Oakland City Transfer Tax: Rates, Exemptions, and Refunds

The Oakland city transfer tax runs from 1% to 2.5% of the sale price, with the rate set by which price tier the transaction falls into. It applies every time real property changes hands inside city limits, it sits on top of a separate Alameda County documentary transfer tax, and both the buyer and the seller are legally on the hook for it.

How Much You Owe by Sale Price

Oakland uses four tiers, and the rate for your tier applies to the entire sale price, not just the portion above the tier’s floor. These are flat rates by bracket, not marginal ones.

  • $300,000 or less: 1.0% ($10 per $1,000)
  • $300,001 to $2,000,000: 1.5% ($15 per $1,000)
  • $2,000,001 to $5,000,000: 1.75% ($17.50 per $1,000)
  • More than $5,000,000: 2.5% ($25 per $1,000)

A home selling for $1.2 million falls in the second tier, so the full $1.2 million is taxed at 1.5%, producing an $18,000 city transfer tax.1City of Oakland. The County Tax Stacks on Top

Alameda County charges its own documentary transfer tax at $1.10 per $1,000 of the property value, authorized under California Revenue and Taxation Code Section 11911.2Alameda County Clerk-Recorder. On the $1.2 million sale above, that adds $1,320 to the $18,000 city tax, for $19,320 in combined transfer tax. Buyers and sellers who plan only around the city rate get surprised at closing.

Who Pays

Oakland’s municipal code makes the buyer and seller jointly responsible for the full amount, meaning the city can pursue either party if the tax goes unpaid.3Alameda County Registrar of Voters. Measure W City of Oakland Who actually writes the check is a contract question. Local custom in Oakland is often a 50/50 split, but that is entirely negotiable. In a hot market a buyer might offer to cover it in full to strengthen a bid; in a slow one a seller might absorb it to close the deal.

Spell the allocation out in the purchase agreement. Language leaning on “customary” splits invites arguments over thousands of dollars in the final days of escrow.

First-Time Homebuyer Discount

Qualifying low-to-moderate-income first-time homebuyers get a 0.5% reduction on the transfer tax rate for properties valued at $2 million or less. On a $900,000 purchase, the standard city tax of $13,500 drops to $9,000, a $4,500 savings. If you think you might qualify, tell your escrow officer or agent early so the declaration form is prepared at the discounted rate.

Transfers That Aren’t Taxed

Several common transfers fall outside the tax:

  • Transfers into a revocable trust for the benefit of the person transferring the property, or their spouse, where beneficial ownership doesn’t change.
  • Interspousal transfers and transfers between domestic partners, including conveyances tied to divorce or legal separation.
  • A deed of trust given to a lender as security for a mortgage, since no sale has occurred.

When and How It Gets Paid

The transfer tax is due when the deed is recorded at the Alameda County Clerk-Recorder’s office, and in nearly every transaction the escrow company pays it out of funds collected at closing.1City of Oakland. Once the recorder verifies payment, a documentary transfer tax stamp goes on the deed, and the recorded deed becomes proof the city and county taxes were paid. Refunds for Overpayment

File promptly, because municipal refund claims are generally subject to time limits.
