NYC sales tax on electronics is 8.875 percent. A $1,000 laptop rings up at $1,088.75, and the same rate applies to almost every piece of consumer hardware you can buy, from smartphones and tablets to televisions, gaming consoles, headphones, and accessories. It also covers pre-written software in any format, plus charges you might not expect on the receipt, like shipping and extended warranties.
How the 8.875 Percent Rate Is Built
Three layers stack to produce the total. New York State charges 4 percent on retail sales of tangible personal property.1New York State Senate. New York Code TAX 1105 – Imposition of Sales Tax New York City adds a 4.5 percent local tax on top of that. The Metropolitan Commuter Transportation District surcharge adds another 0.375 percent to fund regional transit.2New York State Senate. Which Electronics Are Taxable
New York treats electronics as tangible personal property, meaning any physical item you can see and touch. The state’s Quick Reference Guide lists computers among taxable items, and the same reasoning covers tablets, smartphones, televisions, digital cameras, smartwatches, gaming systems, headphones, speakers, and accessories.5New York State Department of Taxation and Finance. Quick Reference Guide for Taxable and Exempt Property and Services If it plugs in, charges up, or processes data and you’re buying it at retail, expect to pay the full 8.875 percent.
One question comes up with wearables. New York exempts clothing and footwear priced under $110 per item from the state’s 4 percent portion, but that exemption applies to articles “worn by humans” in the traditional clothing sense.6New York State Department of Taxation and Finance. Clothing and Footwear Exemption State guidance does not extend it to electronic wearables, so a smartwatch or fitness band is taxed at the full rate.
Software, Including Cloud Subscriptions
Pre-written software is taxable regardless of how you receive it. On a disc, through a download, or accessed remotely as a subscription, the tax applies.7New York State Department of Taxation and Finance. Computer Software The statutory definition of “pre-written” covers any software not built to a specific buyer’s specifications, including products that combine portions of multiple pre-written programs.8New York State Senate. New York Code TAX 1101 – Definitions
Custom software built to your own specifications is not taxable, as long as you are the buyer it was designed for. The moment that custom software is sold or transferred to someone else, it becomes pre-written and tax applies. When a vendor modifies pre-written software for you and charges separately for the customization, only the base software price is taxed; the separately stated modification charge is exempt.7New York State Department of Taxation and Finance. Computer Software
Cloud subscriptions catch a lot of buyers off guard. New York treats remotely accessed software (SaaS) as a transfer of possession, since you gain constructive control over the software while using it. The tax applies based on where you use or direct the use of the software, not where the servers sit.7New York State Department of Taxation and Finance. Computer Software An Adobe Creative Cloud or similar subscription used in NYC gets taxed at 8.875 percent.
Other digital media is different. Downloaded music, e-books, streaming video, and digital movies are not subject to New York State or City sales tax. Software is the only digital good currently taxed in New York.9New York City Independent Budget Office. Digital Goods and Sales Taxes in New York Spotify and Kindle get a pass; Adobe does not.
Shipping and Extended Warranties Get Taxed Too
When you order online and pay for shipping, that shipping charge is part of the taxable receipt. If the product itself is taxable, the shipping, handling, or postage line is taxable as well.10New York State Department of Taxation and Finance. Shipping and Delivery Charges The only exception is if you independently arrange your own delivery service and receive a separate invoice for transportation alone, which almost never happens with a standard consumer electronics purchase.
Extended warranties and service contracts are taxable, treated as the sale of repair and maintenance services. This holds even when the retailer selling the warranty at checkout is not the company that will perform the repairs.11New York State Department of Taxation and Finance. Service Contracts and Extended Warranties Buy a $1,200 laptop with a $150 protection plan and $15 shipping, and the 8.875 percent runs against the full $1,365.
Trade-Ins Lower the Taxable Amount
Trading in an old device cuts the price you owe tax on, as long as the seller intends to resell what you traded. The credit must be applied directly to the item you’re buying in that same transaction. You can’t bank unused credit for later or carry it to a different seller.12New York State Department of Taxation and Finance. How Discounts, Trade-Ins, and Additional Charges Affect Sales Tax Trade in a phone worth $300 against a $1,000 new model and you pay tax on $700.
Online Orders, Marketplaces, and Out-of-State Sellers
Buying from an online or out-of-state retailer does not avoid the tax. New York uses destination-based sourcing: the rate depends on where the package is delivered, not where the seller sits.13New York State Department of Taxation and Finance. Remote sellers with no physical presence in New York must register and collect tax once, over the previous four sales tax quarters, their gross receipts from tangible property delivered into the state exceeded $500,000 and they made more than 100 such sales.14New York State Department of Taxation and Finance. Since June 2019, marketplace facilitators like Amazon, eBay, and Walmart Marketplace are directly responsible for collecting and remitting tax on taxable sales they facilitate for third-party sellers.15New York State Department of Taxation and Finance. Sales Tax Requirements for Marketplace Providers Even a small third-party seller on Amazon doesn’t collect New York tax themselves on platform sales; Amazon handles it.
Use Tax When Nobody Collects
If you buy electronics from a seller that doesn’t collect New York sales tax, say, a small out-of-state vendor below the economic nexus thresholds or a private party, you still owe tax. It’s called use tax, and the rate is the same 8.875 percent. The obligation sits with you, the buyer. Shipping and handling from that purchase are included in the taxable amount.10New York State Department of Taxation and Finance. Shipping and Delivery Charges
Individuals can report use tax on their New York State personal income tax return. If you paid sales tax to another state on the same purchase, New York credits that amount, but only the state-level portion the other jurisdiction charged, not any county or city piece.16New York State Department of Taxation and Finance. Use Tax for Businesses With marketplace rules now covering major platforms, use tax mainly comes up for private party sales, small specialty retailers, and sellers in states without sales tax.
Exemptions Rarely Apply to Regular Shoppers
Tax-free purchases are available to a short list of buyers: 501(c)(3) nonprofits using Form ST-119, federal, state, and local government agencies, and resellers buying inventory with Form ST-120.17New York State Department of Taxation and Finance. Sales Tax Exempt Organizations18New York State Department of Taxation and Finance. Exemption Certificates for Sales Tax Narrower statutory exemptions exist for qualifying internet data center equipment and for telecommunications transmission equipment.19New York State Senate. New York Code TAX 1115 – Exemptions From Sales and Use Taxes A regular consumer buying electronics for personal use has no exemption available. No income-based exclusion, no senior discount, no first-time buyer break.
No Sales Tax Holiday for Electronics
Several states run annual tax holidays covering computers and electronics, among them Alabama, Arkansas, Florida, and South Carolina. New York does not.20Federation of Tax Administrators. 2025 Sales Tax Holidays The clothing exemption for items under $110 is permanent rather than a holiday, and it doesn’t reach electronics. There is no back-to-school weekend or other temporary window where laptops, tablets, or peripherals go tax-free in NYC.
