Who Files Form IT-201
IT-201 is the return for full-year New York residents. Two tests in Tax Law Section 605 decide residency, and meeting either one puts you on this form.2New York State Senate. New York Tax Law 605 – General Provisions and Definitions
The domicile test looks at where your permanent home is. If New York is the place you always intend to return to, it stays your domicile no matter how much of the year you actually spend here.
The statutory resident test catches people whose domicile is somewhere else but who keep a permanent place to live in New York and spend more than 183 days here during the tax year. Active-duty military members are exempt from this second test. If you moved into or out of New York during the year, you file Form IT-203 instead.
Residency alone does not always mean you have to file. You must file IT-201 if you were required to file a federal return, if your federal adjusted gross income plus New York additions exceeded $4,000 (or $3,100 for a single dependent) even without a federal filing requirement, if you want a refund of state, city, or Yonkers tax withheld from your pay, or if you want to claim a refundable or carryover credit.3Department of Taxation and Finance. What to Have in Front of You
The New York return starts from your federal numbers, so finish (or at least draft) the federal return first. The form uses your federal adjusted gross income as its opening line and then applies New York-specific adjustments.4Department of Taxation and Finance. - W-2s from every employer during the year
- 1099s for freelance work, interest, dividends, retirement distributions, and other non-wage income

Working Through the Form
Filing Status

New York Additions
Additions are items federal law lets you exclude or defer that New York still taxes. The two you are most likely to see are interest earned on bonds issued by other states (New York bonds are exempt) and public employee 414(h) retirement contributions taken from your paycheck before federal tax.5New York State Department of Taxation and Finance. New York Subtractions
Subtractions run the other direction, removing income that is federally taxable but not taxed by New York. Pensions from New York State and local governments, federal government pensions, and interest on U.S. government bonds are the common ones. After both adjustments, you have your New York adjusted gross income.
Standard or Itemized Deduction
Every filer picks either the New York standard deduction or an itemized deduction computed on Form IT-196. For the 2025 tax year the standard amounts are $8,000 for single, $16,050 for married filing jointly or qualifying surviving spouse, and $11,200 for head of household. Itemizing only pays off when your qualifying expenses beat those numbers, and New York’s itemized rules do not always match the federal version, so you may claim different amounts on each return.
Calculating the Tax
New York uses graduated rates that run from 4% at the bottom up to 10.9% on income above $25 million for the 2025 tax year.6Department of Taxation and Finance. 2025 Tax Tables Use the tax tables if your New York adjusted gross income is $107,650 or less. Above that, use the rate schedule.
New York City, Yonkers, and MCTMT
If you live in New York City, the same form calculates your city income tax at its own graduated rates. Yonkers residents owe a surcharge computed as a percentage of state tax. Both sit in dedicated sections of IT-201, so there is no separate city return. Self-employed people whose net self-employment income within the Metropolitan Commuter Transportation District exceeds $50,000 also report the MCTMT near the end of the form.
Credits Worth Checking
Two credits reach a large share of filers.
The Empire State Child Credit is refundable and available to full-year residents with at least one qualifying child under 17 at year end. For 2026 returns it is $1,000 per child under four and $500 per child aged four through 16, phasing out starting at $110,000 of federal adjusted gross income for joint filers, $75,000 for single or head of household, and $55,000 for married filing separately.7Department of Taxation and Finance. If you qualify for the federal earned income credit, New York adds a credit equal to 30% of the federal amount, fully refundable for full-year residents.8Department of Taxation and Finance. How to Submit and Pay
New York requires electronic filing if you prepare your return with software that supports it and you have broadband internet access. The mandate does not apply if you fill out forms downloaded from the department’s website or picked up at a library. State law also bars software companies from charging a separate fee for the e-filing itself when it is bundled with preparation.9Department of Taxation and Finance. If you file on paper, the address depends on whether a payment is enclosed. Deadline, Extension, and Late Penalties
The 2025 return is due April 15, 2026. If you cannot make that date, Form IT-370 buys an automatic six-month extension to October 15, 2026. The extension moves the filing deadline only. Any tax you expect to owe is still due April 15, and interest runs on unpaid balances from that date forward.
Filing late and paying late trigger separate penalties that can stack. The late filing penalty is 5% of the unpaid tax for each month or partial month the return is overdue, capped at 25%.13Department of Taxation and Finance. Filing the extension prevents the filing penalty but does not stop the payment penalty or interest.
Fixing a Return After You File
If you catch an error later, or the IRS adjusts your federal return, file Form IT-201-X. The general amendment deadline is three years from the original filing date or two years from the date you paid the tax, whichever is later. A much tighter clock applies when the IRS changes your federal return: you have 90 days from the date of the IRS final determination to file the amended New York return. If any federal adjustment notice lands in your mail, mark that 90-day date immediately.
