The NYS CCA-2 vendor responsibility questionnaire is the form a for-profit construction business files with the Office of the State Comptroller before it can be awarded a New York State contract. You submit it through the Comptroller’s online VendRep System or on paper, and the contracting agency uses it to decide whether your firm has the financial ability, legal capacity, integrity, and past performance to handle the work.1New York State Senate. New York State Finance Law 163 Get it wrong or skip it, and the agency can find your firm non-responsible and refuse to award the contract.
Who Has to File One
The CCA-2 is specific to for-profit businesses bidding on construction-related state contracts: building, renovation, infrastructure, and similar work. Non-construction vendors and not-for-profits file different questionnaires.2Office of the New York State Comptroller. Vendor Responsibility Forms
Subcontractors proposed for state construction work also have to file. If you are bidding as a joint venture, the joint venture submits a CCA-2 and each member of the venture submits its own separate CCA-2 on top of that.3New York State Department of Transportation. Under State Finance Law Section 163, every agency has to make a responsibility determination before awarding a contract, and the CCA-2 is how they get the information to do it.1New York State Senate. Enroll in VendRep Before You Start
Filing online through the Comptroller’s free VendRep System is faster and more flexible than paper, but you cannot begin until your business is enrolled. What the Questionnaire Asks For
Business and Ownership
The opening section captures legal business name, EIN, address, and entity type (corporation, partnership, sole proprietorship, LLC, or joint venture). You also identify any parent, affiliate, or successor entity.6Office of the New York State Comptroller. New York State Vendor Responsibility Questionnaire For-Profit Construction CCA-2
Then come the principal-owner disclosures, which is where filers slip up. List every person or business entity that is, or has been within the past five years, a principal owner holding 5.0 percent or more of the firm’s shares, one of the five largest shareholders, or an officer, director, partner, or proprietor.6Office of the New York State Comptroller. New York State Vendor Responsibility Questionnaire For-Profit Construction CCA-2 For individuals: name, title, date of birth, ownership percentage, and current employment status. For business-entity owners: name, address, EIN, and ownership percentage. The five-year lookback pulls in people who left before the bid went out, so pull your records before you start typing.
Integrity and Legal History
The core of the form is a series of yes-or-no questions covering roughly the past five years. Every “yes” needs a written explanation with dates, case numbers, jurisdictions, and any corrective action taken.
The bidding-history questions ask whether your firm, any affiliate, or any predecessor has been suspended or debarred from government contracting, had a bid rejected for non-responsibility, had a subcontract rejected, defaulted on a contract, been terminated for cause, or had a surety called in to finish the job. Voluntary bidding exclusions, forfeited standby letters of credit, and monitoring or integrity agreements with any government entity also have to be disclosed.6Office of the New York State Comptroller. Criminal and regulatory questions cover charges, indictments, or convictions for business-related crimes — fraud, extortion, bribery, price-fixing, collusive bidding, tax fraud, racketeering — along with non-business crimes involving truthfulness, like filing false documents or perjury.7Hudson River Park Trust. Labor, safety, and environmental questions ask whether your firm has received a serious or willful OSHA citation with a final determination, had a willful prevailing-wage or supplemental-payment violation found by a government entity, or had any New York State Labor Law violation deemed willful.7Hudson River Park Trust. Under Article 8 of the Labor Law, repeat willful prevailing-wage violations can trigger a five-year debarment from public work that must be disclosed here.8New York State Department of Labor. Article 8 Frequently Asked Questions
Financial-integrity questions ask about liens, claims, or judgments over $25,000 that stayed undischarged or unsatisfied for more than 90 days in the past five years. Tax warrants and tax liens count; UCC filings do not.7Hudson River Park Trust. Vendor Responsibility Questionnaire For Profit Construction CCA-2 A separate seven-year question covers bankruptcy proceedings initiated by or against the business or any affiliate, open or closed. For each one, give the chapter, court name, docket number, and current status.
Supplemental Schedules
Three supporting documents must be submitted with the CCA-2:9Office of the New York State Comptroller. For-Profit Construction Questionnaire CCA-2
- A schedule of completed construction contracts with contract values, project owners, and completion dates.
- A schedule of uncompleted contracts showing estimated completion dates and remaining balances.
- Financial information — balance sheet and income data — showing you can take on more work.
Pull these together before you open the questionnaire. The completed and uncompleted schedules show the agency whether you have the track record and the current bandwidth; the financial schedule shows whether a new contract will stretch you past your limits.
Why Honest Answers Matter
A CCA-2 you know to be false is not just grounds for a non-responsibility finding. It can be prosecuted as offering a false instrument for filing in the first degree under Penal Law Section 175.35, a class E felony.10New York State Senate. New York Penal Law PEN 175.35 Leaving out something you know about carries the same risk as writing something untrue. Disclose, then use the explanation fields to give context.
Submitting the Form
In VendRep, review every field and explanation, certify, and submit electronically. No physical signature is needed, and the questionnaire becomes visible to every state contracting agency immediately — one filing covers every open bid.5Office of the New York State Comptroller. Paper filing is still an option. Download the PDF from the Comptroller’s site, complete it, and mail it to the Bureau of Contracts at the address in the form’s instructions.9Office of the New York State Comptroller. How Long It Stays Good
A CCA-2 is generally valid for one calendar year.3New York State Department of Transportation. New York State Vendor Responsibility Questionnaire For Profit Construction CCA-2 If you filed one within six months of a new bid date and nothing has changed, you can submit an Affidavit of No Change to the new contracting agency instead of refiling the whole thing. Major changes — an acquisition, a bankruptcy filing, a new criminal charge — require an immediate update even if the questionnaire is less than a year old.11Office of the New York State Comptroller. The VendRep System A contracting agency or the Comptroller’s office can also ask for an update at any time if something comes to their attention. Keeping the profile current between bids is easier than scrambling under a bid deadline.
If the Agency Finds You Non-Responsible
The responsibility determination belongs to the contracting agency that issued the solicitation. If it preliminarily finds your firm non-responsible, it has to notify you in writing with the specific reasons. You then have a reasonable period to submit a written appeal, and if the facts are in dispute the agency may hold a hearing, though it is not required to. The agency then issues a final determination.12Office of the New York State Comptroller. XI.16 Vendor Responsibility
After administrative remedies are exhausted, judicial review runs through an Article 78 proceeding under New York’s Civil Practice Law and Rules. The petition must be filed within four months of the final agency determination. Courts will overturn the finding only if it was arbitrary and capricious, affected by an error of law, or unsupported by substantial evidence. Judges give significant deference to agency procurement decisions, which makes getting the questionnaire right the first time the surest strategy.
