NYC Senior Citizen Rent Freeze (SCRIE): Eligibility and Renewals

The NYC Senior Citizen Rent Increase Exemption, known as SCRIE and part of the city’s Rent Freeze Program, locks your rent in place if you are 62 or older, live in a qualifying regulated apartment, and have a household income of $50,000 or less after certain deductions. Your landlord still collects the full legal rent; the city covers the difference through a property tax credit to the building owner.1The City of New York. NYC Rent Freeze Program

The Four Things You Have to Meet

SCRIE eligibility rests on four requirements, and all four have to be true at the same time.

The $50,000 cap is a hard ceiling. It doesn’t scale with household size, and financial hardship doesn’t override it. What matters is how the number gets calculated, and that’s where most applicants either qualify or don’t.

How Income Is Counted

The income figure is not your gross income. The Department of Finance starts with the combined income of every household member, then subtracts federal, state, and city income taxes and the Social Security taxes paid. Union dues and court-ordered support payments come out too.2AMLegal. NYC Administrative Code 26-509 – Application for Rent Increase Exemptions

Several categories of money don’t count at all. Gifts, inheritances, payments to victims of Nazi persecution, and withdrawals from savings are excluded. So are annual cost-of-living increases in Social Security or pension benefits that stay at or below the Consumer Price Index, which keeps a routine inflation bump from pushing you over the limit.2AMLegal. Interest, dividends, and capital gains do count. So does a one-time lump sum like an insurance settlement, but only in the year you receive it. In later years the remaining balance is treated as an asset, not income, so a large payout might disqualify you for a single year without ending your eligibility permanently.

A common point of confusion: if you have a roommate who is not a family member, you don’t report their income as household income. But rent they pay you does count as your income.

What “Frozen Rent” Actually Means

SCRIE does not freeze your rent at whatever you happen to be paying the day you apply. The frozen amount is set at one-third of your monthly household income, and it gets recalculated at every renewal.6NYC311. Rent Freeze Program Assistance

Three things can happen when the Department of Finance runs the numbers at renewal:

  • If one-third of your monthly income is less than your current frozen rent, the frozen rent stays where it is.
  • If one-third of your monthly income is more than your current frozen rent because your income has gone up, the frozen rent rises to match one-third of your income.
  • If one-third of your monthly income exceeds the full legal rent, you no longer qualify.

Your landlord always collects the full legal rent. The city pays the gap through a property tax abatement credited to the building owner’s account.1The City of New York. NYC Rent Freeze Program

How to Apply

You can apply online through the NYC Department of Finance’s Tenant Access Portal or by mailing a paper application. Paper forms are available by calling 311. Send supporting documents with the completed application.4ACCESS NYC. Senior Citizen Rent Increase Exemption (SCRIE)

You’ll need:

  • Proof of age, such as a birth certificate, passport, driver’s license, or other government-issued ID showing your date of birth.
  • Proof of income for every household member for the prior year: federal and state tax returns or W-2s. If you didn’t file, an SSA-1099 or pension statement works instead.
  • Proof of rent. Rent-stabilized tenants provide their current and prior leases signed by both tenant and landlord. Rent-controlled tenants provide the Notice of Maximum Collectible Rent. Mitchell-Lama residents provide a certification from building management.

Renewals and What Happens If You Miss One

SCRIE is not a one-time approval. For rent-stabilized tenants, renewals usually track lease expiration on a one- or two-year cycle, and you can start the renewal online 60 days before your benefit expires.7NYC.gov. NYC Rent Freeze Program – Apply or Renew At renewal you have to show you still meet every requirement and report any change in household composition or income.

Missing a renewal deadline doesn’t end your benefit right away, but the timeline is unforgiving. Ninety days after your lease ends without a renewal, the Department of Finance sends a Failure to Recertify notice to you, your representative, and your landlord. That notice gives you another 90 days to submit the renewal, signed leases covering the relevant period, and proof of income.8NYC311. Rent Freeze Program Renewal

If you still haven’t renewed 180 days after your lease end date, the benefit lapses. You have to start over as a new applicant, and you owe your landlord the portion of the full legal rent you didn’t pay during those six months.8NYC311. Rent Freeze Program Renewal Depending on the gap between your frozen rate and the legal rent, that back rent can be substantial. Tenants whose disability or impairment prevented timely filing can request additional time as a reasonable accommodation.

If Your Application Is Denied

You have 120 days from the date on a denial or revocation notice to file an appeal. The Department of Finance can grant a six-month extension for good cause.9NYC Department of Finance. SCRIE Tenant Appeal Application

One distinction matters. If your denial was because you didn’t submit required documents, you don’t file a formal appeal. You send the missing documents to the address on your decision notice within six months. A formal appeal is for cases where you disagree with the Department of Finance’s determination on the merits. Appeals go by mail to the Compliance Unit at the same P.O. Box 3179 address in Union, NJ. If an appeal is denied, you can’t file a second one on the same application.9NYC Department of Finance. If You Also Have a Qualifying Disability

SCRIE is one of two tracks in the Rent Freeze Program. The other is the Disability Rent Increase Exemption (DRIE), which uses the same $50,000 income limit, the same apartment types, and the same rent-to-income calculation, but replaces the age requirement with receipt of a qualifying disability benefit: SSI, SSDI, VA disability pension or compensation, or disability-related Medicaid if you previously received SSI or SSDI.10ACCESS NYC.
