection credit of 5 percent of the tax reported, capped at $200 per filing period.14New York State Department of Taxation and Finance. Vendor Collection Credit Monthly filers and PrompTax participants don’t qualify. The credit can’t be claimed on amended or late returns, so a single missed deadline has a real cash cost.

Penalties and Personal Liability

Late filing penalties start at 10 percent of the tax due for the first month and add 1 percent per additional month, capped at 30 percent. If a return is more than 60 days past due, the minimum penalty is the lesser of $100 or 100 percent of the tax owed. Registered vendors who don’t file at all face a minimum $50 penalty regardless of what’s due.15New York State Senate. The state can revoke or suspend your Certificate of Authority for willfully failing to file, collect, or remit.11Cornell Law Institute. New York Codes Rules and Regulations Title 20 539.4 – Revocation or Suspension of Certificates of Authority Without the certificate, you cannot legally operate.

The part that catches owners off guard is personal liability. Owners, officers, directors, partners, and certain employees who are responsible for the business’s sales tax obligations can be held personally liable for unpaid tax. The Department of Taxation and Finance can seize personal assets, and the liability survives even if the restaurant closes or the entity dissolves.16New York State Department of Taxation and Finance. Records You Have to Keep

Sales tax vendors must retain records for at least three years from either the due date of the return they relate to or the date the return was filed, whichever is later.17New York State Department of Taxation and Finance. For a restaurant, that means daily register tapes or point-of-sale summaries, guest checks, purchase invoices for taxable inventory, and records of any exempt sales. Document how your POS categorizes each menu item as taxable or non-taxable. Keep separate tracking for third-party delivery orders, employee meals, and complimentary items so an auditor doesn’t end up estimating your liability from incomplete data.
