NYS Notary Renewal: Online, Mail, Oath, and Grace Period

A New York State notary commission lasts four years, and NYS notary renewal opens up to 90 days before your expiration date through the state’s Business Express portal. The fee is $60, and you’ll need to submit a signed oath of office along with your application. If your commission has already lapsed, you still have a six-month window to reapply without retaking the written exam.

When to Renew and the Six-Month Grace Period

Your expiration date is printed on your notary identification card. You can file your renewal application up to 90 days before that date, and starting early is the safest way to avoid a gap in your authority.¹

If the date has already passed, don’t panic. The Secretary of State has authority to waive the qualifying requirements for anyone who applies for reappointment within six months of expiration, which means you can renew without sitting for the written exam again.² Miss that six-month window and you’re treated as a brand-new applicant: $15 exam fee, written test, and the full application process from the start.³

One thing to be clear about: during any period your commission is expired, you have no legal authority to perform notarial acts. Any document you notarize during a lapse can be challenged, so wait until you have confirmation your renewal has gone through before signing anything.

How to Renew Online

The Department of State’s preferred channel is the online portal at businessexpress.ny.gov. The steps run in this order:¹

Go to businessexpress.ny.gov, click “Search Applications,” and search for “Notary.” Sign into your NY.gov account or create one if you don’t have it yet.
Open “My Dashboard” and find your existing notary record. The system will pull in your current information.
Before starting the application, download and print the oath of office form so you can complete it separately (more on this below).
Upload the scanned, signed oath when the application prompts you, verify your personal details, and continue to payment.
Pay the $60 fee by credit or debit card.

After payment, you’ll get a confirmation receipt by email. Your new notary identification card will be mailed to the address on file. Delivery times vary and can run from a few days to several months depending on processing volume, so keep the confirmation email as proof your renewal was submitted.⁴

How to Renew by Mail

If you’d rather use paper, you can. Your submission must include your name, license number (UID), address, and expiration date. Incomplete or inaccurate applications are returned.¹

For overnight or express services like UPS or FedEx, use the physical address: Division of Licensing Services, 1 Commerce Plaza, 99 Washington Avenue, 6th Floor, Albany, NY 12231.¹ Paper generally takes longer to process than online submissions, so give yourself extra runway if your expiration is close.

The Oath of Office Step

This is the part that trips people up. The oath of office is not signed electronically inside the portal. You have to sign the form in the physical presence of another commissioned notary public, then scan the completed document and upload it (or mail it) with the rest of your renewal.⁵

Plan ahead. Tracking down another notary, getting the signature, and scanning the form usually takes longer than filling out the online application itself. If you work in an office that employs other notaries, this is a five-minute task. If you don’t, banks, shipping stores, and public libraries are common options.

Updating Your Name or Address at Renewal

If your name has changed since your last commission, you can update it during the renewal itself, or you can file a separate name-change form at any time during your term for a $10 fee. That $10 fee is waived when the change is due to a change in marital status.⁶

You’ll need to provide proof. Acceptable documents include a court order, marriage certificate, driver’s license, valid passport, or immigration documents.⁶ If you change your name mid-term rather than at renewal, you won’t get a new ID card. You continue notarizing under the name on your current commission until the next cycle.

Address changes matter too, because your new ID card and any correspondence from the Department of State goes to whatever address the state has on file.

Attorneys Admitted to the New York Bar

Attorneys admitted to practice in New York’s courts of record are exempt from the notary qualifying exam, both at initial appointment and at renewal.² The four-year term, the $60 fee, the application, and the oath of office all still apply. The practical benefit shows up if the commission lapses past six months: an attorney still won’t have to retake the exam to get recommissioned.

Attorneys should also keep in mind that the $375 biennial attorney registration paid to the Office of Court Administration is a separate obligation. It keeps your law license active. It does not renew your notary commission.

Who Can Still Qualify to Renew

To renew, you need to still meet the underlying qualifications for the commission. You must be a New York resident or maintain an office or place of business in the state. A nonresident who no longer has a New York office loses the commission automatically.²

A criminal conviction doesn’t automatically disqualify you, but it does trigger review. The Secretary of State evaluates convictions under Article 23-A of the Correction Law and decides whether the offense bars appointment.² The Secretary can also suspend or remove a sitting notary for misconduct, but only after serving formal charges and giving the notary an opportunity to respond.

One last boundary worth naming: renewing your traditional commission does not give you authority to perform remote online notarizations. That requires a separate electronic notary public commission, applied for through the same Business Express portal and linked to your existing record.⁶ If you already hold that electronic commission, you’ll want to keep both current on the same cycle.
