Oakland gun laws operate on two layers: California sets the baseline rules for buying, carrying, and storing firearms, and the City of Oakland adds its own ordinances on top. Following state law alone can still put you in violation of a city ordinance, so both have to be read together.
Who Cannot Legally Own a Gun
California permanently bars anyone convicted of a felony, anyone addicted to a narcotic drug, and anyone with an outstanding felony warrant they know about from owning or possessing a firearm.1California Legislative Information. California Penal Code PEN 29800 Possession in violation of that ban is itself a felony.
Several misdemeanors also trigger a prohibition. The list in Penal Code 29805 includes domestic violence, assault, battery, stalking, criminal threats, and brandishing. A misdemeanor domestic violence conviction under Section 273.5 brings a lifetime ban for any conviction on or after January 1, 2019.2California Legislative Information. California Penal Code PEN 29805
Mental health history can disqualify you as well. An involuntary 72-hour hold triggers a five-year ban; other categories, including a finding of not guilty by reason of insanity, can last longer or be permanent depending on the underlying offense.3California Legislative Information. California Welfare and Institutions Code WIC 8103 A gun violence restraining order can separately bar possession of firearms, ammunition, magazines, and body armor for up to five years, and the restrained person must surrender any firearms to law enforcement.4California Legislative Information. Buying a Firearm
Age and the Firearm Safety Certificate
Licensed dealers in California generally cannot sell any firearm to anyone under 21. The narrow exception lets licensed hunters 18 or older buy certain long guns that are not handguns or semiautomatic rifles. For most Oakland buyers, the floor is 21.
Before you can buy, you need a Firearm Safety Certificate. The $25 test is 30 true-or-false and multiple-choice questions on safe handling and basic gun law, and you need at least 23 correct to pass.5State of California – Department of Justice – Office of the Attorney General. Firearm Safety Certificate Program The fee covers two attempts with the same Department of Justice–certified instructor, usually found at a licensed dealer.
Fees and the 10-Day Wait
Every purchase or transfer runs through the Dealer’s Record of Sale process. State fees total $37.19: a $31.19 DROS fee, a $1.00 Firearms Safety Act fee, and a $5.00 Safety and Enforcement fee.6State of California – Department of Justice – Office of the Attorney General. Frequently Asked Questions The firearm cannot be released to you for at least 10 days after the paperwork is submitted, and that applies to every purchase, not just your first.7California Legislative Information. California Penal Code 26815 If the Department of Justice asks you to correct your application, the 10-day clock restarts when you resubmit.
Private Sales Have to Go Through a Dealer
California does not permit informal gun sales between individuals. Every private transfer, including most transfers between family members, has to go through a licensed dealer who runs the same background check and DROS process.8California Legislative Information. California Penal Code PEN 27545 The dealer can add up to $10 per firearm to the state fee, and the 10-day wait still applies.6State of California – Department of Justice – Office of the Attorney General. The Oakland Police Department does not currently accept or process concealed carry weapon applications. Oakland residents apply through the Alameda County Sheriff’s Office.9Alameda County Sheriff’s Office, CA. Concealed Carry Weapon License
What You Need to Qualify
You must show good moral character, live in Alameda County or have your principal workplace there, and finish a training course.10California Legislative Information. California Penal Code PEN 26150 First-time applicants need at least 16 hours of training including live-fire proficiency with each firearm you want listed on the permit.11California Legislative Information. California Penal Code 26165 Course fees typically run $175 to $350.
The application uses the Department of Justice Standard Application, Form BOF 4012, which asks for detailed personal history, prior addresses, employment, and the serial number and caliber of every firearm you want to carry.12California Department of Justice. Standard Initial and Renewal Application for License to Carry a Weapon Capable of Being Concealed Errors can delay or sink the application.
Cost, Timing, and Denials
Applications go through the Sheriff’s online portal. You will undergo state and federal background checks, and the licensing authority can require a psychological assessment and charge up to $150 for it.13California Legislative Information. California Penal Code 26190 The initial application fee is roughly $347 and is subject to change. Plan on several months from submission to decision.
