Oakland Planning Code: Zoning Districts, Variances & Appeals

Title 17 of the Oakland Municipal Code, known as the Oakland Planning Code, is the citywide rulebook for how land can be used and developed, from a backyard addition to a new apartment building. The Planning and Building Department administers it, reviews proposals, and enforces compliance.1Municode Library. Planning Code What follows is the practical shape of the code: what controls your project, what you’ll have to file, and what happens if the city says no.

Start With Your Zoning District

Every parcel in Oakland sits in a zoning district, and the district controls what you can build and what business you can operate. The main families are residential, commercial, industrial, and special-purpose. Residential zones split into RD (Detached Residential) for traditional single-family areas and RM (Mixed Housing Type) zones that run from duplexes up to apartment buildings. Commercial zones range from CN (Neighborhood Commercial) at the small-shop end to CC (Community Commercial) for larger shopping areas. Industrial districts like IG (General Industrial) and CIX (Commercial Industrial Mix) handle manufacturing and logistics.

Before anything else, confirm your district. The city publishes an online zoning map, and the Planning and Building Department can confirm the designation on a specific parcel. Everything below depends on this one answer.

What the Development Standards Control

Once you know the district, the development standards tell you how tall, how dense, and how close to the property line you can build.

Height

Height limits track the zone and the slope of your lot. In the RM zones, maximum wall heights run from 30 feet in RM-1 and RM-2 to 35 feet in RM-3 and RM-4, and pitched roofs can reach 35 feet across all RM zones on relatively flat lots.2Municode Library. Oakland Code Title 17 Chapter 17.17 – RM Mixed Housing Type Residential Zones Regulations Lots with a grade over 20% can go slightly taller but face additional controls measured from the pavement edge or the rear setback line. Downtown and central business zones allow substantially greater heights, with specific limits set by the district overlay.

Density

Density caps the number of housing units a lot can hold. The RM zones work on a sliding scale: any legal lot can carry up to two units, and for projects of five or more units, RM-1 allows one unit per 1,750 square feet of lot area, RM-2 one per 1,500, RM-3 one per 1,250, and RM-4 one per 1,000.2Municode Library. Oakland Code Title 17 Chapter 17.17 – RM Mixed Housing Type Residential Zones Regulations Projects that include affordable units can earn more density under California’s Density Bonus Law (Government Code Section 65915), which starts at a 20% bonus for setting aside at least 10% of units for lower-income households or 5% for very low-income households.3California Legislative Information. California Government Code 65915

Lot Coverage

Lot coverage limits how much of your parcel the building can occupy. In the RM zones, one- and two-unit projects get 55% coverage on lots under 6,000 square feet, 45% on lots between 6,000 and 12,000 square feet, and as little as 15% on lots of an acre or more. RM projects with three or more units have no lot coverage maximum but still have to meet setback and open-space rules.2Municode Library. Setbacks

Setbacks are the minimum distances a building must sit from your property lines. In residential zones, front setbacks typically run 15 to 20 feet, side setbacks can be as little as 4 to 5 feet, and rear setbacks mirror side setbacks or run slightly larger. Small encroachments can draw enforcement, so get these right at the plan stage.

Parking Minimums

Chapter 17.116 sets minimum off-street parking by use and zone. A single-family home in the RD zones needs two spaces per unit; in RM-1, a home needs one and a half spaces per unit. Higher-density and downtown zones drop or eliminate the requirement.

Commercial ratios depend on both the business and the zone. A retail shop in most zones needs one space per 200 to 300 square feet of customer-facing floor area. Medical offices need one space per 400 square feet in most zones, dropping to one per 600 square feet in neighborhood commercial districts. Restaurants in most zones need one space per 200 square feet.4City of Oakland. Oakland Code Chapter 17.116 – Off-Street Parking and Loading Shared parking agreements and transportation demand management plans in transit-rich areas can bring these numbers down.

Permitted Uses and Conditional Use Permits

The code sorts activities into those allowed outright and those that need a Conditional Use Permit. Permitted uses are considered inherently compatible with the zone, like a single-family home in a residential district or a bookstore in a commercial one, and move through review quickly.

Conditional uses can create noise, traffic, or other neighborhood impacts. Chapter 17.134 governs the CUP process. To approve a CUP, the city must find that the project’s location, size, and operating characteristics will be compatible with surrounding properties, that the design will provide a functional environment, and that the project conforms with the Oakland General Plan.5Municode Library. Oakland Code Title 17 Chapter 17.134 – Conditional Use Permit Procedure Approvals usually come with binding conditions, like operating hour limits or soundproofing requirements.

Each zone has a use classification table showing which activities are permitted, which need a CUP, and which are prohibited. Check these before you sign a lease or close on a parcel.

Accessory Dwelling Units

Oakland allows ADUs on residential lots under both city rules and California state law. A detached or attached ADU can be up to 850 square feet for a studio or one-bedroom, or 1,000 square feet for a two-bedroom. Detached ADUs require a four-foot side and rear setback and max out at 16 feet tall, with the front setback matching the underlying zone. Attached ADUs cannot exceed 50% of the primary home’s floor area. ADUs go through a streamlined review and cannot be denied if they meet the objective standards in the code.

