NYC Unemployment Benefits: Eligibility, Filing, and Weekly Amount

NYC unemployment benefits are administered by the New York State Department of Labor, and the rules are the same statewide: if you lost your job through no fault of your own, earned enough during a recent base period, and are ready and able to work, you can collect a weekly payment for up to 26 weeks. The current maximum is $869 a week and the minimum is $143.1Department of Labor. What is the Maximum Benefit Rate The program is funded by employer taxes, not payroll deductions. The one thing that sets NYC residents apart shows up at tax time, because the city adds its own income tax on top of federal and state.

Who Qualifies

Two things have to line up: how you left your job, and how much you earned before that.

On the separation side, layoffs, position eliminations, and business closures qualify. Quitting without good cause or being fired for misconduct disqualifies you until you find new work and earn at least ten times your weekly benefit rate — at the maximum rate, that’s roughly $8,690 in new wages before benefits can restart.2New York State Senate. On the earnings side, the Department looks at a “base period” of four calendar quarters from your recent work history. For claims filed in 2026, you need at least $3,500 in your highest-earning quarter, and your total base-period wages must equal at least one and a half times that high-quarter amount.3Department of Labor. You also have to be ready, willing, and able to accept work immediately. If you’re out because of illness or injury, unemployment insurance generally isn’t the right program; disability benefits may be.4New York State Senate. New York Code LAB 591 – Eligibility for Benefits

What to Have Ready Before You File

Gather everything first. The online system can time out, and missing information causes delays.5Department of Labor. What Do I Need to File

  • Social Security number
  • Government-issued ID: driver’s license, state ID, or employment authorization number if you’re not a U.S. citizen
  • For each recent employer: legal name, address, Federal Employer Identification Number, and New York State registration number (all on your W-2)
  • Start and end dates for each job
  • Bank routing and account numbers if you want direct deposit (faster than the debit card option)
  • Federal employees: forms SF-8 and SF-506General Services Administration. Standard Form 8 – Notice to Federal Employee About Unemployment Insurance
  • Anyone who served in the military in the last 18 months: form DD-214

How to File

File through the New York Department of Labor’s online portal after creating a NY.gov account.7Department of Labor. After filing, the Department mails a Monetary Benefit Determination showing the base-period wages it used, your calculated weekly rate, and the total available over the life of your claim.9Department of Labor. Errors in wages or employers here will lower every weekly payment for the whole claim, so contact the Department right away if anything is wrong.

Your first full week of the claim is an unpaid waiting week. You still have to certify for it and meet all eligibility requirements, but no payment goes out for that week.10Department of Labor. Certify for Weekly Unemployment Insurance Benefits

How Much You Get and for How Long

Your weekly amount is based on your highest-earning calendar quarter in the base period. If you had wages in all four quarters, the Department divides your high-quarter wages by 26 (or by 25 if that quarter was $3,575 or less). If you were paid in only two or three quarters, it averages your two highest quarters and divides by 26.11Department of Labor. Starting the first Monday of October 2026, the maximum resets to 50 percent of the statewide average weekly wage and cannot drop below the prior year’s cap.12New York State Senate. New York Code LAB 590 – Rights to Benefits So the maximum from October 2026 forward will likely be higher than $869.

You can collect for up to 26 weeks within your benefit year, and the total dollars available equal 26 times your weekly rate.12New York State Senate. New York Code LAB 590 – Rights to Benefits If unemployment across the state rises to certain thresholds, a federal Extended Benefits program can add up to 13 more weeks, but only when triggered.13U.S. Department of Labor. Weekly Certification and Work Search

Every week you want to collect, you have to certify online or by phone that you were unemployed or partially unemployed and met eligibility for the prior week. The certification portal has broader hours than the new-claim portal: Monday through Friday 7:30 a.m. to midnight, and all day Saturday and Sunday.8Department of Labor. You also have to complete at least three work-search activities each week, on different days, and keep a written log.14New York Codes, Rules and Regulations. 12 CRR-NY 473.4 – Work Search Applying for jobs, going to interviews, attending career fairs, and using a staffing agency or career center all count. The Department can request your log at any time; if you can’t produce it, benefits stop. After 10 full weeks of collecting, the definition of “suitable work” widens, and you’re expected to accept jobs outside your usual field if you can do the work.14New York Codes, Rules and Regulations. 12 CRR-NY 473.4 – Work Search Refusing a suitable offer can end your eligibility.

