NYCHA Form 040.032, Notice of Intent to Vacate: 30-Day Rule and Inspection

If you live in New York City Housing Authority public housing and plan to move out, you give NYCHA a Notice of Intent to Vacate by filing Form 040.032 with your development’s Property Management Office at least 30 calendar days before your move-out date.1New York City Housing Authority. When You Need To File It

File Form 040.032 any time you decide to permanently leave your NYCHA apartment, whether you are moving to private housing, leaving New York City, or ending your tenancy for any other reason. Either the resident or NYCHA can end a NYCHA lease by giving the other side 30 days of written notice, and this form is the resident’s version of that notice.1New York City Housing Authority. One boundary to be aware of. If you have a Section 8 Housing Choice Voucher and want to move to a different unit, that is voucher portability, handled through HUD Form 52665 and NYCHA’s Leased Housing Department, not through Form 040.032.2U.S. Department of Housing and Urban Development. The 30-Day Rule

NYCHA needs a full 30 consecutive calendar days between the date you file the form and the date you leave. The 30 days do not have to match a calendar month. You can give notice on any day of the month, as long as 30 complete days pass before the move-out date you wrote down.1New York City Housing Authority. Pick a date you can actually meet. A move-out date fewer than 30 days after your submission date does not satisfy the notice requirement, and a date you cannot realistically hit will cost you money for reasons explained below.

What Goes on the Form

The form asks for basic identifying information:

  • Head of household name, as it appears on the lease
  • Current NYCHA address, including development name, building number, and apartment number
  • Intended move-out date, at least 30 calendar days out from the day you submit

The move-out date is the field that matters most. Give yourself enough time to clear the apartment and return your keys by the date you write down.

Where To Submit It and How To Prove You Filed

Turn the completed form in to your development’s Property Management Office, the on-site office where you handle maintenance requests and other lease paperwork. Keep a signed, dated copy for yourself. If you deliver the form in person, ask the office for a stamped or signed receipt showing the date it was received. That receipt is your proof that you met the 30-day deadline and is what you will rely on if NYCHA later disputes when your notice period started.

Rent Runs Until You Hand Over the Keys

You owe rent for every day you remain in the apartment, through the day you turn in the keys and NYCHA takes possession. Filing the form does not prorate or shortcut anything. Leaving earlier than the date on the form does not save you money if you still have the keys, and staying past that date means rent continues to run. The clock stops only when you have moved out, returned the keys, and NYCHA has taken possession of the unit.

Ask To Be Present for the Move-Out Inspection

NYCHA inspects the apartment after you leave. If you gave proper advance notice and want to attend, NYCHA will conduct the inspection with you present.1New York City Housing Authority. Chapter 11 Lease Terminations Being there lets you see what conditions NYCHA is documenting and address anything on the spot, which is worth doing if you might later contest damage charges.

Tell your Property Management Office when you file the form that you want to attend the inspection, and confirm the scheduled date as your move-out approaches. If you leave without notice or without asking to attend, NYCHA inspects on its own and you lose that chance to walk through the findings.

What Happens if You Just Leave

Moving out without filing Form 040.032 is expensive. NYCHA treats the unit as abandoned and charges rent through the date it discovers the apartment is empty and regains possession.1New York City Housing Authority. Filing the form, even at the last minute, caps your rent obligation at a defined end date.

If Someone Else in the Household Wants To Stay

When the head of household moves out, another person in the apartment may be able to take over the lease as a Remaining Family Member. To qualify, that person must have been an authorized household member on the lease, must have lived in the apartment continuously for at least 12 months immediately before the head of household left, and must have appeared on all Affidavits of Income during that period.4New York City Housing Authority. They also need the legal capacity to sign a lease, must pass NYCHA’s criminal background and sex offender screening, and must provide verifiable income so NYCHA can set a new rent. A Remaining Family Member is not on the hook for any unpaid rent the departing tenant left behind; NYCHA writes off the prior tenant’s arrears.4New York City Housing Authority.