If the Sheriff denies your application, you get written notice of the grounds. You have 30 days from that notice to request a hearing in the superior court for your county of residence. Some licensing authorities require an internal appeal first.14State of California – Department of Justice – Office of the Attorney General. Frequently Asked Questions
Where a CCW Permit Does Not Let You Carry
Under Penal Code 26230, added by Senate Bill 2, a permit does not authorize carry in these places:
- Buildings and parking areas controlled by a local government or state executive or legislative officer
- Courts and buildings designated for court proceedings
- Preschools, K-12 schools, childcare facilities, and their parking areas
- Hospitals, mental health facilities, nursing homes, medical offices, and urgent care centers
- Publicly funded transit vehicles, stations, and parking areas
- Public parks, athletic areas, playgrounds, youth centers, and adjacent sidewalks and streets
- Any establishment that sells alcohol for on-site consumption
- Permitted public gatherings and special events, plus sidewalks within 1,000 feet
- Places of worship and polling places during elections
That list covers most of the public spaces an Oakland permit holder moves through on a given day. Carrying in a prohibited location can bring criminal charges and cost you the permit.
Carrying Without a Permit
Carrying a loaded firearm in public without a permit is illegal in any incorporated city in California, which includes all of Oakland. The baseline offense is a misdemeanor with up to one year in county jail and a $1,000 fine.16California Legislative Information. California Penal Code PEN 25850 It becomes a felony if you have a prior felony conviction, if the gun is stolen and you knew or should have known, if you are an active gang participant, or if you are otherwise barred from possessing firearms. Carrying a loaded gun that is not registered to you can also expose you to felony-level punishment.
Oakland’s Storage Rules
At Home
Oakland goes beyond state law. Any firearm in a residence that is not being carried on your person must be kept in a locked container or disabled with a trigger lock from the state Department of Justice’s approved list. A “locked container” means a fully enclosed, hard-sided container secured with a padlock, key lock, combination lock, or similar device. A purse, backpack, or fabric bag does not count.17Municode. Oakland Municipal Code Chapter 9.39 – Safe Storage of Firearms in a Residence
A violation is a misdemeanor carrying up to six months in county jail, a fine of up to $1,000, or both. The city can also impose a separate $1,000 civil penalty per violation.
In Vehicles
Oakland Municipal Code 9.36.170 requires any firearm left in an unattended vehicle to be locked in a container that is not visible from outside or stored in the trunk. The ordinance was enacted to curb thefts of guns from cars. Violations can bring misdemeanor charges.
Child Access
California’s criminal storage law adds separate liability if a child or prohibited person gets to your firearm. Penalties scale with what happens: criminal storage in the first degree, when the person causes death or great bodily injury, is punishable by 16 months, two, or three years in prison and a fine of up to $10,000; lesser degrees apply when injury is less serious or when a child simply gains access.18California Legislative Information. California Penal Code Part 6, Title 4, Division 4, Chapter 2 If the gun is locked in a container, fitted with an approved trigger lock, or on your person, the statute does not apply, and it also does not apply when access came through an illegal break-in.
Weapons You Cannot Own at All
Assault Weapons and .50 BMG Rifles
California bans the manufacture, sale, transport, import, and possession of assault weapons and .50 BMG rifles. A first offense involving a single weapon is a felony punishable by four, six, or eight years in state prison, and each weapon is a separate offense. Transferring an assault weapon to a minor adds a consecutive one-year enhancement.19California Legislative Information. California Penal Code PEN 30600
Large-Capacity Magazines
Possessing a magazine that holds more than 10 rounds is either an infraction with a fine of up to $100 per magazine or a misdemeanor with up to one year in county jail, a $100-per-magazine fine, or both.20California Legislative Information. California Penal Code PEN 32310 If you have any, your legal options are to take them out of state, sell them to a licensed dealer, or surrender them to law enforcement.
Ghost Guns
Oakland specifically prohibits possessing, buying, selling, or transporting unserialized firearms and unfinished frames or receivers that lack a serial number from a federal firearms manufacturer or authorized licensee. The exceptions are narrow: licensed gunsmiths, firearms manufacturers, and law enforcement.21Oakland Municipal Code. Oakland Municipal Code 9.36.190 – Unfinished Frame or Receiver and Firearms Not Containing Serial Numbers Prohibited For anyone else, possession means confiscation and possible prosecution.
Getting Rid of a Firearm You Don’t Want
The Oakland Police Department partners with community groups on an annual “Guns to Gardens” buyback where residents can turn in firearms anonymously for gift cards worth up to $300.22City of Oakland, CA. Annual Guns to Gardens Event Collects Dozens of Firearms Outside of buyback events, you can surrender a firearm to any law enforcement agency. To transport it to a station, keep it unloaded and locked in a container separate from any ammunition.