Working Part-Time While Collecting

p>You can work part-time and still receive a partial benefit. New York uses an hours-based reduction:16Department of Labor. Partial Unemployment Eligibility

  • 0 to 10 hours: full weekly benefit
  • 10.1 to 16 hours: 25 percent reduction
  • 16.1 to 24 hours: 50 percent reduction
  • 24.1 to 30 hours: 75 percent reduction
  • Over 30 hours: no benefit that week

If your gross pay for the week is more than $869, you also get nothing that week, no matter your hours.3Department of Labor. Report all part-time work when you certify, even if you haven’t been paid for it yet.

Taxes: The NYC Piece

Unemployment benefits are taxable at every level that applies to NYC residents: federal, New York State, and New York City. Federal law treats the payments as gross income.17Office of the Law Revision Counsel. 26 USC 85 – Unemployment Compensation In January you’ll get a 1099-G showing the total paid the prior year, and that amount goes on your federal return.

You can head off a January bill by asking for 10 percent federal withholding from each payment using IRS Form W-4V.18Internal Revenue Service. About Form W-4V, Voluntary Withholding Request New York does not offer a matching voluntary withholding option for state or city tax on unemployment, so NYC residents should set money aside or make estimated payments to cover state and city liability.

If Your Claim Is Denied

If the Department denies your claim or cuts your benefits, you can request a hearing before an administrative law judge. The deadline is 30 days from the date on the determination notice, and extensions are limited.19Unemployment Insurance Appeals Board. Request a Hearing

You can request a hearing three ways:

  • Online: sign into your NY.gov account and pick “Claimant Request for Hearing” under online forms
  • Mail: NYS Department of Labor, P.O. Box 15131, Albany, NY 12212-5131
  • Fax: 518-457-9378

The request has to be in writing, has to name the determination you’re disputing, and has to say why. A phone call doesn’t count. Bring evidence to the hearing: pay stubs, termination letters, emails, medical records if relevant. Keep certifying every week during the appeal — if you win, you’ll get back payments for the weeks you certified.19Unemployment Insurance Appeals Board. Request a Hearing If the judge rules against you, you have 20 days from the decision to take a second appeal to the Appeals Board.

Overpayments and Fraud

If the Department decides you got benefits you weren’t entitled to, you have to repay them. How hard they push depends on why it happened.

For an honest mistake, like misreporting hours, the Department deducts 50 percent of your weekly benefit from future payments until the balance is cleared. Fraud is far worse. A willful false statement means repaying everything, plus a civil penalty of 15 percent of the overpaid amount or $100, whichever is greater, plus forfeiting between 1 and 20 weeks of future benefits.21New York State Senate. New York Code LAB 594 – Fraud Penalties For willful overpayments, 100 percent of future weekly benefits are offset until the debt is recovered, so you collect nothing.20Department of Labor. Overpayment Waiver and Appeal Process The Department can also file a court judgment that remains enforceable for 20 years and allows wage and bank garnishment.

If You’re Going Back to School

Attending a full-time training program would normally violate the requirement that you be available for immediate work. A Section 599 waiver exempts approved training from the work-search rule.22New York State Senate. New York Code LAB 599 – Career and Related Training The Department has to agree that your training leads to skills with reasonable employment opportunities in New York. Programs can run up to 24 months, and if approval comes through before your regular benefits run out, you may qualify for additional benefits beyond the standard 26 weeks, funding permitting.23Department of Labor. 599 Program Apply as soon as you enroll; waiting until benefits are nearly gone can disqualify you.