Variances When the Standards Don’t Fit Your Lot

Chapter 17.148 lets you apply for a variance when strict compliance would create unreasonable hardship because of your lot’s unique physical conditions. The code separates major variances (heard by the Planning Commission at a public hearing), minor variances (decided by the Director of City Planning), and minor zoning exceptions (handled by the Zoning Manager).6Municode Library. Oakland Code Title 17 Chapter 17.148 – Variance and Exception Procedure

Variances are hard to get by design. You have to show that strict compliance would cause practical difficulty or unnecessary hardship due to unique site conditions, that it would deprive you of privileges enjoyed by similar properties, that it won’t harm surrounding properties, and that it won’t amount to a special privilege inconsistent with how similar parcels are treated.6Municode Library. Oakland Code Title 17 Chapter 17.148 – Variance and Exception Procedure Wanting more floor area or a taller building isn’t enough. The hardship has to come from the property itself, not from personal or financial circumstances.

Applications, Fees, and Timing

Every project starts with the Basic Application for Development Review, which collects the project description, property details, and owner authorization.7City of Oakland. Basic Application for Development Review You’ll also need site plans showing property lines and proposed changes, architectural elevations, floor plans, accurate floor area ratio and lot coverage calculations, and your Assessor’s Parcel Number. Submissions go in digitally in the formats the city specifies. Incomplete or inaccurate plan sheets are one of the most common reasons applications stall, and professional drafting usually pays for itself in avoided revision cycles.

Fees are substantial and scale with complexity. For fiscal year 2025-2026, a minor design review runs about $5,100 when the project is exempt from environmental review, a minor CUP or variance costs roughly $5,350, a major CUP about $12,250, and a major variance around $13,200. Fees stack when a project needs multiple permits: a combined major CUP, variance, and design review totals approximately $35,200.8City of Oakland. Zoning Permit Fees Schedule Fiscal Year 2025-2026 Projects requiring an Initial Study or Environmental Impact Report follow a slightly different fee structure. All fees are due at application and are subject to change without notice.

After filing through the online permit portal, planning staff run a completeness check. Under California’s Permit Streamlining Act (Government Code Section 65943), the city has 30 calendar days to tell you in writing whether the application is complete, and if the city misses that deadline the application is deemed complete automatically.9California Department of Housing and Community Development. Portions of the Permit Streamlining Act If it isn’t complete, the city has to give you an exhaustive list of what’s missing.10California Department of Justice. Legal Alert OAG 2025-04 – Consistent Interpretation of the Permit Streamlining Act 90-Day Rule Complete applications move into substantive review for compliance with zoning, development, and overlay standards. Significant projects trigger public notification by mail to property owners and occupants within 300 feet of the site.11Municode Library. Oakland Code Title 17 Chapter 17.140 – Planned Unit Development Procedure Review ends in a decision that approves outright, approves with conditions, or denies. Approvals then move to the building permit phase.

Environmental Review

The California Environmental Quality Act makes the city evaluate environmental impacts before issuing permits on most projects. Smaller projects can qualify for a categorical exemption. Larger projects may need an Initial Study, and when significant impacts turn up, a full Environmental Impact Report. The city publishes CEQA Thresholds of Significance that standardize how impacts get analyzed.12City of Oakland. Environmental Review Documents (CEQA/EIR) For complex projects, environmental review is often the longest piece of the schedule, so figure out early whether it applies.

Appeals

If you disagree with a planning decision, or a neighbor objects to an approval, there’s a formal appeal. Appeals of Zoning Manager decisions must be filed within 10 calendar days and submitted by 4:00 p.m. on the deadline date. The appeal has to spell out where the decision involved an error or abuse of discretion, or lacked substantial evidence.13City of Oakland. Applications on File A filing fee set by the Master Fee Schedule applies.

The appeal path depends on who decided the matter. Staff decisions generally go to the Planning Commission, and Planning Commission decisions can go to the City Council. One rule catches people out: at the appeal, you can only raise issues that were raised in writing during the original public comment period. Arguments you didn’t make earlier are off the table at the appeal hearing and in any later court challenge.14Municode Library. Oakland Code Title 17 Chapter 17.130 – Administrative Procedures – General If the Planning Commission deadlocks, the original staff decision stands as final unless the matter is forwarded to the City Council.

What Happens If You Build Without Approval

Building or operating outside Title 17 triggers enforcement. The process usually starts with a courtesy notice or notice of violation that gives the property owner a chance to correct the problem. If violations continue, the city can issue administrative citations with escalating daily fines. In 2020, Oakland voters approved Measure RR, which removed a prior $1,000 cap on fines for ordinance violations from the city charter and gave the City Council authority to set higher fine limits by ordinance. Penalties for ongoing planning code violations can now run well above the old ceiling, and the city has more leverage on persistent problems.
